RECOMMENDATION:
1) Adoption of the proposed ordinance;
2) Adoption a resolution establishing a new schedule of parking penalties;
3) Adoption of a resolution establishing on street parking meter rates; and
4) Adoption of a resolution establishing off street parking rates and fees,
designating long & short-term parking facilities, and specifying hours of
operation for City off street parking facilities.
BACKGROUND:
This report addresses a number of issues related to on and off street parking. First, changes
are recommended to the Municipal Code section that defines parking rules and policies in the
City's Downtown. Second, the City Council is asked to add penalties for violation of several
new Municipal Code sections. The Council approved some increases to existing parking
penalties in June 2007, and this action would add penalties for newly added Code sections.
The mechanism to do this is to replace the schedule of parking penalties adopted in June 2007

with the new schedule including the new fees. Finally, the report also recommends adoption of
increased on street parking meter rates and approval of a new fee schedule for off street
parking fees.
The City Council last adjusted parking rates on May 16, 2005. Since that time, costs of
operation have increased and significant expenses are anticipated to replace aging equipment,
perform structural assessments, acquire needed vehicles and complete needed repairs in
parking facilities. Parking services are self-funded through fee and fine revenue. In order to
meet these expenses, rate adjustments are recommended.
In developing recommendations for fees and Municipal Code changes, community input was
collected over several months. Parking Services staff hosted two merchant meetings and
issued several hundred invitations. In addition, meetings were held with the Business
Improvement District Board, Chamber of Commerce representatives, the Citizens Advisory
Committee on Redevelopment, and individual meetings with interested businesses.
Two study sessions were held with City Council on May 7 and May 21, 2007. At these study
sessions, staff provided information on recent changes in parking operations, the parking
budget, parking activity in the downtown, rates charged by other jurisdictions, anticipated
upcoming projects and purchases, and opinions gathered from the community.
ANALYSIS:
MUNICIPAL CODE CHANGES
It is recommended that Municipal Code Chapter 5.60, Parking Meters that deals with City
parking be repealed and a new Chapter 5.60, Parking Regulations, be adopted. The existing
Chapter 5.60 is largely parking meter specific. Until a few years ago, parking fees in City
parking facilities not attended by a cashier were collected exclusively through payments made
at parking meters. Approximately four years ago, the City began a transition from parking
meters to parking revenue machines in off street parking facilities. In the future, it is possible
that the City may choose to use parking revenue machines to collect parking fees in on street
locations as well. The proposed language for Municipal Code section 5.60 would replace
references to "parking meter" with the term "parking revenue machine."
Other changes proposed for Chapter 5.60 include:
Responsibility for off street parking signing, revenue equipment installation and
maintenance would be transferred from the City Engineer to the Parking Services
Manager. The Parking Services Manager has, in fact, been responsible for painting of
curbs and posting signs in the City's parking garages for several years. The City
Engineer continues to have responsibility for marking streets and painting curbs, posting
signs, and delineating parking spaces on City streets. This proposed change to the
Code would make the Code consistent with current City practice.
It becomes a violation to park a vehicle overnight in City parking garages for more than
one night without permission and empowers the Parking Services Manager to post no
parking times in City parking lots (sections 5.60.053 (a) and (b). Some vehicle owners
have used City parking lots and garages to store vehicles. The City's downtown parking
facilities were developed to provide short-term and monthly parking. Parking facilities
were not intended to be used as an inexpensive long-term vehicle storage sites.

required to pay for the parking they use. Each day, vehicles are parked in City parking
garages during the afternoons and evenings, then removed when the garages close at
11:00 PM. Persons using the garages in this manner park in City garages without
paying posted fees. A proposed Municipal Code section ((5.60.052 (c) (2)) would enable
parking services staff to collect fees from these persons.
Persons parking in City garages without the means to pay parking fees would be issued
a "promise -to -pay." This IOU process ((section 5.60.052 (c) (1)) allows parking
attendants to accept a promise -to -pay from persons that park in City garages and are
unable to pay for the time they park. If payment is not made within a specified time, a
late charge is added and the person is invoiced for the parking charges. If the person
fails to pay in response to the invoice, a parking citation is issued.
Future parking fee rates would be set by City Council resolution. Currently, on street
parking fees are specified in the Municipal Code while off street parking rates are set by
City Council resolution. New wording in Chapter 5.60 calls for both on and off street
parking fees be established by City Council resolution. This will simplify the parking fee
setting process and allow on and off street parking fees to be established though one
City Council action.
Acts such as driving through a parking garage gate arm, forcing the arm up, and driving
over a curb to avoid exiting through a parking garage driveway would be citable
offenses. On a daily basis, drivers circumvent parking revenue equipment in order to
avoid payment of parking fees in City garages. This is done by driving over a curb to
avoid the gate, by manually forcing the gate up, or by breaking off the gate. Such
behavior results in losses to the City much greater than a few dollars in unpaid parking
fees. Replacement or repair of a broken gate can cost hundreds of dollars and take an
exit lane out of service for up to a day, causing delays for paying customers. Recovery
of these costs is very difficult using criminal or civil remedies. Municipal Code section
(5.60.052 (b)) would make such conduct a parking violation and an accompanying
resolution would establish a $350.00 penalty for violation.

NEW PARKING PENALTIES
New sections recommended for inclusion in the Municipal Code create the need for parking
penalties that to enforce new regulations and restrictions. Penalties for non payment of parking
fees or parking overnight in parking facilities is the same as the City's penalty for overtime
parking. The penalty for driving through a parking garage gate or forcing the gate up to avoid
payment of parking fees is higher due to the high costs incurred by the City to repair damage
caused by such actions.

PARKING FEES
Parking fee changes are recommended for several reasons:
• The Parking Enterprise Fund must collect sufficient revenues to cover costs related to
providing parking services, including staffing for parking facilities, parking garage
financing, facility maintenance, and utility costs. In the past two years and in the coming
years, expenses in these areas have risen.
• The attached fee schedule provides existing and proposed parking fees and charges. In
order to allow sufficient time for public noticing, waiting periods and implementation, new
parking rates and fees would go into effect on October 1, 2007.
• Fees currently charged in parking garages are unduly complicated. Parking staff heard
from the community that a clearer and more constant rate schedule would be preferred.
• Fees that do not round to quarters increase the cost of supporting parking machines and
for collection and processing of revenues.
• The difference between higher and lower demand parking is insufficient to affect
customer usage patterns.
Current on street parking meter rates in San Rafael are $0.65 per hour in lower demand areas
and $0.80 per hour along 4th Street where parking demand is greatest. A review of parking fees
in surrounding communities, which is attached to this report, shows that parking fees currently
charged and proposed for San Rafael tend to be lower than rates charged in larger
communities. Rates in San Rafael are higher than the $0.50 per hour charged in the smaller
communities of San Anselmo and Mill Valley. A primary reason that rates are higher in larger
cities is that metered on street parking revenue is used to subsidize the much higher cost of
providing parking garages. It is recommended that metered parking in San Rafael be increased
from $0.65 to $0.75; a rate that corresponds to the lower level rates charged on other
communities that offer similar services.
Establishment of on street parking fees through resolution is contingent on City Council's
approval of the Municipal Code amendment described in this report that changes the Municipal
Code so that on street parking meter rates are established by City Council resolution. It is for
this reason that City Council is asked to approve two, separate rate resolutions: one for off-
street parking and the other for on -street parking.
Included in the off street parking rate resolution is a change in enforcement hours at two parking
facilities. An analysis of parking demand showed that the highest peak in downtown parking
occurs after 6:00 PM when parking restrictions and metering is no longer in force. This lack of
evening parking controls was found to have a negative impact on some businesses that rely on
customer turn over. As a result, it is recommended that parking fees be enforced until 8:00 PM
at two off street parking locations: in the lot adjacent to Walgreen's Pharmacy at 3rd & Lootens
and in the A Street garage extension at 3rd & B Streets.
ADMINSTRATIVE ISSUES
While no Council action is required, there are two upcoming administrative changes that were
previously discussed with the Council in the May study sessions. First, an occupancy

assessment in the City's Downtown Parking Area revealed that metered parking spaces on
Hetherton Street were rarely used. Conversely, unmetered parking spaces on Ritter Street,
Lincoln Avenue, and Brooks Street between 2nd and Td Streets are heavily used but those areas
lack meters. The Municipal Code empowers the City Engineer to place parking meters within
the City's Parking District as needed to ensure parking turnover and access to the Downtown.
Staff has begun meeting with business owners in advance of removing parking meters from
Netherton Street and adding meters on Ritter Street, Lincoln Avenue, and Brooks Street on
stretches adjoining 2nd Street. This action has been reviewed by the Transportation
Coordinating Committee.
Second, some City parking lots currently have mixed long and short term parking restrictions
within the same lot. Customers are often unclear as to time restrictions in lots where some
meters allow unlimited hours of parking and other meters allow only two hours of parking.
There is also a lack of long term parking except in the area of the City's parking garages. For
these reasons, two hour limit restrictions will be removed from parking lots at 5th & D, 5th &
Lootens, the A Street Garage extension, and at 1412 2"d Street.
FISCAL IMPACT: It is estimated that approval of these recommendations will result in
approximately $165,000 in additional parking fee & citation revenue annually. The action will
also result in a one-time cost of approximately $18,000 for new signs and parking meters.
OPTIONS:
A) Municipal Code changes
1) Take no action, leaving the Municipal Code with the existing wording; 2) Direct staff to
modify these recommendations; or, 3) Approve the ordinance as recommended.
B) New Parking Penalties
1) Direct staff to modify these recommendations; or, 2) Approve the resolution as
recommended.
C) On street and off street rate adjustments
1) Take no action, leaving fees at existing levels; 2) Direct staff to modify these
recommendations; or, 3) Approve the resolution as recommended.

AN ORDINANCE OF THE CITY OF SAN RAFAEL REPEALING
CHAPTER 5.60 (PARKING METERS) AND ENACTING A NEW
CHAPTER 5.60 (PARKING REGULATIONS) OF THE SAN RAFAEL
MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS:
DIVISION 1:
San Rafael Municipal Code Chapter 5.60 (Parking Meters) is hereby repealed, and a new
Chapter 5.60 (Parking Regulations) is hereby adopted to read as follows:
Chapter 5.60
PARKING REGULATIONS
Section 5.60.010 Downtown parking zone.
The City streets located within the following boundaries, including both sides of each
street named herein, are hereby established as the downtown parking zone:
(A) Northern boundary shall be Mission Avenue.
(B) Southern boundary shall be Second Street.
(C) Western boundary shall be H Street.
(D) Eastern boundary shall be Hetherton Street.
Section 5.60.020 Installation and maintenance of parking revenue equipment.
The City Parking Services Manager is authorized and directed to install, maintain and
operate the necessary parking revenue equipment along streets located in the designated
downtown parking zone, subject to such exceptions as may be approved by City Council
resolution, and in such off-street parking facilities operated by the City as shall be specified by
Council resolution, for the purpose of, and in such numbers, and at such places, and for such
days and hours, as to provide for the efficient control and regulation of the parking of vehicles
therein.
Section 5.60.030 Parking time limits.
The City Parking Services Manager is authorized and directed to establish maximum time
limits for both fee and non -fee parking spaces located within the downtown parking zone in
order to facilitate long and short-term visitor access to destinations within the downtown parking
zone. The maximum time limit, days and hours of operation, parking rate, and payments
accepted by parking revenue equipment shall be indicated on said parking revenue equipment.
Section 5.60.040 Curb or street lines or markings.
The City Engineer shall have lines or markings painted or placed upon curbs and streets
to designate parking spaces where fees will be collected by parking revenue equipment or where
parking duration will be restricted by a maximum time limit. The City Parking Services
Manager shall have lines or markings painted or placed in off-street parking locations. Each
vehicle parked in areas lined and marked in said fashion shall park within the lines or markings
so established. It is unlawful to park a vehicle of such size or in such a position that the same
shall not be entirely within the space designated by such lines or markings.
Section 5.60.050 Unlawful parking in on street parking spaces.
It is unlawful for any person between the hours of eight a.m. (8:00 a.m.) and six p.m.
(6:00 p.m.) of any day to cause or permit any vehicle registered in his name or operated by him
to be parked continuously in any parking space equipped with parking revenue equipment within
the downtown parking zone, for more than the maximum period of time indicated on said
parking revenue equipment, or any time during which the parking revenue equipment indicates
that the space is illegally in use, except during the time necessary to make payment at the parking
revenue equipment, and excepting also during the time from six p.m. (6:00 p.m.) to eight a.m.
(8:00 a.m.), and on Sundays and parking holidays.
Section 5.60.051 Parking Holidays.
Parking fees will not be due or collected on the following holidays as designated by the
United States & State of California: New Year's Day, Martin Luther King's Day, Presidents'
Day, Caesar Chavez Day, Memorial Day, Independence Day, Labor Day, Veterans' Day,
Thanksgiving Day & the day after Thanksgiving, and Christmas Day. The City Council may
designate days of observance of some of these holidays when City offices are closed and some
City services are not provided. In such instances the parking holiday shall be the actual Federal
or State holiday, not the day of City observance.
Section 5.60.052 Unlawful parking in off street parking spaces.
A. It is unlawful for any person to cause or permit any vehicle registered in his name
or operated by him to be parked continuously in any fee parking space within any un -gated off-
street parking facility operated by the City during the posted days and hours of operation of that
facility without having paid parking fees as posted within said facility during posted days and
hours of facility operation except for time necessary to make payment at the parking revenue
equipment.
B. It is unlawful for any person to circumvent, displace, break, or overcome control
mechanisms in any off-street parking facility operated by the City in order to avoid payment of
parking fees. The issuance and review of notices of parking violation and delinquent parking

violation, and the liability for and payment and collection of parking violation penalties, shall be
governed by Sections 40200 et seq. of the California Vehicle Code.
C. It is unlawful for any person to cause or permit any vehicle registered in his name
or operated by him to be removed from any gated off-street parking facility operated by the City
until all fees, rates and charges have been paid and discharged, except as provided in subsections
1 and 2 below:
1. In the event that the person operating a vehicle parked in any gated off-
street parking facility operated by the City attempts to remove the vehicle from the facility but is
unable to pay all fees, rates and charges due at such time, such person shall, prior to removing
such vehicle from the facility, be required to sign an agreement to pay any unpaid fees, rates and
charges. A copy of such agreement shall be given to the person signing the agreement. Such
agreement shall set forth the location of the facility, the date and approximate time that the
vehicle is removed, the name of such person, the vehicle license number, the registration
expiration date, if visible, the last four digits of the vehicle identification number, if available,
the color of the vehicle, and, if possible, the make of the vehicle. Such agreement shall require
payment to the City of all unpaid fees, rates and charges, plus a processing fee in an amount
established by City Council resolution, no later than seven days after the agreement is signed,
and shall indicate the address to which payment may be delivered or sent. If full payment is not
made within such seven-day period, the Parking Services Manager shall mail a notice of late
payment to the vehicle's registered owner. Such notice shall require payment to the City of the
unpaid fees, rates and charges, and processing fee, plus a late payment fee in an amount
established by City Council resolution, no later than seven days after the date of such notice. In
the event that such amount is not fully paid within such seven-day period, a notice of parking
violation, requiring payment of a penalty in an amount established by City Council resolution,
shall be mailed to the vehicle's registered owner. The above agreement shall include a reference
to this section.
2. When any vehicle remains parked in a gated off-street parking facility
operated by the City at the close of such lot's hours of operation, the facility attendant shall
record the location of the facility, the date and approximate time, the vehicle license number, the
registration expiration date and the last four digits of the vehicle identification number, if visible,
the color of the vehicle, and, if possible, the make of the vehicle. A numbered notice shall be
attached to the vehicle requesting that all fees, rates and charges that have accrued and are due be
paid at a parking revenue machine before the vehicle is removed from the facility. The notice
shall also require that the operator of the vehicle record the notice number and vehicle license
plate number on the parking facility ticket issued to the vehicle operator at the time the vehicle
entered the parking facility. In the event that full payment is not deposited and collected on the
next day of facility operation, the Parking Services Manager shall mail a notice of late payment
to the vehicle's registered owner. Such notice shall require payment to the City of the unpaid
fees, rates and charges, and add a late payment fee in an amount established by City Council
resolution. In the event that such amount is not fully paid within such seven-day period, a notice
of parking violation, requiring payment of a penalty in an amount established by City Council
resolution, shall be mailed to the vehicle's registered owner. The notice attached to the vehicle
shall include a reference to this section.

D. By entering an off-street parking facility operated by the City and parking a
vehicle in such facility, the owner, operator or person in charge of such vehicle shall be deemed
to have consented to the provisions of subsections C1 and C2 above. Any notices required to be
mailed under this section, shall be deemed served on the day that they are deposited in the U.S.
mail, first class, postage prepaid. The issuance and review of notices of parking violation and
delinquent parking violation, and the liability for and payment and collection of parking violation
penalties, shall be governed by Sections 40200 et seq. of the California Vehicle Code.
Section 5.60.053 Overnight parking prohibited; no parking times.
A. It is unlawful for any person to cause or permit any vehicle registered in his name
or operated by him to be parked in any parking space in an off-street parking facility operated by
the City in excess of twenty-four (24) consecutive hours without that person having obtained
from the Parking Services Manager an overnight parking permit. In the event a vehicle is left
parked or standing in a City parking facility for twenty-four (24) or more consecutive hours, any
member of the Police Department of the City of San Rafael, or any City employee assigned to
the enforcement of parking laws and regulations, may remove the vehicle from parking facility
in the manner and subject to the requirements of the California Vehicle Code.
B. The Parking Services Manager is authorized and directed to designate times when
no parking shall be allowed in off-street parking facilities operated by the City. It is unlawful for
any person to cause or permit any vehicle registered in his name or operated by him to be parked
in a parking space in an off-street parking facility operated by the City at times when no parking
has been so designated for such facility.
Section 5.60.055 Parking spaces, exclusive use of.
Temporary utilization of parking spaces located in the downtown parking zone or off-
street parking facilities operated by the City, without the deposit of payment or for a period of
time longer than the maximum time limit of said parking space, may be granted by the City upon
application for such permission. The application shall be submitted in writing to the parking
services division or police department and shall provide substantial need for temporarily closing
off these spaces for a stated duration of time. The applicant for temporary utilization of parking
spaces in the downtown parking zone shall pay the City for use of those parking spaces at a rate
established by Council resolution. The applicant for temporary utilization of parking spaces in
off-street parking facilities operated by the City shall make payments to the City as established
by Council resolution. Upon receipt of these payments, official bags shall be placed or signs
posted on said parking spaces. This provision shall not permit anyone other than the applicant to
occupy a parking space during a posted no -parking period.
Section 5.60.060 Rates charged for use of parking spaces.
The rates for use of parking spaces located within the downtown parking zone and in off-
street parking facilities operated by the City shall be set forth by City Council resolution.

Section 5.60.080 Deposit of payment required.
When any vehicle is parked in any parking space for use of which a fee is required as
provided in accordance with the provisions of this chapter, the operator of the vehicle upon
parking shall, and it is unlawful to fail to, deposit immediately United States coins, currency, or
other such payment that is available and/or operational for parking spaces located within the
downtown parking zones and in off-street parking facilities operated by the City.
Section 5.60.090 Improper use of parking revenue equipment.
It is unlawful to deposit or cause to be deposited in any parking revenue equipment, any
slug, device or nonaccepted payment material, or to deface, injure, tamper with, open, willfully
break, remove, destroy, circumvent, or impair the usefulness of any parking revenue equipment
installed pursuant to this chapter.
Section 5.60.100 Notice of parking violation.
It shall be the duty of each police officer or employee of the Police Department as
designated by the Police Chief, and any City employee assigned to enforce parking laws and
regulations, to observe any vehicles that are parked in violation of this chapter or the California
Vehicle Code, and to issue and attach to such vehicles a notice of parking violation as provided
by law.
Section 5.60.120 Disposition and use of revenue.
The depositing of payment in parking revenue equipment as provided in this chapter is
levied and assessed as fees for the purposes provided in this section. All receipts accruing to the
City from the operation of parking revenue equipment shall be expended for the acquisition,
installation, operation, maintenance, repair and replacement of parking revenue machines,
parking revenue equipment collection and enforcement and expenses incidental thereto; the
acquisition by purchase, condemnation or lease, installation, improvement, operation,
maintenance, repair and replacement of off-street parking facilities and expenses incidental
thereto, including costs and expenses incurred in condemnation proceedings whether
successfully concluded or abandoned; and expenses incurred in connection with proposals or
proceedings for acquisition of off-street parking facilities, whether such proposals or proceedings
are carried out or abandoned. Excess revenue not expended for the foregoing purposes shall be
kept as reserves in the City's parking services fund or expended for any lawful purpose.

are exempt from the requirements of the California Environmental Quality Act under Section

If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to
be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance.
The Council hereby declares that it would have adopted the Ordinance and each section,
subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more
section, subsection, sentence, clause or phrase be declared invalid.

This ordinance shall be published once in full before its final passage, in a newspaper of general

RESOLUTION ESTABLISHING A NEW SCHEDULE OF PARKING
PENALTIES AND LATE PAYMENT PENALTIES FOR NOTICES OF
PARKING VIOLATIONS, AND RESCINDING RESOLUTION NO. 12270
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES AS FOLLOWS:
WHEREAS, The California Vehicle Code, Section 40203.5 provides that local
government bodies shall establish a schedule for parking penalties with respect to notices of
parking violations issued by the City; and
WHEREAS, The City Council desires to include in the schedule of parking penalties and
late payment penalties for notices of parking violations additional penalties for enforcement of
sections and provisions being added to the Municipal Code by Ordinance No. 1859; and,
WHEREAS, The City Council has determined that proposed parking penalties are fair
and reasonable; and
WHEREAS, the City Council finds that approval of a Schedule of Parking Penalties and
Late Payments is categorically exempt under the California Environmental Quality Act pursuant
to 14 Cal. Code of Regs. Section 15321 (a), as an action related to the enforcement of parking
laws administered by the City.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
RESOLVES THAT the Schedule of Parking Penalties and Late Payment Penalties shall be
as set forth in Exhibit "A" attached hereto and incorporated herein, and rescinds
Resolution No. 12270, effective on the date of enactment of Ordinance No. 1859.

WHEREAS, The City of San Rafael currently operates and shall continue to provide
metered on -street parking within the City; and
WHEREAS, The City Council has determined that additional revenues will be required to
meet current and future expenses related to provision of parking services within the City of San
Rafael Downtown Parking Zone; and
WHEREAS, the revenues collected from these metered on -street parking spaces are
used for the expenses and projects paid for by the Parking Enterprise Fund; and
WHEREAS, the City Council finds that the specification of metered on -street parking
rates is statutorily exempt under the California Environmental Quality Act, under Public
Resources Code Section 21080(b)(8), relating to the collection of fees to meet operating
expenses, costs for supplies, equipment, and materials, reserve requirements, and capital
expenses in the City's parking programs.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
RESOLVES THAT effective on October 1, 2007, subject to enactment of Ordinance
No. 1859, on street metered parking rates within the Downtown Parking Zone will be
seventy-five ($0.75) cents per hour, except on 4t' Street where parking rates will be one
dollar ($1.00) per hour.

LOCATION: City Council Chambers, 1400 Fifth Avenue,
San Rafael, CA
PURPOSE: To receive public comments and consider
adoption of:
An Ordinance with amendments to Chapters 5.34 and 5.60 of
the San Rafael Municipal Code, including:
Authorization for packing enforcement officers to operate bi-
cycles or electric personal assistive mobility devices on side-
walks;
Transfer of responsibility for installing parking revenue equip-
ment, posting signs, marking curbs in off-street locations from
City Engineer to the Parking Services Manager;
Changing terminology in Code from parking meters to parking
revenue machines;
• Prohibition of departures from parking facilities without hav-
ing paid for parking;
Prohibition of willful damage to off street parking facilities;
Prohibition of unauthorized overnight parking in City off-street
parking facilities; and
A Resolution specifying hourly parking rates to be charged for
use of on street parking locations; and
A Resolution specifying hourly parking rates and other fees for
off street parking locations, and rescinding Resolution No.
11774; and
A Resolution establishing a new schedule of parking penalties
and late payment penalties for notices of parking violations,
and rescinding Resolution No. 12270.
