LEONCINI, Clerk of the City of San Rafael, and Ex -Officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance NO. 1575 entitled: "AN ORDINANCE OF THE CITY COUNCIL OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM PCM (PLANNED COMMERCIAL AND LIGHT INDUSTRIAL) TO P -D (PLANNED DEVELOPMENT) DISTRICT (1100 ANDERSEN DRIVE) (Z89-11) (GOLDEN STATE LUMBER)" is a true and correct copy of an ordinance of said City and was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the Sixteenth day of October 81 19 89 , published as required by City Charter in the Marin Independent Journal , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a REGULAR meeting of the City Council of said City held on the 6th day of November 1989 by the following vote, to wit: AYES: COUNCILMEMBERS:Frugoli, Thayer & Mayor Mulryan NOES: COUNCILMEMBERS:None ABSENT: COUNCILMEMBERS:None DISQUALIFIED: COUNCILMEMBERS: Boro & Bremner (Due to potential conflict of interest) WITNESS my hand and the official seal of the City of San Rafael this Eiahth day of November , 19 89 JEA N . LEONCINI, City Clerk ORDINANCE NO. 1515 AN ORDINANCE OF THE CITY COUNCIL OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM PCM (PLANNED COMMERCIAL AND LIGHT INDUSTRIAL) TO P -D (PLANNED DEVELOPMENT) DISTRICT 0100 ANDERSEN DRIVE) (Z89-11) (GOLDEN STATE LUMBER) THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by reference by Section 14.15.020 of the Municipal Code is amended by reclassifying the following real property from "PCM" ( Planned Commercial and Light Industrial ) District to "P -D " (Planned Development) District. Said property so reclassified is located at 1 100 Andersen Drive, San Rafael, County Assessor's Parcel 18-180-49 and 31 which is more particularly described in Exhibit "A" attached hereto. DIVISION 2. Any development of this property shall be subject to the conditions outlined in Exhibit "B" attached hereto. DIVISION 3. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such holding or holdings shall not affect the validity of the remaining portions of this ordinance. The Council declares that it would have passed this ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. DIVISION 4. This ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (3 0) days after its final passage. Narcei A as shown upon that certain Parcel Map entitled "Parcel Map Being a 'Reversion to Acreage' and a Resubdivision of the Lands of the San Rafael Redevelopment Agency' filed for record July 27, 1984, in Book 22 of Parcel Maps at page 24, Marin County Records; containing 2.67 acres, more or less. AP #18-180-31 II. Aii that portion of the parcel of land conveyed in the deed from Gallo Glass Company to Pacific Gas and Electric Company by deed dated August 29, 1973, and recorded in Book 2725 of Official Records at page 673, Marin County Records, which lies westerly of a line lying parallel to and 70.0 feet westerly of (measured at right angles toy the center- line of an existing line of towers of first party traversing the parcel of land conveyed in said deed dated August 29, 1973; containing 2.32 acres, more or less. Exhibit "B" CONDITIONS OF APPROVAL: ZONE CHANGE - Z 89-11 PLANNING DEPARTMENT (a) The following zoning is approved: 1. Land Use - Wholesale Lumberyard 2. Land Area - 5.01 acres 3. Building Setbacks - 25 feet front yard setback - 10 feet side yard setback 4. Landscaping - A minimum 20 -foot wide landscaped area shall be provided along the street frontage. (b) In accordance with section 14.51.070 of the San Rafael Zoning Ordinance, the change of zone shall be valid for 18 months from City Council adoption. The zoning shall expire unless a building permit is issued or unless a time extension is granted.
