RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL REJECTING ALL COMPETITIVE PROPOSALS FOR
THE PURCHASE OF MULTI -SPACE PARKING METER
EQUIPMENT, BID NO. 502-02, WAIVING COMPETITIVE
BIDDING PURSUANT TO SAN RAFAEL MUNICIPAL CODE
SECTION 2.55.070(D), AND AUTHORIZING STAFF
NEGOTIATIONS TO CONTRACT FOR THE PURCHASE OF THE
EQUIPMENT IN AN AMOUNT NOT TO EXCEED $50,000.
WHEREAS, on the 19`h day of August, 2002, pursuant to Resolution 11158, the City
Council did grant permission to contract for the purchase of multi -space parking meter
equipment by use of Competitive Negotiation; and
WHEREAS, on the 18`h day of September, 2002, pursuant to due and legal notice
published in a manner provided by law, competitive proposals for negotiation for the equipment
hereinafter mentioned, the City Clerk of the City of San Rafael did publicly open, examine and
recorded all sealed proposals for furnishing the following equipment:

in accordance with the specifications therefore on file in the office of said City Clerk; and
WHEREAS, the City Council has reserved the right to reject all competitive proposals
pursuant to Section 2.55.240 of the San Rafael Municipal Code, which reservation of right is
referenced in Section II, item 17 of the Request for Proposal; and
WHEREAS, the City Council may approve the waiver of competitive bidding for the
purchase of equipment, and authorize purchases of such equipment by City staff without recourse
to competitive bidding where valid reasons exist to do so, pursuant to San Rafael Municipal
Code Section 2.55.070(D); and

WHEREAS, staff recommends the rejection of all competitive proposals for the purchase
of the Multi -Space Meter Equipment due to lack of proposals and project costs that exceed
project budgets; and
WHEREAS, the City Council finds that valid reasons exist at this time for the waiver of
competitive bidding for purchase of the Multi -Space Parking Meter Equipment, since such
equipment can not be obtained on a timely basis with renewed competitive negotiation of the
purchase, and contracts for purchase of the equipment must be completed by staff negotiations
with a vendor on an expedited basis in order to assure timely delivery of the equipment and avoid
a reduction in services to the community by the equipment and City's Parking Services Division;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
San Rafael that the Mayor and City Clerk are authorized to reject all competitive proposals for
the Multi -Space Parking Meter Equipment, Bid No. 502-02.
IT IS FURTHER RESOLVED that the City Manager is authorized to negotiate and
execute a contract or contracts with a vendor for purchase of multi -space parking meter
equipment, software, and other components for off-street parking operations in San Rafael, in a
total amount not to exceed $50,000.00.

foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of the
City Council of said City held on Monday, October 21, 2002, by the following vote, to wit:
