JOURNAL, a newspaper published in the City of San Rafael and passed and adopted as
an ordinance of said City at a REGULAR meeting of the City Council of said City held

ORDINANCE NO. 1690
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING
MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE
BY SECTION 14.01.020 OF THE MUNICIPAL CODE OF SAN RAFAEL,
CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY IN THE
CIVIC CENTER NORTH AREA
(RE: ZC95-3 - I MCINNIS PARKWAY, AP 180-410-06)
(CIVIC PLACE OFFICE PROJECT)
THE COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS:
WHEREAS, the San Rafael Planning Commission has held a duly -noticed public
hearing on the proposed amendment to the zoning map as required by State Law
and has considered all written correspondence, verbal testimony and the staff
reports relevant to the proposed amendment, and recommended to the City
Council approval of the proposed amendment; and
WHEREAS, the San Rafael City Council finds that the proposed amendment to the
zoning map is consistent in principle with the General Plan, adopted Northgate
Activity Center Plan, and other applicable plans or policies; and
WHEREAS, the San Rafael City Council finds that the Office Building proposal is
appropriate in the area and the design constitutes an office environment of
sustained desirability in harmony with the character of the surrounding
neighborhood, and where applicable, adequate open space and amenities for the
building have been developed through design review that are harmonious with
the character of the surrounding neighborhood; and,
WHEREAS, the San Rafael City Council finds that the development is improved by
deviations from typical Zoning Ordinance property development standards because
landscape buffer areas from the wetland areas, consistency with the surrounding
office development and development standards set forth for landscaping and
architecture will provide for higher quality development on the site; and
WHEREAS, the San Rafael City Council finds that the auto, bicycle and pedestrian
traffic system is adequately designed for circulation needs and public safety and
emergency vehicle access is provided to serve the proposed office building based on
the information contained in the project application and the Negative Declaration
and review by the City's Fire, Police, and Public Works Departments; and

WHEREAS, the San I gel City Council finds that public .lth, safety and general
welfare are served by the adoption of the proposed amendment to the zoning map
because the amendment is not in conflict with other General Plan Policies and it
will allow office use similar to office uses on other nearby parcels while
maintaining adequate setbacks to the wetland area;
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES HEREBY ORDAIN AS
FOLLOWS:
DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by
reference by Section 14.01.020 of the Municipal Code is amended by reclassifying the
following real property from PD 1448 (Planned Development), to PD (Planned
Development), with development standards. Said property so reclassified is located
at the 1 McInnis Parkway at Civic Center Drive, San Rafael, (Exhibit "B") County
Assessor's Parcel Number 180-410-06.
DIVISION 2. Any development of this property shall be subject to the
development standards outlined in Exhibit "A" which is attached hereto and made
a part hereof.
DIVISION 3. If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held to be invalid, such decision shall not affect the
validity of the remaining portions of this Ordinance. The Council hereby declares
that it would have adopted the Ordinance and each section, subsection, sentence,
clause or phrase thereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses or phrases be declared invalid.
DIVISION 4. The Ordinance shall be published once in full before its final passage
in a newspaper of general circulation, published and circulated in the City of San
Rafael, and shall be in full force and effect thirty (30) days after its final passage.

The foregoing Ordinance No. 169-0 was read and introduced at a
regular meeting of the City Council of the City of San Rafael, held on the
4th. day of DECEMBER , 1995, and ordered passed to print by
the following vote, to wit:

Civic Place Office Building
Zoning Master Plan
Land Uses: A 37,000 square foot two-story office building ,
including any accessory uses permitted pursuant to the
San Rafael Zoning Ordinance.
Parking: 148 parking spaces on-site to accommodate the project, as
shown on the site plan prepared by Eklund & Zak,
Architects, and recommended for approval by the Design
Review Board on April 18, 1995. This amount is based on
the City's zoning ordinance requirement of one space per
250 gross square feet.
Landscape As specified on the site plan. The proposed setbacks are
Setbacks: equal to or greater than the setbacks approved as part of
the restaurant PD. The project provides for the following
setbacks: (a) McInnis Parkway: 25 foot minimum
landscaped from curb edge to edge of parking. (b) Civic
Center Drive: 25 feet minimum landscaped from curb edge
to edge of parking. (c) Southeast (Gallinas Creek): 50 feet
minimum landscaped measured from the edge of creek
wetlands to edge of parking. (d) Northeast side (facing
Hotel parcel): 110 feet minimum measured from the
property line to the edge of the parking lot, to be
landscaped predominantly with native material.
Landscape Landscaping concepts as shown on the plans prepared by
Standards Baronian Associates and recommended for approval by the
Design Review Board on April 18, 1995, and subject to final
review by the Design Review Board before building permit
issuance.
Building (a) 25 feet minimum from McInnis Parkway right of way.
Setbacks: (b) 290 feet from Civic Center right of way.
(c) 360 feet from northeast property line.
(d) 50 feet minimum from Gallinas Creek wetland.
