LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1637 entitled: "AN ORDINANCE OF THE CITY OF SAN RAFAEL ADOPTING THE PLANNED DEVELOPMENT DISTRICT 1637 FOR TERRA LINDA MEADOWS, AS CLASSIFIED ON THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA (RE: Z91-4 SAN RAFAEL ZONING ORDINANCE)" is a true and correct copy of an ordinance of said City and was introduced at a RFrlll AR meeting of the City Council of the City of San Rafael, held on the 8th day of 55PTFM9FR , 1992, published as required by City Charter in the MARIN INDEPENDENT .IOIIRNAI a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a aFriii nR meeting of the City Council of said City held on the 91 et day of SEPTEMBER 19 92, by the following vote, to wit: AYES: COUNCILMEM13ERS: Breiner, Cohen, Shippey, Thayer & Mayor Boro NOES: COUNCILMEMBERS : None ABSENT: COUNCILMEMBERS: None WITNESS my hand and the official seal of the City of San Rafael this 19__q2- . 13th day of OCTOBER JEANN "LEOA�NI, City Clerk ORDINANCE NO. 1637 AN ORDINANCE OF THE CITY OF SAN RAFAEL ADOPTING THE PLANNED DEVELOPMENT DISTRICT 1637 FOR TERRA LINDA MEADOWS, AS CLASSIFIED ON THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA (RE.: Z91-4 SAN RAFAEL ZONING ORDINANCE) THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES HEREBY ORDAIN AS FOLLOWS: DIVISION 1 Certain real property known as Terra Linda Meadows is reclassified from PC (Planned Community) to PD 1637 on the City of San Rafael Zoning Map as of the effective date of this ordinance. Said property so reclassified is located on Lea Drive, and Surrey and Forrest Lanes, San Rafael, as described on County Assessor's Page 17540 (Map 1) and on the Schematic Site Plan (Map 2), and as recorded in Book 16 of Recorded Maps at Page 78, Marin County Official Records. This rezoning supersedes Ordinance No. 740. DIVISION 2 Any development of Terra Linda Meadows shall be subject to the following development standards. Land Uses: Permits 220 condominium units and associated recreation facilities. Also permits open space and accessory structures and uses customarily incidental to a permitted use and contained on the same site. Area: 2453 acres Height: Height limits are 30 feet (main dwellings) and 15 feet (accessory structures); provided, however, that lower heights may be required to be compatible with the existing project. Setbacks: The following building setbacks shall be maintained — 20 feet from the north and east property lines; 15 feet from the Lea Drive right-of-way; 10 feet from the edge of the Surrey and Forrest Lanes travel lanes (to retain landscaping); and, Where the existing distance between dwelling groups at their closest point is 35 feet or less, that setback shall not be reduced. Any changes in building setbacks require a revised subdivision and use permit. DIVISION 3 If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases may be declared invalid. DIVISION 4, The Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty days following its final passage.
