EONCINI, City Clerk ORDINANCE NO. 16 0 2 AN ORDINANCE OF THE CITY OF SAN RAFAEL REZONING CERTAIN REAL PROPERTY FROM THE CITY OF SAN RAFAEL/ZONE PCM -NG (I-33) (PLANNED COMMERCIAL AND LIGHT INDUSTRIAL DISTRICT - NORTHGATE ACTIVITY CENTER OVERLAY DISTRICT (INDUSTRIAL - 33 PEAK PM TRIPS) TO PCM -NG (PLANNED COMMERCIAL AND LIGHT INDUSTRIAL DISTRICT - NORTHGATE ACTIVITY CENTER OVERLAY DISTRICT) 4300 Redwood Highway, AP# 155-110-06 (Broderbund Software) THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by reference by Section 14.15.020 of the Municipal Code is amended by rezoning the following described property from the City of San Rafael/Zone PCM -NG (I-33) (Planned Commercial and Light Industrial District - Northgate Activity Center Overlay District (Industrial - 33 Peak PM trips) to PCM -NG (Planned Commercial and Light Industrial District - Northgate Activity Center Overlay District). Said property contains 212,572 sq. ft. and is located at 4300 Redwood Highway and shown as County Assessor's Parcel 155-110-06, per legal description attached as Exhibit "A". DIVISION 2. This zoning shall become effective in accordance with Section 65859 of the Government Code of the State of California. DIVISION 3. The City Council of the City of San Rafael does hereby find that this Ordinance is necessary for the protection of the public health, safety and welfare of the population of San Rafael for the following reason: The rezoning will correct an inconsistency between the trips established for the subject parcel under the existing zoning and the trips allocated by Appendix B of the City of San Rafael General Plan 2000. DIVISION 4. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact P f, R n �J I. !t( that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage.
