HomeMy WebLinkAboutCC Resolution 11235 (Massage/Body Works Practitioner Examination)RESOLUTION NO. 11235 RESOLUTION APPROVING FORM OF EXAMINATION FOR MASSAGE AND/OR BODYWORK PRACTITIONERS PURSUANT TO SAN RAFAEL MUNICIPAL CODE SECTION 8.34.060 WHEREAS, the City Council has adopted Chapter 8.34 of the San Rafael Municipal Code regulating offices, establishments and practitioners providing massage/bodywork services; and WHEREAS, Subsection A.13 of Section 8.34.060 of the San Rafael Municipal Code provides that, the City Council may establish by Resolution, in a form approved by Council, a written examination to test the new applicant's basic knowledge of anatomy, physiology, hygiene and massage, as well as knowledge of the requirements as stated in Section 8.34.090; and WHEREAS, the Police Department conducted a study of tests currently in use in other municipalities and schools of massage and/or bodywork; and assembled data concerning examination questions in the aforementioned knowledge areas; and WHEREAS, the Police Department presented the pool of examination questions to representatives of current holders of valid massage and/or bodywork permits, who deemed the pool of examination questions met the intent of testing basic knowledge; and WHEREAS, the Police Department proposes that each new applicant after January 1, 2003 be tested by a random selection of a minimum of six questions from Attachment "A" hereto and a random selection of a minimum of four questions from Attachment `B" hereto for a total of not less than ten questions; and WHEREAS, the City Council finds that the proposed examination is acceptable for testing the basic knowledge of applicants for practitioner permits; and 1 UHIUNAL ���� WHEREAS, the City Council finds that adoption of this Resolution approving the form of the examination is exempt from the requirements of the California Environmental Quality Act under Section 15061 (b) (3) of the (CEQA) Guidelines, which exempts projects which clearly will have no significant adverse impacts. NOW THEREFORE BE IT RESOLVED that the City Council approves as to form the examination questions attached hereto as Attachment "A" and "B", and directs the Police Department to administer on each new applicant for a massage and/or bodywork practitioner permit after January 1, 2003, a written examination consisting of a random selection of a minimum of six questions from Attachment "A" and a minimum of four questions from Attachment `B" hereto, which must be passed by a 70% score or better to obtain a permit, provided that a new applicant who has passed a national certification examination as specified in San Rafael Municipal Code Section 8.34.060 (A) (13) shall be subject to examination on only the Attachment `B" questions which must be passed by a 70% or better score to obtain a permit.
