Clerk of the Council of said City, do hereby certify that the foregoing Charter
Ordinance No. 1700 entitled:
"AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AMENDING TITLE 6 OF THE SAN RAFAEL MUNICIPAL CODE TO PROHIBIT DOGS
AT THE DOWNTOWN FARMER'S MARKET FESTIVAL AND SIMILAR SPECIAL PUBLIC
EVENTS"
is a true and correct copy of an Urgency Ordinance of said City and was introduced
at a REGULAR meeting of the City Council of the City of San Rafael, held on the 15th
day of JULY, 1996, published as required by City Charter in the MARIN INDEPENDENT
JOURNAL, a newspaper published in the City of San Rafael and passed and adopted as
an ordinance of said City at a REGULAR meeting of the City Council of said City held
on the 15th day of JULY, 1996, by the following vote, to wit:

AN URGENCY ORDINANCE OF THE CITY
OF SAN RAFAEL AMENDING TITLE 6 OF
THE SAN RAFAEL MUNICIPAL CODE TO
PROHIBIT DOGS AT THE DOWNTOWN
FARMER'S MARKET FESTIVAL AND
SIMILAR SPECIAL PUBLIC EVENTS
WHEREAS, the City Council finds that there have been increasing numbers of dogs at
the Downtown Farmer's Market Festival and other similar City special public events; and
WHEREAS, the City Council finds that these dogs, whether leashed or unleashed,
present an immediate danger to the health, safety, and welfare of individuals, and particularly
small children in attendance at such events, through such dogs' aggressive behavior and public
defecation and urination; and
WHEREAS, the City Council finds that the adoption of this ordinance is required for the
immediate preservation of the public health, safety and welfare, and needs to take effect
immediately as an Urgency Ordinance.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES
ORDAIN AS FOLLOWS:
SECTION 1: Title 6 of Chapter 6.10 entitled "Animals" of the San Rafael Municipal
Code is amended to add Section 6.10.040 to read as follows:
SECTION 6.10.040. DOGS PROHIBITED AT DOWNTOWN FARMER'S,
MARKET FESTIVAL AND OTHER SIMILAR SPECIAL PUBLIC EVENTS.,
No owner or keeper of a dog shall allow or permit such dog, whether leashed or
unleashed, to be in any public street or other public place that has been designated, by action of
the City Council, as the location of special public events, such as the Downtown Farmer's Market
Festival, the Italian Street Painting Festival, or similar festivals, celebrations, or events, during the
designated period of operation of such festivals, celebrations, or events, provided that this
prohibition shall not apply to a person with disabilities requiring the use of a guide dog, signal
dog, or service dog to obtain equal access to such an event, and provided that this prohibition
shall not be effective unless appropriate signs giving notice of such prohibition are posted at
sufficient points around the event to give reasonable notice of such prohibition to the public.

SECTION 2: This ordinance is adopted as an Urgency Ordinance pursuant to
Government Code Sections 36934 and 36937(b) and shall take effect immediately upon adoption
by a four-fifths (4/5ths) vote of the City Council. The City Clerk is directed to forthwith publish a
copy of this ordinance once in a newspaper of general circulation, published and circulated in the
City of San Rafael.
