AN ORDINANCE OF THE CITY OF SAN RAFAEL PREZONING
CERTAIN REAL PROPERTY FROM THE COUNTY OF MARIN
ZONE BFC -RSP 7.26 DU/AC (BAY FRONT CONSERVATION
RESIDENTIAL SINGLE FAMILY PLANNED DISTRICT 6,000 SQ.
FT. MINIMUM LOT SIZE) DISTRICT TO THE CITY R-1 DISTRICT
(RESIDENTIAL SINGLE FAMILY 5,000 SQ. FT. MINIMUM LOT
SIZE.)

THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. The Zoning Map of the City of San Rafael,
California, adopted by reference by Section 14.15.020 of the Municipal Code is
amended by prezoning the following described property from the County of
Marin BFC -RSP 7.26 DU/AC (Bay Front Conservation, Residential Single Family
Planned District, 6,000 sq. ft. minimum lot size) District to the City R-1
(Residential Single Family, 5,000 sq. ft. minimum lot size) District. Said property
contains 7,100 sq. ft. so prezoned and is located south of Point San Pedro Road, on
the south side of Oak Avenue at 183 Oak Drive and shown as County
Assessor's Parcel 186-153-37.
DIVISION 2. This zoning shall become effective in accordance
with Section 65859 of the Government Code of the State of California.
DIVISION 3. The City Council of the City of San Rafael does
hearby find that this Ordinance is necessary for the protection of the public
health, safety and welfare of the population of San Rafael for the following
reason:
The General Plan of the City of San Rafael, specifically Policy LU -6, states that
the annexation of already developed unincorporated islands should be annexed
to the City, dependent on resident interest, the cost/revenue implications of
specific annexation requests and specific annexation requests and provision of
City services to the area.
DIVISION 4. If any section, subsection, sentence, clause or phrase
of this Ordinance is for any reason held to be invalid, such decision shall not
affect the validity of the remaining portions of this Ordinance. The Council
hereby declares that it would have adopted the Ordinance and each section,
subsection, sentence, clause or phrase thereof, irrespective of the fact that any
one or more sections, subsections, sentences, clauses or phrases be declared
invalid.
DIVISION 6. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation, published and
circulated in the City of San Rafael, and shall be in full force and effect thirty (30)
days after its final passage.

regular meeting of the City Council of the City of San Rafael, held on the 19th
day of November, 1990, and ordered passed to print by the following vote, to
