LEONCINI� ity Clerk ORDINANCE NO. 16 2 8 AN ORDINANCE OF THE CITY OF SAN RAFAEL ADOPTING THE PLANNED DEVELOPMENT DISTRICT 1628 FOR GREEN OAKS, AS CLASSIFIED ON THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA (RE.: Z91-4 SAN RAFAEL ZONING ORDINANCE) THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES HEREBY ORDAIN AS FOLLOWS: DIVISION 1 Certain real property known as Green Oaks is reclassified from PUD - R-1 (Planned Unit Development - Single -Family Residential) to PD 1628, on the City of San Rafael Zoning Map as of the effective date of this ordinance. Said property so reclassified is located at the end of Manuel T. Freitas Parkway, San Rafael, County Assessor's Page 175-39 as described in Map 1 and as recorded in Book 15 of Recorded Maps at Page 24, Marin County Official Records as described in Map 2. This rezoning supersedes Ordinance No. 1036. DIVISION 2 Any development of Green Oaks shall be subject to the following development standards. Land Uses: Permits 107 condominium units and associated recreation facilities. Also permits open space and accessory structures and uses customarily incidental to a permitted use and contained on the same site. Area: Approximately 27 acres. Height: Height limits are 30 feet (main dwellings) and 15 feet (accessory structures). Setbacks: Per the Master Plan, individual unit setbacks are 10 feet front, 0 feet side and 15 feet rear, except that a 15 foot setback shall be maintained from Manuel Freitas Parkway. Setbacks between dwelling group structures are 20 feet (side/side); 40 feet (rear/rear) and 25 feet (side/rear). DIVISION 3 If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases may be declared invalid. DIVISION 4 The Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty days following its final passage.
