is a true and correct copy of an Ordinance of said City and was introduced at a
REGULAR meeting of the City Council of the City of San Rafael, held on the 7th day
of DECEMBER, 1998, published as required by City Charter in the MARIN INDEPENDENT
JOURNAL, a newspaper published in the City of San Rafael and passed and adopted as
an ordinance of said City at a REGULAR meeting of the City Council of said City held
on the 21st day of DECEMBER, 1998, by the following vote, to wit:

ORDINANCE NO. 1734
AN ORDINANCE OF THE CITY OF SAN RAFAEL PREZONING CERTAIN
REAL PROPERTY FROM THE COUNTY OF MARIN ZONE R-1 (RESIDENTIAL
SINGLE FAMILY DISTRICT 7,500 SQ. FT. MINIMUM LOT SIZE) DISTRICT TO
THE CITY R 20 - C DISTRICT (SINGLE FAMILY RESIDENTIAL, 20,000 SQ. FT.
MINIMUM LOT SIZE, CANAL FRONT OVERLAY).

THE COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS:
DIVISION 1. The Zoning Map of the City of San Rafael, California,
adopted by reference by Section 14.15.020 of the Municipal Code is amended by
prezoning the following described property from the County of Marin R-1
Zoning District to the City R 20 - C Zone District. Said Property contains 0.8
acres so prezoned and is located on the south side of Point San Pedro Road, as
shown as County Assessor's Parcel 17-181-36 and described in the attached
Exhibit "A" (legal description).
DIVISION 2. This zoning shall become effective in accordance with
Section 65859 of the Government Code of the State of California.
DIVISION 3. The City Council of the City of San Rafael does
hereby find that this Ordinance is necessary for the protection of the public
health, safety and welfare of the population of San Rafael for the following
reason:
The General Plan of the City of San Rafael, specifically Policy LU -6, states
that the annexation of already developed unincorporated islands should be
annexed to the City, dependent on resident interest, the cost/revenue
implications of specific annexation requests and provision of City services to the
area.

DIVISION 4. If any section, subsection, sentence, clause or phrase
of this Ordinance is for any reason held to be invalid, such decision shall not
affect the validity of the remaining portions of this Ordinance. The Council
hereby declares that it would have adopted the Ordinance and each section,
subsection, sentence, clause or phrase thereof, irrespective of the fact that any
one or more of the sections, subsections, sentences, clauses, or phrases be
declared invalid.
DIVISION 5. This Ordinance shall be published once in full before
its final passage in a newspaper of general circulation, published and circulated
in the City of San Rafael, and shall be in full force and effect (30) days after its
final passage.

TO
CITY OF SAN RAFAEL
MAPPING NO. 5 10
Beginnning at a point on the corporate city limits of San Rafael, said point
also being the most northwesterly corner of Parcel One of 15 PM 68 as recorded
in the Office of the Recorder of Marin County, and on the southerly right of
way of Point San Pedro Road; thence from said Point of Beginning along the
corporate city limits of San Rafael in a southeasterly and southwesterly
direction to the westerly line of APN #17-181-36 said line described in
Document 87-46337 filed in the Office of the Recorder of Marin County;
thence leaving said corporate city limits of San Rafael and along the westerly
line of Document 87-46337 North 25'43'00" West 220 feet more or less to the
southerly right of way line of Point San Pedro Road; thence along said
right of way North 63° 12'00" East 165.33 feet more or less to the
Point of Beginning.
Said parcel contains 0.8 acres more or less.
