Ex -officio Clerk of the Council of said City, do hereby certify that
the foregoing Charter Ordinance No. 1636 entitled:
"AN ORDINANCE OF THE CITY OF SAN RAFAEL ADOPTING THE PLANNED DEVELOPMENT
DISTRICT 1636 FOR 10 BAY WAY, AS CLASSIFIED ON THE ZONING MAP OF THE CITY

is a true and correct copy of an ordinance of said City and was
introduced at a REGULAR meeting of the City Council
of the City of San Rafael, held on the 8th day of

MARTN TNDFPFNDENT JOURNAL , a newspaper published in the City
of San Rafael and passed and adopted as an ordinance of said City at
a REGULAR meeting of the City Council of said City

ORDINANCE NO. 1616
AN ORDINANCE OF THE CITY OF SAN RAFAEL ADOPTING
THE PLANNED DEVELOPMENT DISTRICT 1636 FOR
10 BAY WAY, AS CLASSIFIED ON THE ZONING MAP
OF THE CITY OF SAN RAFAEL, CALIFORNIA
(RE-- Z91-4 SAN RAFAEL ZONING ORDINANCE)
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES HEREBY ORDAIN AS FOLLOWS:
DIVISION.1
Certain real property known as 10 Bay Way is reclassified from R -1-B-1 (Single -Family Residential -
[B -1 Area and Yard Variations] Combined] to PD 16 3 6 on the City of San Rafael Zoning Map
as of the effective date of this ordinance. Said property so reclassified is located at 10 Bay Way, San
Rafael, County Assessor's Parcel 16-301-22 (Map 1), as recorded in Book 17 of Recorded Maps at Page 72,
Marin County Official Records (Map 2), and as described on Map 3 showing approximate location of
land uses.
DIVISION .
Any development of 10 Bay Way shall be subject to the following development standards.
Land Uses: Permits one single-family home in the existing location approximately 110 feet from the
south property line, 60 feet from the east property line and four to eight feet from the top of bank of the
drainageway to the west. No further subdivision of the property to create more than the existing
building site is permitted. (This restriction is also contained in the deed restriction on the property.)
Area: 4.2 acres
Height and setbacks: Height limits and setbacks for the dwelling and any accessory structures shall be
consistent with requirements of the R7.5 District.
DIVISION 3
If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be
invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The
Council hereby declares that it would have adopted the Ordinance and each section, subsection,
sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections,
sentences, clauses or phrases may be declared invalid.
DIVISION 4
The Ordinance shall be published once in full before its final passage in a newspaper of general
circulation, published and circulated in the City of San Rafael, and shall be in full force and effect
thirty days following its final passage.

The foregoing Ordinance No. 1636 was read and introduced at a regular meeting of the City Council of
the City of San Rafael on Tuesday, September 8th, 1992, and ordered passed to print by the following
vote, to wit:
AYES: Councilmembers : Breiner, Cohen, Shippey, Thayer & Mayor Boro
NOES: Councilmembers : None
ABSENT: Councilmembers : None
and will come up for adoption as an Ordinance of the City of San Rafael at a regular meeting of the
Council to be held on Monday, September 21st, 1992.
