LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Ordinance No. 1667 entitled: "AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE BOUNDARIES OF PARKING DISTRICT NO. 1 ESTABLISHED BY CHARTER ORDINANCE NO. 659 SO AS TO INCLUDE 729 FOURTH STREET, THE SOUTH EASTERLY CORNER OF LINCOLN AVENUE AND FOURTH STREET, APN # 11-275-01 was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the 6th day of SEPTEMBER, 1994, a summary of Ordinance No. 1667 was published as required by City Charter in the MARIN INDEPENDENT JOURNAL , a newspaper published in the City of San Rafael, and passed and adopted as an ordinance of said City at a REGULAR meeting of the City Council of said City held on the 19th day of SEPTEMBER, 1994, by the following vote, to wit: AYES: COUNCILMEMBERS: Cohen, Heller, Thayer, Zappetini & Mayor Boro NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None WITNESS my hand and the official seal of the City of San Rafael this 21st day of SEPTEMBER, 1994. LEONCINIiity Clerk ORDINANCE NO. 1667 AN ORDINANCE OF THE CITY COUNCIL OF SAN RAFAEL AMENDING THE BOUNDARIES OF PARKING DISTRICT NO.1 ESTABLISHED BY CHARTER ORDINANCE NO. 659 SO AS TO INCLUDE 729 FOURTH STREET, THE SOUTH EASTERLY CORNER OF LINCOLN AVENUE AND FOURTH STREET, APN # 11-275-01 WHEREAS, the City Council, acting for itself and as the Parking Place Commission as provided under the Parking District Act of 1951, has made the following findings required for approval of an annexation procedures for Parking District No. 1: (1) The site proposed to be annexed is immediately adjacent to the Parking District boundary on Lincoln Avenue, and is a logical extension of the District. (2) All Planning Department approvals have been secured and the Planning Commission determined that the proposal was an appropriate addition to the City and was consistent with Our Vision of Downtown San Rafael. (3) Recent surveys of parking indicates that overall, the District facilities in reasonable proximity to the annexation site have available parking to accommodate the 23 spaces required for the retail portions of the project and the residential parking needs are accommodated on the site. (4) There will be no adverse impact on parking facilities in the District, as the District facilities in reasonable proximity to the site have spaces available to accommodate the 23 retail space need required by the approved development. (5) No annexation fee is required, as the administrative tasks involved in the processing of the annexation were included in the processing of the required Planning Department permits, and there has been no assessment in the District since its initiation in 1958. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. The boundaries of Parking District No. 1 as established by Charter Ordinance No. 659, adopted by the City Council on February 3, 1958, as shown in Resolution of Intention No. 1855, and as shown on that certain map filed in the office of the City Clerk of the City of San Rafael designated "Amended Map Showing Boundaries of Proposed Parking District and Properties to be Acquired, Parking District No. 1, City of San Rafael, Marin County, California" is amended by annexing the property located at 729 Fourth Street, on the south easterly corner of Lincoln Avenue and Fourth ORIGINAL �;E�� Street, County Assessor's Parcel Number 11-275-01, which is more particularly described in Exhibit "A" attached hereto (the "property"). DIVISION 2. The property following annexation to Parking District No. 1 shall be entitled to the same rights and subject to the same obligations, including any future assessments for the purposes authorized by law, as the other properties heretofore included in Parking District No. 1. DIVISION 3. LEONCINI, City Clerk EXHIBIT "A" DESCRIPTION All that certain real property situate in the City of San Rafael, County of Marin, State of California, described as follows: THAT portion of Block 48 of the City of San Rafael, County of Marin, State of California, as shown on the Map of the Town of San Rafael, filed October 4, 1873 in Rack 1 of Maps Pull 4, Marin County Records, described as follows: BEGINNING at the intersection of the Southerly line of Fourth Street with the Easterly line of Petaluma'(now Lincoln) Avenue, as shown on said map; thence Easterly along said South line of Fourth Street, 120 feet to the Northwest corner of the land conveyed to Annie C. Nichols By Deed dated August 17, 1912, recorded .in Book 146 of Deeds at Page 313, Marin County Records; thence Southerly along the Westerly line of land so conveyed 90 feet to the Southwest corner thereof; thence Easterly along the Southerly line of said Nichols 30 feet to the Southeast corner thereof; thence South along the West line conveyed to K.C. Whiting by Deed recorded in Book 'Y' of Deeds at page 258, Marin County Records, 14 feet to the Southwest corner thereof; thence Easterly along the land so conveyed to Whiting 50 feet to the West line of Tamalpais Avenue; thence South on the West line of Tamalpais Avenue, 24 feet; thence west 197.45 feet, more or less, to a point in the East line of Petaluma (now Lincoln) Avenue, which is 172 feet North of .its intersection with the North line of Third, Street and thence North on the East line of Petaluma Avenue, 127 feet, more .or less, to the point of beginning. EXCEPT the Northerly 4 feet thereof as excepted in Deeds of Record for the widening of Fourth Street.
