Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1777 entitled:
"AN ORDINANCE OF THE CITY OF SAN RAFAEL REPEALING SECTION
2.16.028(27) OF THE SAN RAFAEL MUNICIPAL CODE AND ADOPTING
A NEW SECTION 2.16.028(27) ESTABLISHING PENALTIES FOR
VIOLATIONS OF THE PARK RULES AND REGULATIONS CONTAINED
IN SECTION 2.16.028 OF THE SAN RAFAEL MUNICIPAL CODE"
is a true and correct copy of an Ordinance of said City and was introduced at a REGULAR
meeting of the City Council of the City of San Rafael, held on the 18th day of March, 2002,
published as required by City Charter in the MARIN INDEPENDENT JOURNAL, a newspaper
published in the City of San Rafael, and passed and adopted as an Ordinance of said City at a
REGULAR meeting of the City Council of said City held on the 2nd day of April, 2002, by the
following vote, to wit:

ORDINANCE NO. 1777
AN ORDINANCE OF THE CITY OF SAN RAFAEL
REPEALING SECTION 2.16.028 (27) OF THE SAN RAFAEL
MUNICIPAL CODE AND ADOPTING A NEW SECTION
2.16.028 (27) ESTABLISHING PENALTIES FOR
VIOLATIONS OF THE PARK RULES AND REGULATIONS
CONTAINED IN SECTION 2.16.028 OF THE SAN RAFAEL
MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS:
DIVISION 1.
A. The City Council finds that law enforcement officials require greater flexibility in the
penalties which can be charged for continuous and repeated violations of the rules and regulations
governing the City's Parks.
B. The City Council further finds that Article III, Section 54 of the City
Charter authorizes the Council to establish penalties for Municipal Code violations.
C. The City Council further finds that the public necessity, convenience and general welfare
require the adoption of a greater range of penalties for repeated violations of the City's park rules and
regulations.
D. The City Council further finds that there is no possibility that this ordinance
amendment will have any effect on the environment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES
ORDAIN AS FOLLOWS:

DIVISION 2.
The current section 2.16.028 (27) of the San Rafael Municipal Code is hereby deleted in its
entirety.

A new section 2.16.028 (27) is hereby added to the San Rafael Municipal Code to read as
follows:
"2.16.028 (27)
It is unlawful for any person to violate any provision of this section. Any
such violation shall be punishable and /or remedied as provided in Chapter 1.42 of
this Code."
DIVISION 4:
The City Council finds and determines with certainty that there is no possibility that this
legislative amendment will have any effect on the environment and therefore, this action is
exempt from review under the California Environmental Quality Act (CEQA) pursuant to
Section 15061(b)(3) of the CEQA Guidelines.
DIVISION 5:
If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to
be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The
Council hereby declares that it would have adopted the Ordinance and each section, subsection,
sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections,
sentences, clauses or phrases be declared invalid.
DIVISION 6:
This Ordinance shall be published once in full before its final passage in a newspaper of general
circulation, published, and circulated in the City of San Rafael, and shall be in full force and effect thirty
(30) days after its final passage.

Council of the City of San Rafael, held on the 18 th day of MARCH, 2002 and
