THIS AGREEMENT made and entered into this 1st. day of June, 1994, by and
between the CITY OF SAN RAFAEL, hereinafter referred to as "CITY", and Gary Burns
hereinafter referred to as "EMPLOYEE".
WHEREAS, the CITY, in order to provide a Recreation Program to its residents
and/or provide program services; and
WHEREAS, the City, in order to provide said program is authorized to employ a
Recreation Program Aide:
NOW, THEREFORE, in consideration of the mutual covenants and agreements
contained herein, the parties hereby agree as follows:
1. The City hereby contracts with the Employee to perform services as Recreation
Program Aide as enumerated in Exhibit "A" attached.
2. The term of employment will be for a period of 12 months beginning July 1,
1996 and shall run no longer than June 30,1997.
3. Employee agrees to perform the services enumerated in Exhibit "A" which is
incorporated herein by reference.
4. Salary shall be at Step B of Wage class 8104 Recreation Program Aide shall be
paid twice each month on the business day falling on or nearest the fifteenth
and the final day of the month in the same manner as full-time, permanent
employees of the City of San Rafael.
5. Fringe Benefits: Recreation Program Aide shall be entitled to the following
fringe benefits:
a. Ten working days of paid vacation per year, with time of vacation subject to
the approval of the Recreation Director. Vacation leave will accrue at the
rate of 6.26 hours per month.
b. Sick leave at the rate of one working day per month.
c. Same paid holidays as permanent employess of City of San Rafael.
d. Worker's Compensation insurance. Employee shall be entitled to Worker's
Compensation Insurance coverage in accordance with the provisions of the
Worker's Compensation Insurance and Safety Act."

e. Health Insurance equivalent to single coverage rate of Kaiser Permanente.
f. Public Agency Retirement System (PARS)
6. Recreation Program Aide will work a regular work week (371/2 hours), five
days a week. Flex time will be subject to the approval of the Recreation
Director. Overtime will be paid only with prior authorization by the
Recreation Director and shall be paid at the rate of time and a half. Overtime
will be paid for any hours over 371/2 hours/week.
7. The Recreation Program Aide will report to and receive direction from the
Recreation Supervisor in charge of the Adult Athletics Division in performance
of duties enumerated in Exhibit A.
8. The Recreation Program Aide and City of San Rafael agree to submit any
claims arising under this Agreement to binding arbitration pursuant to the
current provisions of the California Code of Civil Procedures and any
successor statutes.
9. No other benefits are implied other than those specifically contain in this
document. Employee has no rights to any regular position with the City of
San Rafael. Regular employment procedures administered through the
Personnel Office would be followed should employee wish to be considered
for any full-time regular position.
10. City may terminate this employment agreement at its option, on the
occurrence of any one of the following events:
a. The loss of a facility in which program services are provided due to events
beyond the control of the City, or occurrence of circumstances that make it
impossible or impractical for the program services to be continued. In such
event, City shall give Employee 30 days written notice of termination.
b. The inadequacy of revenue generated by the program services as
determined by Quarterly accounting audits performed by City. In such
event, City shall give Employee 30 days written notice of termination.
c. This agreement may be terminated for any reason by either party at any time
upon 30 day written notice to all parties to this agreement

11. City and Employee may extend, by mutual written agreement, the same terms
and conditions of this Agreement for an additional period as deemed
necessary. IN WITNESS WHEREOF, the parties hereto have entered into this
Agreement the day and year first written above.
