SUMMARY:
At the meeting of November 7, 1983, the Council adopted a resolution to
purchase the Hillside Avenue Open Space parcel. Additionally, they passed
a resolution to authorize the expenditures from Open Space Fund No. 17
for the purpose of acquisition and slide repairs on the parcel.
A current geotechnical report, with recommendations, was prepared by
Donald Herzog and Associates in June of this year. We have since requested
a proposal from them to prepare plans and specifications for the
implementation of their recommendations.
Following is a summary of the estimated costs for preparing the required
documents:

It is anticipated that the work will not be able to be completed this year.
Therefore, an interim winterization plan will be implemented prior to the
rainy season.
RECOMMENDATION:
I RECOMMEND THAT THE CITY COUNCIL, BY MOTION, AUTHORIZE THE CITY MANAGER
TO EXECUTE A SERVICE AGREEMENT WITH DONALD HERZOG AND ASSOCIATES TO PREPARE
PLANS, SPECIFICATIONS AND ESTIMATES FOR THE STABILIZATION OF THE HILLSIDE
AVENUE OPEN SPACE, WITH ALL COSTS TO BE DRAWN FROM OPEN SPACE FUND NO. 17.

Proposal
Geotechnical Services
San Rafael Open Space

This letter presents our proposal to perform geotechnical
engineering services for San Rafael Open Space located near
Hillside Avenue in San Rafael, California. We previously
performed a geotechnical reconnaissance at the site and
presented our findings and recommendations in a written
report dated June 14, 1984. In that report, we noted areas
of erosion and landsliding.
The scope of our work is to provide a topographic survey of
the landslide and erosion areas to prepare the plans and
specification. We intend to subcontract the survey work.
Our plans and specifications are the following:
1. Working drawings to perform the repair.
2. Special provisions of the project specifications.
3. An engineer's estimate to perform the work.
We propose that we perform the work on a time and materials
basis in accordance to the attached Standard Schedule of
Charges.

We would not exceed the above amounts without your written
authorization. Construction inspection services are not
included in the above fee. We are currently seeking other
estimates to do the survey work. If we obtain a lower
estimate, our total fee would be reduced accordingly.
We bill monthly, and bills are due upon presentation and past
due after 30 days. A 1.5 percent per month service charge
and reasonable collection expenses, if any, are added to past
due accounts. If billings become past due, we reserve the
right to cease work and/or to withdraw reports until payment
is received.
Our work would be performed in accordance with generally
accepted standards of engineering practice. We offer no
other guarantees or warranties, either expressed or implied.

Standard laboratory tests are charged for on a unit cost basis
in accordance with the Laboratory Schedule of Charges.
Travel time is charged at normal billing rates.
The charge for appearance as an expert witness is 1.5 times the
rate for engineering services. Half-day and full-day minimums
apply.
Billings are due upon presentation and past due after 30 days.
A 1.5 percent per month service charge and reasonable collection
expenses, if any, are applied to past due accounts.
Our work is performed in accordance with generally accepted
standards of engineering practice. We offer no other guarantees
or warranties, either expressed or implied.
