I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the
Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1668
entitled:
"AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING TITLE 5 OF THE SAN
RAFAEL MUNICIPAL CODE TO AMEND CHAPTER 5.34 -- REGULATION OF SKATEBOARDS,
ROLLER SKATES AND BICYCLES -- TO ADD SECTION 5.34.040 AUTHORIZING POLICE
OFFICER OPERATION OF BICYCLES ON PUBLIC SIDEWALKS"
is a true and correct copy of an ordinance of said City and was introduced at a REGULAR
meeting of the City Council of the City of San Rafael, held on the 17th day of
OCTOBER, 1994, published as required by City Charter in the MARIN INDEPENDENT JOURNAL , a
newspaper published in the City of San Rafael and passed and adopted as an ordinance of
said City at a REGULAR meeting of the City Council of said City held on the 7th
day of NOVEMBER, 1994, by the following vote, to wit:

ORDINANCE NO. 1668
AN ORDINANCE AMENDING TITLE 5 OF THE SAN
RAFAEL MUNICIPAL CODE TO AMEND CHAPTER 5.34
-- REGULATION OF SKATEBOARDS, ROLLER SKATES
AND BICYCLES -- TO ADD SECTION 5.34.040
AUTHORIZING POLICE OFFICER OPERATION OF
BICYCLES ON PUBLIC SIDEWALKS
WHEREAS, the Police Department of the City of San Rafael has
initiated a bicycle patrol by police officers within the City; and
WHEREAS, Section 5.34.010 of the San Rafael Municipal Code now
contains a blanket prohibition against any person riding a bicycle
on a public sidewalk in an area posted with a sign prohibiting such
act; and
WHEREAS, it will be necessary for police officers who are
engaged in such bicycle patrol to operate their bicycles from time
to time on public sidewalks, in order to fully carry out their
duties and responsibilities as police officers.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL, DO
ORDAIN AS FOLLOWS:
DIVISION 1:
Section 5.34.040 is added to the San Rafael Municipal Code to
read as follows:
5.34.040. Notwithstanding Section 5.34.010, it shall not be
unlawful for a person, engaged in the course and scope of
employment as a police officer for the City, to ride a bicycle on
a public sidewalk in an area posted with a sign prohibiting bicycle
riding on sidewalks.
DIVISION 2:
This Ordinance shall be published once in full before its
final passage in a newspaper of general circulation, published, and
circulated in the City of San Rafael, and shall be in full force
and effect thirty (30) days after its final passage.
