of San Rafael and passed and adopted as an ordinance of said City at
a REGULAR meeting of the City Council of said City
held on the Eighteenth day of SEPTEMBER 1989, by the following

AN ORDINANCE OF THE CITY OF SAN RAFAEL PROVIDING
FOR THE SALE AND CONVEYANCE OF PUBLIC REAL PROPERTY
LOCATED AT 346 MOUNTAIN VIEW AVENUE, SAN RAFAEL, CALIFORNIA
TO HARRY RODRIGUES OF 18 SEA WAY, SAN RAFAEL, CALIFORNIA, 94901
THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. It is hereby determined and ordained that
the real property situated. at 346 Mountain View Avenue in
San Rafael, as more particularly described in "Exhibit A"
attached hereto, is surplus to the City and that it would
be in the best interest of the City of San Rafael, California,
to sell all of the real property hereinafter described.
DIVISION 2. The City of San Rafael, California, a
municipal corporation, hereinafter referred to as "City",
h_y and through its City Council, after public advertising
does hereby sell the land referred to in Division 1 above
and hereinafter specifically described, to Harry Rodrigues,
the high bidder at a public bid opening held on August 8,
1989, hereinafter referred to as "Buyer", upon the following
terms and conditions:
A. Purchase Price. The purchase price to be
paid by Buyer to City shall he the sum of Three
Hundred and Thirty-six thousand dollars ($336,000)
in cash lawful money of the United States of
America.
B. Delivery and Possession. Buyer shall be given
possession of said real property upon recordation
of the deed of conveyance.
C. Compliance with San Rafael Charter. It is
understood that the within sale is subject to
Subdivision 7 of Section 7 of Article VII of the
San Rafael Charter, and it is agreed that the
within sale shall be made in compliance with said
Charter provisions.

D. Condition of Title. Title shall be subject
to covenants, conditions, restrictions, reserva-
tions, rights, rights-of-way and easements now of
record and to all of the provisions of this Agree-
ment of Sale, and the property is sold in an "as is"
condition.
E. Description of Property. That certain real pro-
perty situate in the City of San Rafael, County of
Marin, State of California, as described in "Exhibit
A", attached hereto.

DIVISION 3. The/Mayor of the City of San Rafael is
authorized and directed to execute and to deliver to Harry
Rodrigues of 18 Sea Way in San Rafael, California, a deed of
conveyance in the name of said City necessary and proper to
carry out the sale, upon the terms and conditions herein
provided, upon receipt of the purchase price and other consi-
derations, all as hereinabove set forth.
DIVISION 4. This Ordinance shall be published once in
full before its final passage in a newspaper of general cir-
culation, published and circulated in the City of San Rafael,
and shall be in full force and effect thirty ( 30 ) days after
its final passage. �Q

of the City of San Rafael, held on the 5th day of
September , 1989, and ordered passed to print by the
following vote, to wit:
AYES: COUNCILMEMBERS: Boro, Frugoli, Thayer & Vice -Mayor Breiner
NOES: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS: Mayor Mulryan
and will come up for adoption as an Ordinance of the City of
San Rafael at a Regular meeting of the Council to be

PROPERTY DESCRIPTION
All that certain real property situate in the City of San
Rafael, County of Marin, State of California, described as
follows:
Lot 32, as shown upon that certain Map entitled "Map of Oak
Woodlands, Unit One", filed for record November 14, 1955 in
Volume 8 of Maps, at Page 105, Marin County Records.
Reserving therefrom for the benefit of the grantor herein:
An easement for drainage purposes, with the right of ingress
and egress thereto. Said easement is described as follows:
Beginning at the most Westerly corner of Lot 32 of Oak
Woodlands, Unit One, Book 8 of Maps, Page 105, Marin County
Records: thence North 41° 30' 00" East along the North-
westerly line of said Lot 32, a distance of 17.27 feet;
thence leaving said line South 48° 29' 21" East, a distance
of 73.35 feet; thence South 79° 05' 41" East, a distance
of 52.11 feet; thence South 47° 48' 49" East, a distance
of 31.79 feet to a point on the Southeasterly line of said
Lot 32 which bears North 41° 31' 00" East, a distance of
43.40 feet to the Southeast corner of said Lot 32; thence
North 48° 30' 00" West along the Southerly line of said
Lot 32, a distance of 150.00 feet to the point of beginning.
No permanent structures may be constructed on or over this
easement.
