ORDINANCE NO. 1557
AN ORDINANCE OF THE CITY OF SAN RAFAEL
ADOPTING BY REFERENCE ADDITIONS AND AMENDMENTS TO
THE MARIN COUNTY ANIMAL CONTROL
CODE AND AMENDING THE PENALTY CLAUSE
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS:
DIVISION 1. Title 6 of the San Rafael Municipal Code is
hereby amended by adding Section 6.10.012 "Adoption of Additions and
Amendments to County Code" to read in its entirety as follows:
Section 6.10.012 Adoption of Additions and Amendments to
County Code. Pursuant to Sections 50022.7 and 50022.9 of the
California Government Code, the Additions and Amendments to the Marin
County Animal Control Code set forth in Marin County Ordinance 2969,
and specifically contained in Marin County Code Sections 8.04.181,
8.04.182 and 8.04.183 are hereby adopted by reference and shall be in
full force and effect within the City of San Rafael.
DIVISION 2. Title 6 of the San Rafael Municipal Code is
hereby amended by amending Section 6.10.050 "Penalty for Violations"
to read in its entirety as follows:
Section 6.10.050 Penalty for Violations. Any person
violating within San Rafael any of the provisions of Section
8.04.180, 8.04,181, 8.04.182, 8.04,183, 8.04.240, 8.04.245, 8.04.246,
8.08.010 and 8.08.020 of the Marin County Code shall be guilty of a
misdemeanor and upon conviction thereof shall be punished by fine not
exceeding Five Hundred Dollars, by imprisonment in the County jail
for a period not exceeding six months, or by both such fine and
imprisonment. Any person violating within San Rafael any other
provisions of Title 8 of the Marin County Code shall be guilty of an
infraction and upon conviction thereof shall be punished by a fine of
not more than Fifty Dollars for the first offense and for a second or
and subsequent offense by a fine of not more than One Hundred
Dollars.
DIVISION 3. If any section, subsection, sentence, clause,
or phrase of this Ordinance is for any reason held to be invalid,
such decision shall not affect the validity of the remaining portions
of this Ordinance. The Council hereby declares that it would have

adopted the Ordinance and each section, subsection, sentence, clause,
or phrase thereof, irrespective of the fact that any one or more
section, subsection, sentence, clause or phrase be declared invalid.
DIVISION 4. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation,
printed, published, and circulated in the City of San Rafael, and
shall be in full force and effect thirty (30) days after its final
passage.

The foregoing Charter Ordinance No. 1557 was read and
introduced at a REGULAR meeting of the City Council of the City of
San Rafael held on the 17th day of JANUARY 1989, and ordered
passed to print by the following vote, to wit:
AYES: COUNCILMEMBERS: Boro, Frugoli, Thayer & Vice -Mayor Breiner
NOES: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS: Mayor Mulryan
and will come up for adoption as an Ordinance of the City of San Rafael
at a REGULAR meeting of the Council to be held on the 6th day
of FEBRUARY , 1989.
