the foregoing Charter Ordinance No. 1552 entitled:

ORDINANCE NO. 1552
AN ORDINANCE OF THE CITY OF SAN RAFAEL PROVIDING FOR
THE SALE AND CONVEYANCE OF PUBLIC REAL PROPERTY
LOCATED AT 335 FORBES AVENUE, SAN RAFAEL, CALIFORNIA
TO GERRY K. ROBERTSON OF
3020 BRIDGEWAY IN SAUSALITO, CALIFORNIA 94965
THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. It is hereby determined and ordained that
the real property situated at 335 Forbes Avenue in San Rafael,
as more particularly described in "Exhibit A" attached hereto,
is surplus to the City and that it would be in the best
interest of the City of San Rafael, California, to sell all
of the real property hereinafter described.
DIVISION 2. The City of San Rafael, California, a
municipal corporation, hereinafter referred to as "City",
by and through its City Council, after public adver-
tising does hereby sell the land referred to in Division 1
above and hereinafter specifically described, to Gerry K.
Robertson, the high bidder at a public bid opening held on
October 12, 1988, hereinafter referred to as "Buyer", upon
the following terms and conditions:
1. Purchase Price. The purchase price to be
paid by Buyer to City shall be the sum of
Two Hundred and two thousand, six hundred and
fifty dollars ($202,650) in cash lawful money
of the United States of America.
2. Delivery and Possession. Buyer shall be
given possession of said real property upon
recordation of the deed of conveyance.
3. Compliance with San Rafael Charter. It is
understood that the within sale is subject to
Subdivision 7 of Section 7 of Article VII of
the San Rafael Charter, and it is agreed that
the within sale shall be made in compliance with
said Charter provisions.

4. Condition of Title. Title shall be subject
to covenants, conditions, restrictions, reser-
vations, rights, rights-of-way and easements now
of record and to all of the provisions of this
Agreement of Sale, and the property is sold as
an "as is" condition.
5. Description of Property. That certain real
property situate in the City of San Rafael,
County of Marin, State of California, as described
in "Exhibit A" attached hereto.
DIVISION 3. The Mayor of the City of San Rafael is
authorized and directed to execute and to deliver to Gerry
Robertson of 3020 Bridgeway in Sausalito, California, a
deed of conveyance in the name of said City necessary and
proper to carry out the sale, upon the terms and conditions
herein provided, upon receipt of the purchase price and
other considerations, all as hereinabove set forth.
DIVISION 4. This Ordinance shall be published once in
full before its final passage in a newspaper of general
circulation, published and circulated in the City of San
Rafael, and shall be in full force and effect thirty (30)
days after its final passage.

read and introduced at a reaular meeting of the
City Council of the City of San Rafael, held on the 7th
day of November , 1988, and ordered passed to print
by the following vote, to wit:

NOES: COUNCILMEMBERS: None

LOT 51, as shown upon that certain map entitled, "Lands
of Forbes Subdivision 3, San Rafael, Marin County, Calif-
ornia, 1913" recorded April 8, 1913 in Volume 4 of Maps
at Page 39, Marin County Records.
