SUBJECT: Review of Use Permit for Ritter Center (UP13-030) for potential modification or revocation
and consideration of alternative option of a Memorandum of Understanding to transfer select services to
other providers/locations.
EXECUTIVE SUMMARY:
Ritter Center has been in operation since the early 1980's and its first Use Permit was in 1992, as a temporary
allowance. Ritter Center began to provide its services at a time when the homeless population in Downtown San
Rafael was much smaller and Ritter was able to serve and accommodate its mission to help the homeless get
back on their feet, without substantial impacts on surrounding residents, businesses, and visitors to the
Downtown. Throughout the years, Ritter's operation has grown, the types of services it provides have increased,
and there has been a significant increase in the homeless population that use or are drawn to downtown and
Ritter Center services (as well as meal services at St. Vincent Dining Hall).
The Ritter Center Use Permit has been modified on a few occasions over the years to allow additional services
and modular buildings, as well as to eliminate the temporary nature of the Use Permit. Ritter Center currently
operates under a Use Permit (UP13-030) that includes conditions of approval limiting the number of clients to
certain functions of their use. There are other functions that Ritter provides (food pantry, behavioral health,
general assistance signup, etc.), that do not have a specific limit on the number of clients served as part of the
approved Use Permit (UP13-030).
In 2012, Ritter received approval for an amendment to UP13-030, allowing an increase in its daily client caseload
for showers and medical services from 40 clients/day to 60 clients/day (averaged over one week). At that time,
Ritter had indicated that it was seeking to relocate outside of downtown and indicated that it planned to move
within three years of that approval (the end of its lease term at that time).
The three year time frame expired in late 2015, but Ritter still does not have an alternate location outside of
Downtown. The City recently has stepped in to help in the search for alternate locations outside downtown or
outside the City of San Rafael, but no site has yet been secured or approved.
At this point, homelessness -related issues in downtown have posed significant impacts on residents, businesses,
and visitors. Although many of the issues with homelessness in downtown cannot solely be attributed to Ritter
Center, many community members have expressed substantial concerns about Ritter Center's operations, and its

associated impacts. The use itself lends to the congregation of homeless persons (who may or may not even be
clients of Ritter), on the streets and properties surrounding Ritter Center. With the growth of the homeless issue in
San Rafael, particularly downtown, the current site for Ritter Center, may not be adequately sized to
accommodate the services that Ritter provides without spilling over and impacting other parts of downtown.
At the conclusion of the 5th performance review on March 21, 2016, the Council directed that the Use Permit be
brought back for a full review and consideration of modification or revocation. In preparing for this review, the City
Attorney has further evaluated the City's ability to modify or revoke the Use Permit under the law, and has
identified new options.
With that in mind, City staff and the City Attorney have worked with Ritter staff and Ritter's legal counsel over the
past few weeks, using the framework established by the Council subcommittee to identify operational changes
that could reduce the intensity of use of the current Ritter site, and have been able to formulate a mutually
agreeable solution that would seek to limit or transfer, to other locations, certain services currently provided by
Ritter, including:
• Relocate part of the food Dantry services to another location or provider;
• Relocate showers/laundry services to another location or to mobile services; and
• Relocate mail services to the Post office or other location.
The proposal would call for the transfer of certain operations from the current site to other locations/providers,
which will help reduce the intensity of use at the site and reduce the attraction to the Ritter Center location.
Therefore, staff recommends that at this time, in lieu of a modification or revocation to the Use Permit, staff will
work with Ritter Center staff to develop a Memorandum of Understanding (MOU) incorporating changes to
operations at the site, and bring that MOU back to the Council for review and approval. The services would
continue on the current site until a new site/provider is operational. Because of the County's substantial funding of
a large portion of the services referenced above (e.g., showers/laundry services), any relocation must be
supported by the County, and, therefore, coordination with the County is important.
RECOMMENDATION:
Staff recommends that the City Council:
1. Direct staff and the City Attorney to continue negotiations with Ritter Center (Ritter staff and counsel) and
prepare a Memorandum of Understanding (MOU) between the City of San Rafael and Ritter Center to
transfer certain services to other locations/providers in the County (part of the food pantry,
laundry/shower services and mail services); and
2. Direct staff to present the draft MOU to the City Council for review and approval at a future meeting; and
3. Defer enforcement related to the current Use Permit while Ritter and the City of San Rafael are engaged
in negotiation of the MOU, and if an MOU is approved, until a determination can be made as to the impact
of the operational modifications on conditions on and adjacent to the Ritter Center site.
BACKGROUND:
Site and Use History:
12-16 Ritter Street: The Ritter Center has been in operation at its current location since 1981. The Ritter Center
is located in four buildings/modular trailers housed on two contiguous lots (12 Ritter and 16 Ritter St) located on
the south side of Ritter Street. As described below, the Ritter Center provides various functions and services
housed in the four buildings, including case management, behavioral health, day services, medical services, food
pantry, emergency clothing/Goodwill Gift certificates, and seasonal programs (Thanksgiving and Christmas):
• Ritter Center (16 Ritter): Offices and food pantry distribution

• Day Services Center (DSC) (12 Ritter): Showers, laundry, mailboxes and restrooms. Prior to the Use
Permit amendment (UP11-070) to install the new medical modular in 2012, the DSC also served as the
medical clinic. Following the approval of the Use Permit amendment (UP11-070) in 2012, the medical
services were transferred to the new modular building and the DSC was limited to showers, laundry,
mailboxes and restrooms.
• Medical Modular Building (12 Ritter): Medical clinic
The 16 Ritter St address was originally built as a single family home converted to office use in 1973. There was
no Use Permit history for the site until 1992, when Ritter (then known as the ("Human Concern Center") applied
for a temporary Use Permit (ED92-52/ UP92-32) to install an 879 sq. ft. trailer on site, to the rear of the existing
building at 16 Ritter St. The City approved a Use Permit and Design Review Permit for the trailer to be used as
office space/counseling.
The adjacent lot at 12 Ritter Street was vacant until 1993, when the City approved a Use Permit and Design
Review Permit (ED93-15/UP93-16) for a 1,100 sq. ft. temporary trailer to be used for Day Services. In 2000, the
City approved a Design Review Permit (ED00-37) to replace this trailer with a new 1,452 sq. ft. trailer. Both lots
have always been viewed as one site in terms of services, but it was not until 2004 that both lots came under
review as one cohesive Use Permit application, signed by both property owners. At that time, the Planning
Commission approved a Use Permit amendment for 12-16 Ritter St (UP04-005). The purpose of the amendment
was to modify several conditions of approval from previous Use Permits because they were no longer applicable
or necessary. Planning Commission Resolution # 04-26 codified the 1993 approved Use Permit operating at 12-
16 Ritter Street, and in effect consolidated all Ritter services under one operational Use Permit. All services listed
in UP04-005 are still part of current Ritter Center services.
815 Third Street (Annex Buildinq): The Ritter Center also leases 1,800 sq. ft. of administrative office space in the
building directly across the street at 815 Third St. This space previously was approved for a temporary Use Permit
to be used as a client screening and pick-up location for the 2011-2012 Rotating Emergency Shelter (REST)
Program (expired April 2012). Ritter continued to use the space for administrative offices once the REST
Program ended. The Use Permit for the Ritter operations does not include activities at 815 Third St. However, the
parcel is zoned 2/3 MUE (Second/Third Mixed Use East) and administrative offices is a permitted use in this
zoning district. Staff recently has been informed that the 815 Third St. site is being used as a REST Program
pick-up location. However, that is not being operated by Ritter. It is our understanding that St. Vincent's is in
charge of this REST pick-up location.
History of Planning Entitlements: The Ritter Center has been in operation in the same location since 1981,
providing a variety of services and resources to working poor and homeless, all free of charge. The City has
approved several planning permits on the site over the years. The complete history of the sites and Ritter Center
(or former names of organization) is provided as Attachment 1 and is summarized below:
• 1992 - Use Permit (UP92-32) and Design Review Permit (ED92-52) approved for 879 sq. ft. office trailer
to be added to rear of 16 Ritter site.
• 1995 - Use Permit amendment (UP95-3) approved 1,100 sq. ft. temporary trailer added to site and the
Use Permit expiration date for the trailer eliminated. A cap of 40 clients a day established for the DSC.
• 2000 - Design Review Permit (ED00-37) approved to allow a 1,452 sq. ft. permanent DSC trailer to
replace the 1,100 sq.ft. temporary trailer, also removed "temporary" status of the trailer. Medical services
were provided as part of the DSC trailer.
• 2004 - Use Permit amendment (UP04-005) eliminated the Day Service Center (DSC) Oversight
Committee and monthly reporting to City requirements.
• 2011 - Use Permit (UP11-070) amendment and Design Review Permit (ED11-098) approved increasing
the maximum client caseload for DSC and medical services from 40 clients/day to 65 clients/day
averaged over the operational work week and addition of a 933 sq. ft. modular trailer for medical
services. Condition of approval required a Performance Report to City Council every 6 months. Appealed
to City Council.

• 2013 — City Council upheld the Planning Commission approval, but amended the approval to reduce the
DSC and medical modular client caseload maximum from 65 clients/day to 60 clients/day. This decision
was memorialized in a Zoning Administrator hearing approving UP13-030.
• 2012-2016 — Five performance reports presented to the Council on Ritter's adherence to the certain
operational standards listed in the conditions of approval.
Current Use Permit: The Ritter Center is currently operating under conditional Use Permit UP13-030 (see
Attachment 2. This Use Permit amended the previously approved Use Permit (UP11-070) and allowed the
relocation of the existing medical clinic space from the 1,452 square foot Day Services Center (DSC) trailer to a
new 933 -square -foot modular. The new medical clinic space was approved to include three exam rooms, a larger
waiting room and medical offices. The total number of clients served (laundry, showers. mailboxes, restrooms
and medical services) was increased from the 40 clients/day approved in 2004 (UP04-005), to 60 clients/day,
averaged over one week. In addition to the medical clinic, the following Ritter Center inventory of services,
previously approved per UP04-05, were all continued to be authorized at the Ritter Center as part of UP13-030:
• Case Management
• Behavioral Health
• Day Services Center (DSC) (laundry, showers, mailboxes, restrooms)
• Food Pantry
• Emergency clothing/Goodwill Gift certificates
• Seasonal programs (Thanksgiving and Christmas)
The Use Permit also delineated the following key conditions of approval (see pages 7-8 in Attachment 2).
Condition of Approval #4: The approved hours of operation for the Ritter Center are 6:00 am to 8:00 pm,
seven days a week. However, current operating hours for the DSC and the medical clinic are 9:00 am to 5:00
pm, Monday through Friday, and some occasional Saturday morning women's medical clinic hours.
Condition of Approval #5: Client caseload for the existing Day Services Center (DSC) and services in the
new modular are limited to a total of 60 clients/day. averaaed over the operational work week. In addition, the
Ritter Center shall submit monthly reports to the Planning Division, which are to: a) provide a tally of the total
number of daily client visits during the previous calendar month; and b) identify the number of days the
"overflow management plan" was implemented.
Condition of Approval #16: Six (6) months from the date of occupancy and operation, a Performance Report
shall be prepared by the Planning Division and shall continue to be prepared every six months thereafter.
This performance report shall report on the Center's adherence to the operational conditions of approval
regulating client limits, litter control and security, and shall include a tracking of the numbers of police service
calls to the facility. Once completed, the performance reports shall be forwarded to the Planning Commission
and City Council. If, during the course of monitoring, it is determined that the Ritter Center is out -of -
compliance with conditions of approval, the City can schedule the Use Permit for a City Council public
hearing.
The current Use Permit does not have a termination date.
ANALYSIS:
Since 1992, Ritter generally has had the same limit on clients for its day services and medical components, 40
clients/day (avg over operation week) maximum until 2012, when it was raised to 60 clients/day maximum.
However, there are many services Ritter provides at its site that are allowed by the Use Permit, but without a
specific numerical limit.
Over the past 5-7 years, there has been a significant increase in the homeless population in Marin, particularly in
downtown San Rafael. Although it appears that Ritter generally is adhering to some of the specific conditions of
approval related to its operations as noted through its past 6 month performance reports, there is a significant
amount of the homeless population that frequent and loiter in the area around Ritter Center and the adjacent
downtown vicinity.

Some of the users of Ritter services cause significant impacts around Ritter Center and throughout Downtown.
Although many of the issues with homelessness in downtown cannot solely be attributed to Ritter Center, the
Ritter Center serves as a hub for many persons who create the significant impacts in the downtown. The use itself
lends to the congregation of homeless persons (who may or may not even be clients of Ritter) on the streets and
properties surrounding Ritter Center. With the growth of the homeless issue in San Rafael, particularly downtown,
the current Ritter Center site may not be adequately sized to accommodate all the services Ritter currently
provides without spilling over and impacting other parts of downtown.
At the March 21, 2016 Council meeting on the fifth performance report, the Council directed staff to schedule the
Use Permit for a full review to consider modification or revocation of the Use Permit (UP13-030) on June 6th and
appointed a Council subcommittee (Councilmembers Colin and Bushey) to review and meet with Ritter to discuss
ideas for potential operational changes. The subcommittee met with Ritter, followed by on-going meetings by Staff
and Ritter to discuss potential operational changes. Furthermore, the City Attorney has also met with Ritter's
counsel to discuss the potential modification/revocation. The attorneys have discussed the Use Permit's legal
status as a permanent vested right, and the City's burden of proof in the event of a legal challenge to a
modification or revocation of the permit.
Meanwhile, however, in the two weeks leading up to this hearing, City and Ritter staff have reached a mutual
understanding on three facets of Ritter's operation that could be modified, as a means to reduce the intensity at
their current site. This would: 1) meet City goals to reduce blight and impacts, 2) obviate the need for revocation
or modification of the Use Permit, 3) eliminate the risks, costs, and uncertainty of litigation, and 4) ensure that
persons in need continue to obtain the services they require.
Thus, staff recommends that in lieu of modification or revocation of the Use Permit, the City and Ritter enter into a
Memorandum of Understanding (MOU) that would: reorganize and transfer the following three services currently
provided by Ritter to alternate locations or providers in the County. The following represents the specific
agreement points between staff and Ritter and would be developed into the MOU:
Relocate Part of Food Pantry from Ritter site
Current Service: Currently, in collaboration with the SF -Marin Food Bank, Ritter provides food pantry
access for homeless and low-income individuals in the community. The Food Bank sends 290 meal
portions to Ritter every single week, with 200 portions going to housed individuals/families and 90
portions going to homeless individuals/families. Through this arrangement, Ritter serves approximately
400 unduplicated persons/families a month. This service is not outlined in the current Use Permit.
Proposed Chanqe: Ritter is open to transferring some of the food pantry functions they currently provide
(for non -housed clients), so long as current clients will still receive comparable service at an alternative
location. The City shares this goal of maintaining the current level of service for people in need of this
critical service. Staff already has begun working with Ritter and the SF -Marin Food bank to spearhead
relocation efforts. Once an alternative site or sites have been identified and services have been
transferred, Ritter will cease to operate part of the food pantry they currently operate on-site.
End Mail Services at Ritter site
Current Service: Currently, Ritter provides mailboxes for persons without addresses. Because there is a
general P.O. Box, in theory there is no cap on how many people can use this service. Historically, Ritter
has had upwards of 400 people utilizing its mailbox service, but they have recently limited access to
active clients. This change has reduced the number of users to approximately 150. This service is not
specifically outlined in the current Use Permit but has been occurring at the site since the early days of
Ritter.
Proposed Chance: The City will work with Ritter on the creation of a new mail process, housed either on
or off-site depending on the final structure of the program. Rather than having a general mailbox like it

does now, Ritter would start creating unique "suite" numbers for every new client, which would then be
integrated into the County's HMIS system.
Transfer Shower/Laundry Services from Ritter site
Current Service: Currently, shower services and laundry are provided on site and are outlined in the Use
Permit. These services are part of the approved Day Service Center and are limited by the 60 person per
day cap, averaged over an operational week.
Proposed Chanpe: Initial discussions and research have shown that mobile showers and laundry facilities
may be a feasible alternative to a fixed location, and there are other counties that provide these services
through mobile delivery (e.g. Santa Clara County, San Mateo County, San Francisco, etc.). The City will
work with the County to identify funding and operations of these mobile services and once the mobile
service is operational, laundry and showers services will cease at Ritter.
The proposed operational changes would go a long way toward reducing the intensity of use at the current site,
as well as minimizing the attraction of the site to the homeless population concentrating in this part of downtown.
One key facet of the proposed agreement is that it identifies those services that can be relocated/transferred to
other providers or locations, but does not require such relocation until a reasonably comparable alternative
site/service is operational. This is important to ensure that people continue to receive the care and services they
need. In addition, Ritter requires a condition that it would retain the right to resume relocated services if the new
site ceased to provide such services. Furthermore, the parties' discussions have anticipated that the terms of the
MOU would not translate into any amendment to the Use Permit, but rather would be a side agreement, between
the two parties.
If the City enters into the MOU, City staff will coordinate with a third partner, the County of Marin, to find the
alternative locations/services for the food pantry, mobile showers/laundry and mail services. Given that the
County provides a portion of Ritter's operational budget and ultimately is responsible for those services
throughout the County, the City will look to the County to partner in this endeavor. Ritter provides many of these
services under contract from the County and they relate to county -wide issues; however transferring them from
the downtown site would reduce impacts on the City of San Rafael, its residents, businesses, and visitors.
The proposed agreement shows a willingness on the part of Ritter to find meaningful changes that can improve
operations at the site and reduce intensity at the site, while Ritter continues to look for an alternate location
outside downtown. As noted and discussed below, there is renewed energy and promising options for relocation,
so the proposed MOU may be merely a temporary solution.
If the Council finds this direction and these points of agreement appropriate, a draft MOU will be prepared and
brought to the Council for review and adoption and will be counter signed by Ritter.
Potential Relocation of Ritter Center
As the Use Permit and potential changes to operations at their current site are under review, Ritter has been
continuing their attempt to relocate its operation out of downtown. The discussion of Ritter's relocation first came
up in 2011, when the Use Permit was amended for the new medical trailer. At that time, Ritter indicated that it
would be seeking to relocate by 2015, when its lease was set to expire.
Ritter contends it has been actively seeking to find an alternate location, but has experienced little success in
locating properties that meet its needs or property owners willing to lease to it. Therefore, at the end of 2015,
Ritter informed the City that it exercised an extension to the lease for both its Ritter Street properties to allow
Ritter to remain in its current location while it continues its search for an alternate location.
Since the beginning of 2016, City staff also has become more actively involved in assisting with the search for an
alternate location. Community Development Department staff and the Director of Homeless Planning and
Outreach have been assigned the task to actively work with Ritter and its real estate broker to find an alternative
location. In addition, staff has been utilizing their contacts and knowledge of the city to help identify alternate sites
to present to Ritter.

At this point, there are no alternative sites yet secured, but there are a handful of sites and general locations that
could potentially accommodate Ritter. Some of these locations are more appropriate for just Ritter services while
others would allow additional, complementary non-profit uses. Any potential relocation of Ritter and other
associated uses would require a Use Permit review and approval, including public notice and comment period.
The City cannot make a decision on any alternate site until an application is received and public hearing is
conducted. At this point, there is no application yet filed. It is also intended that once Ritter finds a new site, the
types of services provided at the new site would be evaluated on the merits of the new site as part of the Use
Permit application and review for that potential site.
COMMUNITY OUTREACH/PUBLIC COMMENTS:
Over the past few years, the City Council has taken significant measures to address the greater homelessness
issue and how it affects downtown and the City at large. Through those measures, the Council has held
numerous public meetings, created a task force of stakeholders, and expended significant resources, including
additional police staff and the creation of a new Director of Homeless Planning and Outreach position. The
Council and various staff in nearly all city departments have been working on various facets of the homeless
issue.
During the five performance reviews of Ritter since 2012, the City also has received a significant amount of
written and verbal comments regarding Ritter Center. Many of the comments support Ritter and its mission to
provide for the homeless population. Hundreds of letters and petitions have previously been submitted to the City
reflecting those comments. However, there are also significant amounts of comments, both written and verbal,
that have been previously submitted that cite specific concerns and issues affecting businesses, residents, and
visitors to downtown. All the public comments received during the prior five performance report reviews are not
included as part of this report. Copies of those all comments and letters received during those prior reviews have
been discussed and accepted previously and are contained in the public record.
Notice of this public hearing was mailed to all property owners, residents, and businesses within 300 feet of the
site, in accordance with the noticing requirements of the Zoning Ordinance. In addition, notice of this meeting was
published in the Marin IJ on Thursday, May 12, 2016.
Copies of all new comments received as part of this Use Permit review hearing, since the March 21, 2016
meeting until the distribution of this staff report, are included in Attachment 3 this report. This includes a letter
from Ken Reich, forwarding a Change.org petition signed by over 1,200 persons that urges the City to reduce the
Ritter Center Use Permit to it's prior level until the Center can be relocated outside downtown. In addition, there
are a few other emails that have been submitted, expressing concern with persons sleeping next to Ritter in the
Klein TV parking lot, Ritter's growth and impact on downtown, and impacts and safety concerns of a resident from
Gerstle Park. Any public comments submitted after the reproduction of this report on Wednesday, June 1, will be
forwarded to the Council under separate cover.
FISCAL IMPACT:
There is no fiscal impact to the City associated with this Use Permit review aside from the staff time and
resources necessary to complete this staff report and analysis. It is estimated that this Use Permit review,
analysis of compliance with conditions of approval, the preparation of this staff report and all other tasks
associated with bringing this matter to this hearing will have accounted for 45-50 hours of staff time (billable at
$132/hr.) for a cost of $1,320. In addition, staff has spent additional time responding to e-mail correspondence for
a total of 5 additional staff hours ($660).
However, the City is expending a significant amount of time and resources on the greater topic of homelessness,
with financial impacts to multiple City Departments through use of staff resources and impacts on public facilities.
OPTIONS:
The City Council has the following options to consider on this matter:
1. Direct staff to work with Ritter Center to prepare an MOU for Council review and approval (Staff
recommendation); or

2. Continue the matter and direct staff to prepare a Draft Resolution, modifying Use Permit UP13-030 with
certain operational changes and return to a subsequent meeting; or
3. Continue the matter to a future City Council hearing and direct staff to return with more information related to
any questions or comments; or
4. Continue the matter to a future City Council hearing and direct staff to prepare a Resolution revoking the
Use Permit; or
5. Refer the matter to the Planning Commission for consideration and recommendation.

Reports - REVISED
After reviewing the files, I have detailed the Planning permit history for 12 Ritter and 16 Ritter Street. The
Ritter center is located on two separate lots. The 16 Ritter Street address was originally a single family
house converted to office use in 1973. There is no use permit history for 16 Ritter Street until 1992, when
the Human Concern Center applied for a temporary use permit to install a 879 square foot trailer on the
site. See history below:
ED92-52/UP92-32 [16 Ritter Street, APN# 011-272-04, application signed by PO, Brovelli]: On July
29, 1992, Zoning Administrator approval for an 879 square foot office building at the rear of the property.
16 Ritter Street served as an office space and the new trailer was approved for office/counseling.

BACKGROUND
On February 14, 2012, the San Rafael Planning Commission (Resolution 12-01) conditionally
approved a Use Permit (UP11-070) and Design Review Permit (ED11-089), amending the
previously approved Use Permit (UP04-005). The amended use permit would allow: 1) the
installation of a 933 square foot medical modular building at 12 Ritter Street; and 2) allow an
increase in the client caseload for the Day Service Center (DSC) and the medical modular
building to a total of 65 clients/day averaged over one week. This decision was appealed to the
City Council and on April 2, 2012, the City Council adopted Resolution No. 13321 upholding the
Planning Commission action to grant a Conditional Use Permit amendment for the Ritter Center
(see Attachment 1). However, the City Council recommended that the Use Permit conditions be
further amended to: 1) reduce the total client visits for the Day Services Center (DSC) and the
medical clinic from 65 clients per day to 60 clients per day, averaged over one week and require
monthly reports to be submitted to the City to provide a tally on the number of client visits for the
DSC and the medical clinic (Condition of Approval #5); 2) require that City staff prepare a
performance report every six months following occupancy to track condition compliance and
police service calls (Condition of Approval #16); and 3) require the Ritter Center management to
develop and implement an "overflow plan" for the medical services component (Condition of
Approval #17).
Per City Council Resolution 13321, the Use Permit amendment allowed the relocation of the
existing medical clinic space from the Day Services Center (DSC) modular to a new 933 -
square -foot modular. The new clinic space was approved to include three exam rooms, a larger
waiting room and medical offices. The total number of clients served (laundry/showers services
and medical services) was increased from the 45 clients/day approved in 2004 (UP04-005), to
60 clients/day, averaged over one week. The approved hours of operation for the Ritter Center
are 6:00 am to 8:00 pm, seven days a week. However, current operating hours for the DSC and
the medical clinic are 9:00 am to 5:00 pm, Monday through Friday, and some Saturday
mornings for the Women's clinic.

Per Resolution 13321, Condition of Approval #16 specifically states:
"Six (6) months from the date of occupancy and operation, a performance report shall be
prepared by the Planning Division and shall continue to be prepared every six months
thereafter. This performance report shall report on the Center's adherence to the
operational conditions of approval regulating client limits, litter control and security, and shall
include a tracking of the numbers of police service calls to the facility. Once completed, the
performance reports shall be forwarded to the Planning Commission and City Council. If,
during the course of monitoring, it is determined that the Ritter Center is out -of -compliance
with conditions of approval, the City can schedule the Use Permit for a City Council public
hearing. "
On June 17, 2013, Planning staff presented the results of the 6 -month performance report to the
City Council covering Ritter Center operations between October 12, 2012 and April 30, 2013.
This was not an official public hearing, and as such, no public comments were heard. Planning
staff made a presentation, followed by a presentation by the Ritter Center Executive Director,
Diane Linn. The Council discussed the item and expressed concern about the method for
tallying the total number of daily clients at the site. Ultimately, the Council agreed that the daily
client caseload for the Day Services Center (DSC) and the medical modular building should be
averaged over the "operational work week" instead of a 7-dav work week." The Council's
rationale was that the average should be based on the days the Center is actually opened in
order to get a better sense of the total number of clients served. While the Use Permit allows
Ritter to operate 7 days/week, the Center is never open on Sundays, and operates Monday
through Friday and occasionally on Saturday mornings for the Women's Clinic.
The Council ultimately accepted the Performance Report, with the caveat that:
1. The daily client caseload for the DSC and the medical modular be no more than 60
clients/day averaged over operational days and not averaged over a 7 day work week;
2. Staff hold a Zoning Administrator hearing to memorialize the changes made by the
City Council at the June 17, 2013 review of the 6 -month Performance Report; and
3. The next 6 -month Performance Report (May 2013 through October 2013) would be
noticed and scheduled as a public hearing, open for public comments on all aspects of
the Use Permit (staff anticipates that due to the Fall holidays, this hearing will take
place sometime in January 2014).
PROJECT DESCRIPTION
The Ritter Center has been in operation its current location since 1981, providing a variety of
services and resources, free of charge to the working poor and homeless. The Ritter Center is
located in four buildings/modulars housed on two contiguous lots located on the south side of
Ritter Street. As described below, the center provides various functions and services housed in
the four buildings, including Case Management, Behavioral Health Day Services, Food Pantry,
Emergency Clothing/Goodwill Gift certificates, Seasonal programs (Thanksgiving and
Christmas):
• Ritter Center (16 Ritter): Offices and food pantry distribution

• Bouchard Building: Case Management (5 offices) and a conference room
• Day Services Center (DSC): Showers, laundry, and restrooms

No change to the Ritter Center operations is proposed by Ritter Center. The purpose of
this Zoning Administrator hearing is to memorialize an interpretation of one of the conditions of
approval by the City Council, during their review of the 6 month performance report. At that
time, the Council found that one of the conditions (use permit condition #5) was not clear on the
method of tallying the daily client case load, thus directed staff to hold a use permit hearing to
amend Condition #5, changing the method of counting the daily client caseload for the DSC and
medical modular, from a 7 -day average to averaaina over the actual number of operational days
(tvpically 5-6 days/week) as directed by the Citv Council.
ENVIRONMENTAL REVIEW
Pursuant to the California Environmental Quality Act (CEQA), an environmental review is
required to evaluate the environmental impacts of the proposed project. Staff has determined
that this project is exempt per Article 19 Categorical Exemptions, Section 15301 a (Existing
Facilities) Class 1 whereas the proposed project is: 1) limited to interior alterations; and 2) has
been reviewed by appropriate city departments who will ensure that appropriate building and/or
fire permits are secured.
PUBLIC HEARING
The Zoning Administrator meeting began at 10:00 A.M. Present at the meeting were Diane
Linn, Executive Director, Ritter Center, James Ferrandini, Ritter Center staff, Hugo Landecker
and Amy Likover, Gerstle Park residents, Jonathan Freeman, Alison Clayton (Health and
Human Services), and Greg Brockbank. Raffi Boloyan, Planning Manager was the Acting
Zoning Administrator. Caron Parker, Associate Planner made a brief staff presentation about
the history of the project, explaining that the focus of the hearing was the change in Condition of
Approval #5 only. Comments on other aspects of the use permit will be considered at the next
City Council hearing to review the second Performance Report for the Ritter Center. This will be
a public hearing and is tentatively set for sometime in January 2014. The public comment
period was opened and public testimony was heard. There were a variety of comments and
questions about how many non -homeless vs. chronically homeless clients are served, capacity
of the medical modular and use of the overflow management plan. Amy Likover specifically
requested that the Resolution be revised to define the term "operational days," and the Zoning
administrator agreed to add this definition. As stated in COA #5, "for the purposes of this
condition, an "operational day" is defined as a day during which the Day Services Center or the
medical modular building is open to clients for services"
The Zoning Administrator stated for the record that there were no letters received by staff in
response to the public notice mailed on August 30, 2013 to property owners and occupants
within a 300' radius of the subject property.

The Zoning Administrator closed the public hearing at 11:00 A.M.
The Zoning Administrator has determined that the City Council directed use permit amendment
to change the method of tallying the total number of clients served per day is a minor
amendment to the approved Use Permit (UP11-070). As such, the amended use permit is in
substantial conformance with the City of San Rafael's Municipal Code property development
standards for the Second/Third Mixed Use East (2/3/MUE) Zoning District, all applicable policies
of the San Rafael General Plan 2020, and the review criteria for Use Permits.
The Zoning Administrator stated that a copy of the meeting minutes, which incorporate the
findings and the conditions of approval, would be mailed to the applicant and the property owner
and would be available to the public for review at the Planning Division counter upon request.
In addition, the Zoning Administrator stated that a project of this nature has an appeal period of
five (5) working days upon the approval or denial of the project.
RECOMMENDATION:
Staff recommends that the Zoning Administrator approve this minor amendment to incorporate the
City Council's interpretation of condition of approval #5, as determined during their review of the
Ritter Center 6 month Performance Report on June 17, 2013. The amended Use Permit will also re-
adopt the Findings as approved by the City Council in granting the original Use Permit UP11-070 in
Resolution 13321, adopted on April 2, 2012. The Zoning Administrator hereby approves this Use
Permit Amendment (UP13-030) to change Condition of Approval #5 (see Page 7), with original
conditions in sty followed by revised condition in underline. All other conditions set forth in
City Council Resolution 13321 shall remain in effect and are listed below. Any decision shall be
final at 5:00 P.M. on Wednesday, September 25, 2013, pending no appeals filed with the City of
San Rafael Planning Division by that date.
FINDINGS:
Use Permit Amendment (UP13-030)
Findings
1) The Ritter Center use, including the proposed Use Permit amendment to relocate the 600
square foot medical clinic to a new 933 square foot modular on site and increase the client
caseload limit for the Day Services Center (DSC) and the new medical modular to 65
clients/day, continues to be in accord with the General Plan, the objectives of the Zoning
Ordinance, and the purposes of the Second/Third Mixed Use East (2/3 MUE) Downtown
District in which the site is located.
a. As discussed on Pages 4-5 of the February 14, 2012 Planning Commission staff report,
the proposed project is consistent with General Plan Policies LU -9 (Intensity of Non -
Residential Development), LU -14 (Land Use Compatibility), NH -4 (Property
Maintenance), NH -17 (Competing Concerns), NH -51 (Existing Business Areas), and CD -
10a (Non -Residential Design Guidelines) in that: i) upon installation of the new medical
modular, the proposed project site would have an FAR=0.87 which is below the

maximum FAR allowed for the site (1.5 FAR); ii) the proposed use is an allowable use in
the Second/Third Mixed Use Land Use Designation; iii) The proposed new modular
would provide a better space for the medical clinic and reduce the number of clients
having to wait outside; iv) the Ritter Center has been operating since 1981 and has
worked with adjacent neighbors to address the challenges and concerns regarding the
impact of Ritter clients on adjacent businesses while still providing needed services to
the poor and homeless. The number of clients has increased steadily over the years
and the proposed increase to 60 clients/day for the DSC and the new modular would be
mitigated by better site organization and client management; and v) the proposed new
modular has been designed with colors and materials to match the existing buildings on
the site; and
The proposed project is consistent the Zoning Ordinance in that medical clinics are
conditionally permitted uses in the Second/Third Mixed Use East (2/3 MUE) Zoning
District and the Ritter Center is currently operating under a previously approved Use
Permit (UP04-005). The proposed Use Permit amendment would not introduce a new
use, but simply relocate the existing approved medical clinic to a more appropriately
designed medical modular space. The elimination of 5 existing parking spaces is
allowed because parking up to 1.0 FAR is provided by parking garages and surface lots
in the Downtown Parking Assessment District.
2) The proposed project, together with the conditions applicable thereto, would not be
detrimental to the public health, safety or welfare, or materially injurious to properties or
improvements in the vicinity, or to the general welfare of the City in that:
a. The proposed project would relocate an existing use into a slightly larger space, but
would not be an substantial "expansion" of medical space because unlike the existing
modular, the new modular is designed with a waiting area;
b. The proposed hours of operation for the clinic (Monday through Friday, 9 am — 5 pm)
has not been increased and is less than the hours previously approved under Use
Permit UP04-005, which allows Ritter Center to operate from 6:00 am to 8:00 pm seven
days a week. The proposed hours coincide with typical hours for other business in the
vicinity;
c. The proposed increase in the number of clients for the DSC and new medical modular
from the 40 clients/day limit per UP04-005, to 60 clients/day reflects current demand for
services on the site. The increase in client numbers is not the result of installing a new
modular on site, but has been an existing condition for several years. The addition of a
new modular designed with a waiting area and better clinic facilities would help alleviate
much of the client back-up on site. The medical clinic would be relocated from the DSC
into the new modular, and the vacated medical space in the DSC is proposed to be used
as offices for the Behavioral Health services staff. The Ritter Center is working with a
space planner to help redesign office space on the site to maximize efficiency. The goal
is to create a better space to manage clients throughout the day and reduce the number
of Ritter clients on the surrounding City streets adjacent to the project site. The
proposed new modular would improve client management on site and therefore reduce
client overflow forced to wait outside for appointments;
d. The revised method for calculating the daily client caseload by averaging the number of
clients over the number of "operational days" rather than over a 7 -day week" will help

maintain the number of clients to no more than 60 clients per day, better manage the
number of clients on site and help reduce impact to the surrounding properties.
e. The Ritter Center will continue the established daily litter removal/site clean-up
operations (as required in UP11-070) to keep the streets near the project site clean;
The Ritter Center will continue implement their security program on site during operating
hours to maximize enforcement of Ritter Center client behavioral policies and ensure
security on-site and in the project area. Ritter has also updated client management
policies to refuse services to clients who violate appropriate behaviors agreements that
impact neighboring businesses. The Ritter Center also has trained staff to manage any
difficult clients and works cooperatively with the San Rafael Police Department to
minimize impacts to adjacent properties;
g. No impact to neighboring businesses is anticipated from the proposed elimination of 5
on-site parking spaces. The project site is in the Downtown Parking Assessment
District, which provides parking for sites up to a 1.0 FAR. The Ritter Center has on-
going off-site parking arrangements to lease space at the PG&E surface lot (on Lindaro
Street between 2nd Street and 3rd Street). Ritter Center has secured 6 additional spaces
in this lot to off -set the loss of the 5 on-site parking spaces proposed to be eliminated. In
addition, Ritter Center has access to parking spaces at the Annex building at 815 Third
Street;
The City's Building/Fire Prevention Division has reviewed the project and developed
conditions of approval that would ensure that the use would operate in a manner as
described and comply with all life and safety code requirements. Additional review will
be required upon submittal of a formal building permit application; and
The project will not have a significant environmental impact, and is exempt from CEQA
review per CEQA Guidelines Article 19 Categorical Exemptions, Section 15301 (Existing
Facilities) and Section 15311 (Accessory Structures) which exempts minor interior and
exterior alterations to existing structures, and the construction of minor structures
accessory to existing commerical, industrial or institutional facilities.
3) That the proposed project, as conditioned, complies with each of the applicable provisions of
the Zoning Ordinance, in that:
a. The project conforms to the requirements of Chapter 5 (Land Use Regulation for the 2/3
MUE Zoning District) as a conditionally permitted use;
b. The project is consistent with the requirements of Chapter 18 (Parking), because no on-
site parking is required for sites up to 1.0 FAR located in the Downtown Parking
Assessment District; and
c. The project applicant submitted a Use Permit amendment application, requesting review
of the proposed new 933 square foot medical modular and proposed increase in the
client caseload limit for the DSC and new medical modular on site.

Conditions of Approval
This Use Permit amendment (UP13-030) approves an amendment to a previously approved
Use Permit (UP11-070) and authorizes the relocation of the existing 600 square foot
medical clinic in the Day Services Center (DSC) trailer to a new 933 square foot modular on
the Ritter Center site. In addition to the medical clinic, the following Ritter Center inventory
of services, previously approved per UP04-005 and UP11-070, and described on page 2 of
the Planning Commission staff report dated February 14, 2012, will continue to be
authorized at the Ritter Center as part of this amended Use Permit amendment:
• Case Management
• Behavioral Health
• Day Services
• Food Pantry
• Emergency clothing/Goodwill Gift certificates
• Seasonal programs (Thanksgiving and Christmas)
2. No food services and no full kitchen shall be allowed in the existing Day Services Center
(DSC) or the new modular. No food of any kind shall be sold for consumption on the
premises.
3. No overnight live-in use of the Ritter Center facility shall be allowed except one person
functioning as a night watch person.
4. Hours of operation for providing client services shall be from 6:00 am to 8:00 pm, seven
days a week. Evening use of the premises after 8:00 pm shall be limited to staff and Board
meetings, and live-in facilities for one night security guard.
5. Client caseload for the existing Day Services Center (DSC) and services in the new modular
are limited to a total of 60 clients/day, averaged ever -the aveFage '-da), we* we over the
operational work week. For the purposes of this condition, an "operational dav" is defined
as a dav during which the Dav Services Center or the medical modular buildinq is open to
clients for services. Commencing at occupancy and occupation of the new modular, on the
first day of each month, the Ritter Center shall submit monthly reports to the Planning
Division, which are to: a) provide a tally of the total number of daily client visits during the
previous calendar month; and b) identify the number of days the `overflow plan" was
implemented (per Use Permit Condition of Approval #17). The form of this report shall be
approved by the Planning Division and City Attorney prior to the issuance of a building
permit, and shall include verification under penalty of perjury.
6. The applicant shall contact the Planning Division to request a final inspection, prior to the
issuance of the final building permit. The request for final inspection by the Planning
Division shall require a minimum of 48-hour advance notice.

7. All donated material shall be stored inside the buildings. No materials shall be stored at 12
Ritter Street or in the parking lot at 815 Third Street, or behind the fences adjacent to the
buildings at 12 Ritter Street at any time. Any additional storage building proposed to be
located on site must be approved by the Planning Division before installation.
8. The Ritter Center shall continue to provide a litter control program to monitor and pick up
litter within the neighborhood area of the Center a minimum of three (3) times per week.
9. The applicant shall continue to provide notice to all employees, volunteers and clients
stating that parking shall not occur on adjacent private lots. The notice shall include a list of
available public parking lots.
10. All clients shall be given a copy of the rules and regulations to be read and signed by all
incoming clients. House Rules shall at a minimum include the following:
a. No clients will be admitted which in the judgment of the Ritter Center staff are under
the influence of alcohol or other substances
b. Violent or threatening behavior will not be permitted
c. Failure to comply with the rules may result in eviction from the program and the
premises.
11. All clients shall continue to be screened for alcohol or drug use before receiving services
and the availability of services to clients shall be the decision of the operators of the Day
Services Center (DSC).
12. Clients who cause a peace disturbance or endanger staff or other clients shall not be
allowed to receive services from the DSC. Readmission of evicted clients shall be based on
established House Rules.
13. The DSC shall continue to maintain a security program during operating hours.
14. This Use Permit amendment (UP13-030) shall have no expiration date and shall run with the
land and remain valid regardless of any change of ownership of the project site, subject to
these conditions.
15. On-going compliance with all conditions of approval shall be required to keep the Use
Permit Amendment valid. This Use Permit amendment (UP13-030) may be called to
hearing at any time by the Planning Division in order to review compliance with the
Conditions of Approval.
16. Six (6) months from the date of occupancy and operation, a performance report shall be
prepared by the Planning Division and shall continue to be prepared every six months
thereafter. This performance report shall report on the Center's adherence to the
operational conditions of approval regulating client limits, litter control and security, and shall
include a tracking of the numbers of police service calls to the facility. Once completed, the
performance reports shall be forwarded to the Planning Commission and City Council. If,

This Use Permit (UP13-030) amendment is conditionally approved and shall become valid after a
five (5) working day appeal period at 5:00 P.M on Wednesday, September 25, 2013, pending no
appeals are filed with the City of San Rafael Planning Division.

Our challenge in the near term is how to reduce the impacts of the growing homeless population who are
forced to live on the streets of our small City. Homelessness is a national crisis, but a quick look at 2015
census numbers tells us there is something different about San Rafael. Comparing San Rafael to
Novato, a City with a similar population, shows us that San Rafael has 2.5 times the homeless
population. Using the same 2015 census numbers you find that San Rafael has a homeless population
per capita that is 20% higher than San Francisco and almost 30% higher than Berkeley. Our small City
is clearly drawing people from elsewhere to use its services. In 2015 approximately 29% of the San
Rafael homeless population, or 167 people, were from outside the County. Property crime, theft,
assaults and robberies have risen concurrently with the growing homeless population in our small City
while falling or remaining steady in other Cities.
The result of this growing population downtown is a City where residents do not feel safe in their own
community. Save San Rafael is submitting for your consideration 30 pages of comments from San
Rafael families describing what life is like in our City today. I hope you will take a few moments to read
through these comments to understand how scared, sad and frustrated our citizens are.
While actions are being taken in the longer term to improve this situation, it is clear that the status quo is
no longer acceptable and something must be done now to make this City once again a place for all of its
citizens. While the Ritter Center is only part of the reason homeless are drawn to downtown San Rafael,
it needs to also be a part of the solution. Until the Ritter Center can be relocated, reducing its use permit
to its previous level is a sensible part of a larger set of actions required to improve life in our downtown
area in the near term.
The status quo must change now. On behalf of the San Rafael families and business owners who
comprise Save San Rafael, I am submitting our petition with over 1200 signatures urging you to reduce
the Ritter Center use permit to its prior level until the Center can be relocated away from downtown.,

her, yelled obscenities at her, made verbal death threats to her and most of
these incidents have been reported to the SRPD In which they responded
promptly. This is unacceptable behavior for you and I, but for a homeless
individual, as they are jailed at the cost of the County and expensive to arrest,
are overlooked on many occasions and cited with a warning to continue on the
Poor behavior. How can I protect my family, my wonderful wife, when the City of
San Rafael can't protect isn't citizens of this community? Ritter Center has it's
own on-site Security Service for a reason, a good reason... to protect
themselves from their own clients they serve. Who is protecting the citizens
from the same clients they serve? Who is protecting my wife and her staff from
the people they serve? The person that threated to slit my wife's throat is the
very same lovely person Ritter Center provides security against. I urge Mayor
Phillips to swiftly move Ritter Center and keep our mothers, children, sisters -
CITIZENS - safe.

facing our community. Many of the people in favor of Ritter don't even live in
San Rafael and don't suffer the constant abuse. Furthermore, they would
never allow Ritter in their neighborhood, but would not hesitate to call me a
NIMBY for my feelings. Look at the damage that street people have done to
the economies and communities around the upper Haight in SF and University
Ave in Berkeley. San Rafael is forced to bare an unfair burden because the US
has no national mental health/addiction policy and other cities and communities
have chosen to send their street people here. They cost the city in police,
medical, and municipal resources that we can't afford to spend. They pose a
severe fire risk. They leave litter everywhere, a gaping wound that the
Downtown Street Team is only a band aid for. Public Urination and defecation
are bad for business. Drug dealers supply the addicts and will defend there turf
with violence. Please excuse the free association here, but the list is too long.
Ritter is a bad neighbor with a hidden agenda. Dianne Linn, former head of
Ritter, once said to me personally, that she "won't stop until anyone who wants
to come to Marin will be given a home". That's scary...

Before they finally agreed to hire a security guard at night, the Salvaton Army
at 41h and Mary was also a magnet for vagrants and crime, much line the Ritter
Center.
But the Ritter Center cannot hire security for all of the areas which are affected
by the problems which It attracts - the parks, the streets, the businesses, our
library - the list goes on and on. The problems
Part of the Ritter Center's mission statement is "TO END HOMELESSNESS IN
MARIN COUNTY" but there is too much evidence that the homeless population
is increasing because of, the Ritter Center. It has helped the city to gain a
reputation as a mecca for homeless people,
San Rafael has less than a quarter of the county's population and almost half
of the homeless population, according to the 2013 census. It's unfair for one
city to bear the burden for a countywide problem. If the County Is going to
continue to pay the Ritter Center $592,000 annually, it should take
responsibility for this problem and give the Ritter Center space on county
property, such as the Marin Commons.

Here is an ongoing problem that is getting worse by the day. People are sleeping day and night in the parking lot of the
former Klein TV next to Ritter. The property was sold about 6 months ago. The new owner chooses not to have an
agreement with the police for enforcement of trespassing.
The site is not an emergency shelter, nor is it a housing site for homeless. Nobody even cleans up trash left behind by
the sleepers. The security people at Ritter do nothing. As a community, what should happen. The only solution I can
think of is a Code Enforcement complaint. Do you have any other suggestions?

Hello Caron - I chatted with Kate Colin today about the upcoming hearings on Ritter Center. I had a few
questions she suggested you may be able to assist with.
My point of view is that San Rafael, while working on its longer term strategy, needs to make some short term
tactical changes to begin to change our reputation as a destination for the homeless and to thereby begin to
reduce the inflow of homeless from outside of our County. I am curious if, in the context of the Ritter Center
use permit, we have considered adding eligibility requirements as a condition of maintaining the use permit.
This would entail criteria to establish whether a person has in the past been a resident of Marin in some capacity
and therefore eligible to receive services.
There may be variations of this idea that would allow Ritter to continue to operate, while changing the
reputation of San Rafael as being a destination for the homeless from outside of our County. We must change
the status quo on May 16th and should explore all possible ideas. Perhaps this has been already considered and
there is a legal reason why it cannot be implemented,

My family and I recently moved to from San Anselmo to Gerstle Park. We have only been in our new home for 2 months
but my concern for the safety of myself and my children has grown to such a level that it warrants an email. In the short
time I've lived here, I have experienced numerous incidents but the most frightening was several nights ago when
someone was banging on my door at 3:4Sam. My trash often gets rummaged through with a mess of old food for me to
pick up the next day. I was nearly accosted going into Safeway by a crazy man flailing his arms at me and screaming
absolute obscenities. I will not shop there again. While walking down 4th St. (near Starbucks) on a Sunday afternoon
with a friend, a guy ran- full speed- at us only to dodge us at the last second. I knew San Rafael had a homeless
situation but living just 3 miles down the road in San Anselmo, I really had no idea of it's depth and impact on the
citizens. I really like my neighbors but am a bit remiss that I have chosen this area to live, particularly because I have
three kids. I have always been involved with helping the homeless and volunteer in the city at both Glide Memorial and
St. Anthony's. I feel that The Ritter Center really contributes to the mess we're faced with in San Rafael. The city is being
taken over by the homeless and the drug addicted.
