A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
ESTABLISHING THE LINES OF SUCCESSION FOR THE CITY MANAGER,
DEPARTMENT HEADS AND OTHER KEY CITY OFFICIALS IN THE EVENT
OF THEIR UNAVAILABILITY DURING AN EMERGENCY
WHEREAS, Government Code Sections 8638, within the California Emergency Services Act,
authorizes the City Council to provide for the continuance of the office, in the time of emergency, of the
chief executive officer of the City by the appointment of three standby officers; and
WHEREAS, Government Code Sections 8637, within the California Emergency Services Act,
authorizes the City Council to provide for the succession, in the time of emergency, of City officials who
head departments having duties in the maintenance of law and order or in the furnishing of public services
relating to health and safety; and
WHEREAS, as the legislative body of a charter city, having the "home rule" powers prescribed by
Article XI, Section 5(a) of the California Constitution, the City Council has the power to provide for the
succession, in the time of emergency, of other City Officials and department heads responsible for the
furnishing of critical public services; and
WHEREAS, the function, management and continuity of the City Manager's Office and City
Departments is essential during periods of a disaster or other emergency; and
WHEREAS, the City Manager, Department Heads and other key City Officials may become
unavailable during an emergency, necessitating successors to assume their duties on a temporary basis; and
WHEREAS, the City Manager has recommended a lines of succession list for the City Manager,
Department Heads and other key City Officials in the event of an emergency; and
WHEREAS, the adoption of the lines of succession list for the City Manager, Department Heads,
and other key City Officials will provide the City of San Rafael with a continuity of City organization and
function when these officials become unavailable in the event of an emergency.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Rafael
approves the lines of succession list for the City Manager, Department Heads, and other key City Officials,
in the event of an emergency, as set forth in Exhibit "A" attached hereto.
I, Jeanne M. Leoncini, Clerk of the City of San Rafael, hereby certify that the foregoing Resolution
was duly and regularly introduced and adopted at a regular meeting of the City Council of the City of San
Rafael, held on Monday, the 2nd of April, 2007, by the following vote, to wit:
