ORDINANCE NO. 1550
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SAN RAFAEL,
AMENDING TITLE 3, CHAPTER 3.20
ENTITLED "UNIFORM TRANSIENT OCCUPANCY TAX",
SECTION 3.20.030 OF THE SAN RAFAEL MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS:
SECTION 1: Title 3, Chapter 3.20 is amended to read as
follows:
Section 3.20.030 is amended to read as follows:
Tax imposed. For the privilege of occupancy in any
hotel, each transient is subject to and shall pay a tax in the
amount of ten percent (10%) of the rent charged by the operator.
The tax constitutes a debt owed by the transient to the city which
is extinguished only by payment to the operator or to the city.
The transient shall pay the tax to the operator of the hotel at the
time the rent is paid. If the rent is paid in installments, a
proportionate share of the tax shall be paid with each installment.
The unpaid tax shall be due upon the transient's ceasing to occupy
space in the hotel. If for any reason the tax due is not paid to
the operator of the hotel, the tax collector may require that such
tax shall be paid directly to him. (Ord. 1302 S1, 1978; Ord. 1165
S1, 1975; Ord. 921 S1, 1968; prior Ord. 877 S1, 1967).
SECTION 2. If any section, subsection, sentence, clause
or phrase of this ordinance is for any reason held to be invalid,
such holding or holdings shall not affect the validity of the
remaining portions of the ordinance. The Council declares that it
would have passed this ordinance and each section, subsection,
sentence, clause or phrase thereof, irrespective of the fact that
any one or more sections, subsections, sentences, clauses or
phrases be declared invalid.
SECTION 3. This Ordinance shall be published once in
full before its final passage in a newspaper of general
circulation, published and circulated in the City of San Rafael,

and shall be in full force and effect thirty (30) days after its
final passage.
