EXECUTIVE SUMMARY: Ritter Center has been in operation since the early 1980's and its first Use Permit was in 1992, as a temporary allowance. Ritter Center began to provide its services at a time when the homeless population in Downtown San Rafael was much smaller and Ritter was able to serve and accommodate its mission to help the homeless get back on their feet, without substantial impacts on surrounding residents, businesses, and visitors to the Downtown. Throughout the years, Ritter's operation has grown, the types of services it provides have increased, and there has been a significant increase in the homeless population that use or are drawn to downtown and Ritter Center services (as well as meal services at St. Vincent Dining Hall). The Ritter Center Use Permit has been modified on a few occasions over the years to allow additional services and modular buildings, as well as to eliminate the temporary nature of the Use Permit. Ritter Center currently operates under a Use Permit (UP13-030) that includes conditions of approval limiting the number of clients to certain functions of their use. There are other functions that Ritter provides (food pantry, behavioral health, general assistance signup, etc.), that do not have a specific limit on the number of clients served as part of the approved Use Permit (UP13-030). In 2012, Ritter received approval for an amendment to UP13-030, allowing an increase in its daily client caseload for showers and medical services from 40 clients/day to 60 clients/day (averaged over one week). At that time, Ritter had indicated that it was seeking to relocate outside of downtown and indicated that it planned to move within three years of that approval (the end of its lease term at that time). The three year time frame expired in late 2015, but Ritter still does not have an alternate location outside of Downtown. The City recently has stepped in to help in the search for alternate locations outside downtown or outside the City of San Rafael, but no site has yet been secured or approved. At this point, homelessness -related issues in downtown have posed significant impacts on residents, businesses, and visitors. Although many of the issues with homelessness in downtown cannot solely be attributed to Ritter Center, many community members have expressed substantial concerns about Ritter Center's operations, and its FOR CITY CLERK ONLY File No.: 10-2.7 Council Meeting: 06/06/2016 Disposition: Staff directed to pursue Memorandum of Understanding (MOU) SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2 associated impacts. The use itself lends to the congregation of homeless persons (who may or may not even be clients of Ritter), on the streets and properties surrounding Ritter Center. With the growth of the homeless issue in San Rafael, particularly downtown, the current site for Ritter Center, may not be adequately sized to accommodate the services that Ritter provides without spilling over and impacting other parts of downtown. At the conclusion of the 5th performance review on March 21, 2016, the Council directed that the Use Permit be brought back for a full review and consideration of modification or revocation. In preparing for this review, the City Attorney has further evaluated the City's ability to modify or revoke the Use Permit under the law, and has identified new options. With that in mind, City staff and the City Attorney have worked with Ritter staff and Ritter's legal counsel over the past few weeks, using the framework established by the Council subcommittee to identify operational changes that could reduce the intensity of use of the current Ritter site, and have been able to formulate a mutually agreeable solution that would seek to limit or transfer, to other locations, certain services currently provided by Ritter, including: • Relocate part of the food Dantry services to another location or provider; • Relocate showers/laundry services to another location or to mobile services; and • Relocate mail services to the Post office or other location. The proposal would call for the transfer of certain operations from the current site to other locations/providers, which will help reduce the intensity of use at the site and reduce the attraction to the Ritter Center location. Therefore, staff recommends that at this time, in lieu of a modification or revocation to the Use Permit, staff will work with Ritter Center staff to develop a Memorandum of Understanding (MOU) incorporating changes to operations at the site, and bring that MOU back to the Council for review and approval. The services would continue on the current site until a new site/provider is operational. Because of the County's substantial funding of a large portion of the services referenced above (e.g., showers/laundry services), any relocation must be supported by the County, and, therefore, coordination with the County is important. RECOMMENDATION: Staff recommends that the City Council: 1. Direct staff and the City Attorney to continue negotiations with Ritter Center (Ritter staff and counsel) and prepare a Memorandum of Understanding (MOU) between the City of San Rafael and Ritter Center to transfer certain services to other locations/providers in the County (part of the food pantry, laundry/shower services and mail services); and 2. Direct staff to present the draft MOU to the City Council for review and approval at a future meeting; and 3. Defer enforcement related to the current Use Permit while Ritter and the City of San Rafael are engaged in negotiation of the MOU, and if an MOU is approved, until a determination can be made as to the impact of the operational modifications on conditions on and adjacent to the Ritter Center site. BACKGROUND: Site and Use History: 12-16 Ritter Street: The Ritter Center has been in operation at its current location since 1981. The Ritter Center is located in four buildings/modular trailers housed on two contiguous lots (12 Ritter and 16 Ritter St) located on the south side of Ritter Street. As described below, the Ritter Center provides various functions and services housed in the four buildings, including case management, behavioral health, day services, medical services, food pantry, emergency clothing/Goodwill Gift certificates, and seasonal programs (Thanksgiving and Christmas): • Ritter Center (16 Ritter): Offices and food pantry distribution 0 Bouchard Building (16 Ritter): Case Management (5 offices) and a conference room SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 3 • Day Services Center (DSC) (12 Ritter): Showers, laundry, mailboxes and restrooms. Prior to the Use Permit amendment (UP11-070) to install the new medical modular in 2012, the DSC also served as the medical clinic. Following the approval of the Use Permit amendment (UP11-070) in 2012, the medical services were transferred to the new modular building and the DSC was limited to showers, laundry, mailboxes and restrooms. • Medical Modular Building (12 Ritter): Medical clinic The 16 Ritter St address was originally built as a single family home converted to office use in 1973. There was no Use Permit history for the site until 1992, when Ritter (then known as the ("Human Concern Center") applied for a temporary Use Permit (ED92-52/ UP92-32) to install an 879 sq. ft. trailer on site, to the rear of the existing building at 16 Ritter St. The City approved a Use Permit and Design Review Permit for the trailer to be used as office space/counseling. The adjacent lot at 12 Ritter Street was vacant until 1993, when the City approved a Use Permit and Design Review Permit (ED93-15/UP93-16) for a 1,100 sq. ft. temporary trailer to be used for Day Services. In 2000, the City approved a Design Review Permit (ED00-37) to replace this trailer with a new 1,452 sq. ft. trailer. Both lots have always been viewed as one site in terms of services, but it was not until 2004 that both lots came under review as one cohesive Use Permit application, signed by both property owners. At that time, the Planning Commission approved a Use Permit amendment for 12-16 Ritter St (UP04-005). The purpose of the amendment was to modify several conditions of approval from previous Use Permits because they were no longer applicable or necessary. Planning Commission Resolution # 04-26 codified the 1993 approved Use Permit operating at 12- 16 Ritter Street, and in effect consolidated all Ritter services under one operational Use Permit. All services listed in UP04-005 are still part of current Ritter Center services. 815 Third Street (Annex Buildinq): The Ritter Center also leases 1,800 sq. ft. of administrative office space in the building directly across the street at 815 Third St. This space previously was approved for a temporary Use Permit to be used as a client screening and pick-up location for the 2011-2012 Rotating Emergency Shelter (REST) Program (expired April 2012). Ritter continued to use the space for administrative offices once the REST Program ended. The Use Permit for the Ritter operations does not include activities at 815 Third St. However, the parcel is zoned 2/3 MUE (Second/Third Mixed Use East) and administrative offices is a permitted use in this zoning district. Staff recently has been informed that the 815 Third St. site is being used as a REST Program pick-up location. However, that is not being operated by Ritter. It is our understanding that St. Vincent's is in charge of this REST pick-up location. History of Planning Entitlements: The Ritter Center has been in operation in the same location since 1981, providing a variety of services and resources to working poor and homeless, all free of charge. The City has approved several planning permits on the site over the years. The complete history of the sites and Ritter Center (or former names of organization) is provided as Attachment 1 and is summarized below: • 1992 - Use Permit (UP92-32) and Design Review Permit (ED92-52) approved for 879 sq. ft. office trailer to be added to rear of 16 Ritter site. • 1995 - Use Permit amendment (UP95-3) approved 1,100 sq. ft. temporary trailer added to site and the Use Permit expiration date for the trailer eliminated. A cap of 40 clients a day established for the DSC. • 2000 - Design Review Permit (ED00-37) approved to allow a 1,452 sq. ft. permanent DSC trailer to replace the 1,100 sq.ft. temporary trailer, also removed "temporary" status of the trailer. Medical services were provided as part of the DSC trailer. • 2004 - Use Permit amendment (UP04-005) eliminated the Day Service Center (DSC) Oversight Committee and monthly reporting to City requirements. • 2011 - Use Permit (UP11-070) amendment and Design Review Permit (ED11-098) approved increasing the maximum client caseload for DSC and medical services from 40 clients/day to 65 clients/day averaged over the operational work week and addition of a 933 sq. ft. modular trailer for medical services. Condition of approval required a Performance Report to City Council every 6 months. Appealed to City Council. SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 4 • 2013 — City Council upheld the Planning Commission approval, but amended the approval to reduce the DSC and medical modular client caseload maximum from 65 clients/day to 60 clients/day. This decision was memorialized in a Zoning Administrator hearing approving UP13-030. • 2012-2016 — Five performance reports presented to the Council on Ritter's adherence to the certain operational standards listed in the conditions of approval. Current Use Permit: The Ritter Center is currently operating under conditional Use Permit UP13-030 (see Attachment 2. This Use Permit amended the previously approved Use Permit (UP11-070) and allowed the relocation of the existing medical clinic space from the 1,452 square foot Day Services Center (DSC) trailer to a new 933 -square -foot modular. The new medical clinic space was approved to include three exam rooms, a larger waiting room and medical offices. The total number of clients served (laundry, showers. mailboxes, restrooms and medical services) was increased from the 40 clients/day approved in 2004 (UP04-005), to 60 clients/day, averaged over one week. In addition to the medical clinic, the following Ritter Center inventory of services, previously approved per UP04-05, were all continued to be authorized at the Ritter Center as part of UP13-030: • Case Management • Behavioral Health • Day Services Center (DSC) (laundry, showers, mailboxes, restrooms) • Food Pantry • Emergency clothing/Goodwill Gift certificates • Seasonal programs (Thanksgiving and Christmas) The Use Permit also delineated the following key conditions of approval (see pages 7-8 in Attachment 2). Condition of Approval #4: The approved hours of operation for the Ritter Center are 6:00 am to 8:00 pm, seven days a week. However, current operating hours for the DSC and the medical clinic are 9:00 am to 5:00 pm, Monday through Friday, and some occasional Saturday morning women's medical clinic hours. Condition of Approval #5: Client caseload for the existing Day Services Center (DSC) and services in the new modular are limited to a total of 60 clients/day. averaaed over the operational work week. In addition, the Ritter Center shall submit monthly reports to the Planning Division, which are to: a) provide a tally of the total number of daily client visits during the previous calendar month; and b) identify the number of days the "overflow management plan" was implemented. Condition of Approval #16: Six (6) months from the date of occupancy and operation, a Performance Report shall be prepared by the Planning Division and shall continue to be prepared every six months thereafter. This performance report shall report on the Center's adherence to the operational conditions of approval regulating client limits, litter control and security, and shall include a tracking of the numbers of police service calls to the facility. Once completed, the performance reports shall be forwarded to the Planning Commission and City Council. If, during the course of monitoring, it is determined that the Ritter Center is out -of - compliance with conditions of approval, the City can schedule the Use Permit for a City Council public hearing. The current Use Permit does not have a termination date. ANALYSIS: Since 1992, Ritter generally has had the same limit on clients for its day services and medical components, 40 clients/day (avg over operation week) maximum until 2012, when it was raised to 60 clients/day maximum. However, there are many services Ritter provides at its site that are allowed by the Use Permit, but without a specific numerical limit. Over the past 5-7 years, there has been a significant increase in the homeless population in Marin, particularly in downtown San Rafael. Although it appears that Ritter generally is adhering to some of the specific conditions of approval related to its operations as noted through its past 6 month performance reports, there is a significant amount of the homeless population that frequent and loiter in the area around Ritter Center and the adjacent downtown vicinity. SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 5 Some of the users of Ritter services cause significant impacts around Ritter Center and throughout Downtown. Although many of the issues with homelessness in downtown cannot solely be attributed to Ritter Center, the Ritter Center serves as a hub for many persons who create the significant impacts in the downtown. The use itself lends to the congregation of homeless persons (who may or may not even be clients of Ritter) on the streets and properties surrounding Ritter Center. With the growth of the homeless issue in San Rafael, particularly downtown, the current Ritter Center site may not be adequately sized to accommodate all the services Ritter currently provides without spilling over and impacting other parts of downtown. At the March 21, 2016 Council meeting on the fifth performance report, the Council directed staff to schedule the Use Permit for a full review to consider modification or revocation of the Use Permit (UP13-030) on June 6th and appointed a Council subcommittee (Councilmembers Colin and Bushey) to review and meet with Ritter to discuss ideas for potential operational changes. The subcommittee met with Ritter, followed by on-going meetings by Staff and Ritter to discuss potential operational changes. Furthermore, the City Attorney has also met with Ritter's counsel to discuss the potential modification/revocation. The attorneys have discussed the Use Permit's legal status as a permanent vested right, and the City's burden of proof in the event of a legal challenge to a modification or revocation of the permit. Meanwhile, however, in the two weeks leading up to this hearing, City and Ritter staff have reached a mutual understanding on three facets of Ritter's operation that could be modified, as a means to reduce the intensity at their current site. This would: 1) meet City goals to reduce blight and impacts, 2) obviate the need for revocation or modification of the Use Permit, 3) eliminate the risks, costs, and uncertainty of litigation, and 4) ensure that persons in need continue to obtain the services they require. Thus, staff recommends that in lieu of modification or revocation of the Use Permit, the City and Ritter enter into a Memorandum of Understanding (MOU) that would: reorganize and transfer the following three services currently provided by Ritter to alternate locations or providers in the County. The following represents the specific agreement points between staff and Ritter and would be developed into the MOU: Relocate Part of Food Pantry from Ritter site Current Service: Currently, in collaboration with the SF -Marin Food Bank, Ritter provides food pantry access for homeless and low-income individuals in the community. The Food Bank sends 290 meal portions to Ritter every single week, with 200 portions going to housed individuals/families and 90 portions going to homeless individuals/families. Through this arrangement, Ritter serves approximately 400 unduplicated persons/families a month. This service is not outlined in the current Use Permit. Proposed Chanqe: Ritter is open to transferring some of the food pantry functions they currently provide (for non -housed clients), so long as current clients will still receive comparable service at an alternative location. The City shares this goal of maintaining the current level of service for people in need of this critical service. Staff already has begun working with Ritter and the SF -Marin Food bank to spearhead relocation efforts. Once an alternative site or sites have been identified and services have been transferred, Ritter will cease to operate part of the food pantry they currently operate on-site. End Mail Services at Ritter site Current Service: Currently, Ritter provides mailboxes for persons without addresses. Because there is a general P.O. Box, in theory there is no cap on how many people can use this service. Historically, Ritter has had upwards of 400 people utilizing its mailbox service, but they have recently limited access to active clients. This change has reduced the number of users to approximately 150. This service is not specifically outlined in the current Use Permit but has been occurring at the site since the early days of Ritter. Proposed Chance: The City will work with Ritter on the creation of a new mail process, housed either on or off-site depending on the final structure of the program. Rather than having a general mailbox like it SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 6 does now, Ritter would start creating unique "suite" numbers for every new client, which would then be integrated into the County's HMIS system. Transfer Shower/Laundry Services from Ritter site Current Service: Currently, shower services and laundry are provided on site and are outlined in the Use Permit. These services are part of the approved Day Service Center and are limited by the 60 person per day cap, averaged over an operational week. Proposed Chanpe: Initial discussions and research have shown that mobile showers and laundry facilities may be a feasible alternative to a fixed location, and there are other counties that provide these services through mobile delivery (e.g. Santa Clara County, San Mateo County, San Francisco, etc.). The City will work with the County to identify funding and operations of these mobile services and once the mobile service is operational, laundry and showers services will cease at Ritter. The proposed operational changes would go a long way toward reducing the intensity of use at the current site, as well as minimizing the attraction of the site to the homeless population concentrating in this part of downtown. One key facet of the proposed agreement is that it identifies those services that can be relocated/transferred to other providers or locations, but does not require such relocation until a reasonably comparable alternative site/service is operational. This is important to ensure that people continue to receive the care and services they need. In addition, Ritter requires a condition that it would retain the right to resume relocated services if the new site ceased to provide such services. Furthermore, the parties' discussions have anticipated that the terms of the MOU would not translate into any amendment to the Use Permit, but rather would be a side agreement, between the two parties. If the City enters into the MOU, City staff will coordinate with a third partner, the County of Marin, to find the alternative locations/services for the food pantry, mobile showers/laundry and mail services. Given that the County provides a portion of Ritter's operational budget and ultimately is responsible for those services throughout the County, the City will look to the County to partner in this endeavor. Ritter provides many of these services under contract from the County and they relate to county -wide issues; however transferring them from the downtown site would reduce impacts on the City of San Rafael, its residents, businesses, and visitors. The proposed agreement shows a willingness on the part of Ritter to find meaningful changes that can improve operations at the site and reduce intensity at the site, while Ritter continues to look for an alternate location outside downtown. As noted and discussed below, there is renewed energy and promising options for relocation, so the proposed MOU may be merely a temporary solution. If the Council finds this direction and these points of agreement appropriate, a draft MOU will be prepared and brought to the Council for review and adoption and will be counter signed by Ritter. Potential Relocation of Ritter Center As the Use Permit and potential changes to operations at their current site are under review, Ritter has been continuing their attempt to relocate its operation out of downtown. The discussion of Ritter's relocation first came up in 2011, when the Use Permit was amended for the new medical trailer. At that time, Ritter indicated that it would be seeking to relocate by 2015, when its lease was set to expire. Ritter contends it has been actively seeking to find an alternate location, but has experienced little success in locating properties that meet its needs or property owners willing to lease to it. Therefore, at the end of 2015, Ritter informed the City that it exercised an extension to the lease for both its Ritter Street properties to allow Ritter to remain in its current location while it continues its search for an alternate location. Since the beginning of 2016, City staff also has become more actively involved in assisting with the search for an alternate location. Community Development Department staff and the Director of Homeless Planning and Outreach have been assigned the task to actively work with Ritter and its real estate broker to find an alternative location. In addition, staff has been utilizing their contacts and knowledge of the city to help identify alternate sites to present to Ritter. SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 7 At this point, there are no alternative sites yet secured, but there are a handful of sites and general locations that could potentially accommodate Ritter. Some of these locations are more appropriate for just Ritter services while others would allow additional, complementary non-profit uses. Any potential relocation of Ritter and other associated uses would require a Use Permit review and approval, including public notice and comment period. The City cannot make a decision on any alternate site until an application is received and public hearing is conducted. At this point, there is no application yet filed. It is also intended that once Ritter finds a new site, the types of services provided at the new site would be evaluated on the merits of the new site as part of the Use Permit application and review for that potential site. COMMUNITY OUTREACH/PUBLIC COMMENTS: Over the past few years, the City Council has taken significant measures to address the greater homelessness issue and how it affects downtown and the City at large. Through those measures, the Council has held numerous public meetings, created a task force of stakeholders, and expended significant resources, including additional police staff and the creation of a new Director of Homeless Planning and Outreach position. The Council and various staff in nearly all city departments have been working on various facets of the homeless issue. During the five performance reviews of Ritter since 2012, the City also has received a significant amount of written and verbal comments regarding Ritter Center. Many of the comments support Ritter and its mission to provide for the homeless population. Hundreds of letters and petitions have previously been submitted to the City reflecting those comments. However, there are also significant amounts of comments, both written and verbal, that have been previously submitted that cite specific concerns and issues affecting businesses, residents, and visitors to downtown. All the public comments received during the prior five performance report reviews are not included as part of this report. Copies of those all comments and letters received during those prior reviews have been discussed and accepted previously and are contained in the public record. Notice of this public hearing was mailed to all property owners, residents, and businesses within 300 feet of the site, in accordance with the noticing requirements of the Zoning Ordinance. In addition, notice of this meeting was published in the Marin IJ on Thursday, May 12, 2016. Copies of all new comments received as part of this Use Permit review hearing, since the March 21, 2016 meeting until the distribution of this staff report, are included in Attachment 3 this report. This includes a letter from Ken Reich, forwarding a Change.org petition signed by over 1,200 persons that urges the City to reduce the Ritter Center Use Permit to it's prior level until the Center can be relocated outside downtown. In addition, there are a few other emails that have been submitted, expressing concern with persons sleeping next to Ritter in the Klein TV parking lot, Ritter's growth and impact on downtown, and impacts and safety concerns of a resident from Gerstle Park. Any public comments submitted after the reproduction of this report on Wednesday, June 1, will be forwarded to the Council under separate cover. FISCAL IMPACT: There is no fiscal impact to the City associated with this Use Permit review aside from the staff time and resources necessary to complete this staff report and analysis. It is estimated that this Use Permit review, analysis of compliance with conditions of approval, the preparation of this staff report and all other tasks associated with bringing this matter to this hearing will have accounted for 45-50 hours of staff time (billable at $132/hr.) for a cost of $1,320. In addition, staff has spent additional time responding to e-mail correspondence for a total of 5 additional staff hours ($660). However, the City is expending a significant amount of time and resources on the greater topic of homelessness, with financial impacts to multiple City Departments through use of staff resources and impacts on public facilities. OPTIONS: The City Council has the following options to consider on this matter: 1. Direct staff to work with Ritter Center to prepare an MOU for Council review and approval (Staff recommendation); or SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 8 2. Continue the matter and direct staff to prepare a Draft Resolution, modifying Use Permit UP13-030 with certain operational changes and return to a subsequent meeting; or 3. Continue the matter to a future City Council hearing and direct staff to return with more information related to any questions or comments; or 4. Continue the matter to a future City Council hearing and direct staff to prepare a Resolution revoking the Use Permit; or 5. Refer the matter to the Planning Commission for consideration and recommendation. ATTACHMENTS: 1. Ritter Center history of Planning entitlements 2. Public Correspondence DATE: April 21, 2016 TO: File Community Development Department MEMORANDUM FROM: Caron Parker, Associate Planner SUBJECT: 12-16 Ritter Street — History of Planning approvals and Performance Reports - REVISED After reviewing the files, I have detailed the Planning permit history for 12 Ritter and 16 Ritter Street. The Ritter center is located on two separate lots. The 16 Ritter Street address was originally a single family house converted to office use in 1973. There is no use permit history for 16 Ritter Street until 1992, when the Human Concern Center applied for a temporary use permit to install a 879 square foot trailer on the site. See history below: ED92-52/UP92-32 [16 Ritter Street, APN# 011-272-04, application signed by PO, Brovelli]: On July 29, 1992, Zoning Administrator approval for an 879 square foot office building at the rear of the property. 16 Ritter Street served as an office space and the new trailer was approved for office/counseling. ED93-15/UP93-15 [14 Ritter, APN # 011-272-13, application signed by PO, Bottarini]: On March 23, 1993, the Planning Commission approved a UP and ED for a 1,100 square foot temporary trailer for day services. The UP was set to expire in 2 years (May 5, 1995). The PC approval was appealed to the City Council. The appeal denied (Resolution #8887). PC decision upheld by Council on April 19, 1993. Appeal documents listed APN # 011-272-13. UP95-3 [16 Ritter Street, APN# 011-272-04; application signed by PO Bottarini]: On February 28, 1995, the Planning Commission approved an extension to the previously approved Use Permit UP93-16, which had a 2 -year deadline. Max client caseload for DSC set at 40 clients/day averaged over 1 week. Expiration date eliminated. Evening uses after 8 pm limited to staff meetings. ED00-37 [12 Ritter Street], APN # 011-272-13; application signed by Bottarini]: On May 31, 2000, the Zoning Administrator approved a new 1,452 square foot modular to replace the existing 1,100 sf modular (approved in 1993 as a temporary trailer). The trailer will be used for Day Services. UP04-005 [12-16 Ritter Street, APN# 011-271-04 and 011-272-13, application signed by both PO's, Bottarini and Brovelli]: On September 14, 2004, the Planning Commission amended UP95-003 to allow modifications to the conditions of approval #1, #3, #4, #5, #7, #8(a) and #13. (see Resolution 04-26). COA #13 states NO expiration date to UP. COA #7 still limits caseload to 40 visits/day, averaged over 1 week. UP11-070/ED11-089 [12 Ritter, APN# 011-271-13, signed by Bottarini]: On February 14, 2012, The Planning Commission approved a Use permit and design review permit for a new 933 sf medical trailer on site to handle up to 65 clients/day. On appeal, the City Council reduced the client caseload for the medical trailer and DSC to 60 clients per day, averaged over one week. UP13-030 [12 Ritter, APN #011-271-13, signed by Bottarini]: On September 18, 2013, ZA approval of use permit changing COA #5 per CC direction. COA #5 now states that the average client caseload for the DSC and the medical modular would be limited to 60 clients per day averaged over the actual number of days the Ritter Center is opened "operational days" and not the 7 -day work week. The change would require that the 60 client per day caseload limit be averaged over the number of operational days instead of a 7 -day work week. No other changes to the approved use permit (UP11-070) is proposed; APN No. 011-271-13; Second/Third Mixed Use East (2/3 MUE) Zoning District; Velma Bottarini, owner; Diane Linn, Executive Director, Ritter Center, applicant; File No. UP13-030 Project Planner: Caron Parker, Associate Planner BACKGROUND On February 14, 2012, the San Rafael Planning Commission (Resolution 12-01) conditionally approved a Use Permit (UP11-070) and Design Review Permit (ED11-089), amending the previously approved Use Permit (UP04-005). The amended use permit would allow: 1) the installation of a 933 square foot medical modular building at 12 Ritter Street; and 2) allow an increase in the client caseload for the Day Service Center (DSC) and the medical modular building to a total of 65 clients/day averaged over one week. This decision was appealed to the City Council and on April 2, 2012, the City Council adopted Resolution No. 13321 upholding the Planning Commission action to grant a Conditional Use Permit amendment for the Ritter Center (see Attachment 1). However, the City Council recommended that the Use Permit conditions be further amended to: 1) reduce the total client visits for the Day Services Center (DSC) and the medical clinic from 65 clients per day to 60 clients per day, averaged over one week and require monthly reports to be submitted to the City to provide a tally on the number of client visits for the DSC and the medical clinic (Condition of Approval #5); 2) require that City staff prepare a performance report every six months following occupancy to track condition compliance and police service calls (Condition of Approval #16); and 3) require the Ritter Center management to develop and implement an "overflow plan" for the medical services component (Condition of Approval #17). Per City Council Resolution 13321, the Use Permit amendment allowed the relocation of the existing medical clinic space from the Day Services Center (DSC) modular to a new 933 - square -foot modular. The new clinic space was approved to include three exam rooms, a larger waiting room and medical offices. The total number of clients served (laundry/showers services and medical services) was increased from the 45 clients/day approved in 2004 (UP04-005), to 60 clients/day, averaged over one week. The approved hours of operation for the Ritter Center are 6:00 am to 8:00 pm, seven days a week. However, current operating hours for the DSC and the medical clinic are 9:00 am to 5:00 pm, Monday through Friday, and some Saturday mornings for the Women's clinic. ATTACHMENT 2-1 12 Ritter Street [Ritter Center] Re: UP13-030 Date: September 18, 2013 Per Resolution 13321, Condition of Approval #16 specifically states: "Six (6) months from the date of occupancy and operation, a performance report shall be prepared by the Planning Division and shall continue to be prepared every six months thereafter. This performance report shall report on the Center's adherence to the operational conditions of approval regulating client limits, litter control and security, and shall include a tracking of the numbers of police service calls to the facility. Once completed, the performance reports shall be forwarded to the Planning Commission and City Council. If, during the course of monitoring, it is determined that the Ritter Center is out -of -compliance with conditions of approval, the City can schedule the Use Permit for a City Council public hearing. " On June 17, 2013, Planning staff presented the results of the 6 -month performance report to the City Council covering Ritter Center operations between October 12, 2012 and April 30, 2013. This was not an official public hearing, and as such, no public comments were heard. Planning staff made a presentation, followed by a presentation by the Ritter Center Executive Director, Diane Linn. The Council discussed the item and expressed concern about the method for tallying the total number of daily clients at the site. Ultimately, the Council agreed that the daily client caseload for the Day Services Center (DSC) and the medical modular building should be averaged over the "operational work week" instead of a 7-dav work week." The Council's rationale was that the average should be based on the days the Center is actually opened in order to get a better sense of the total number of clients served. While the Use Permit allows Ritter to operate 7 days/week, the Center is never open on Sundays, and operates Monday through Friday and occasionally on Saturday mornings for the Women's Clinic. The Council ultimately accepted the Performance Report, with the caveat that: 1. The daily client caseload for the DSC and the medical modular be no more than 60 clients/day averaged over operational days and not averaged over a 7 day work week; 2. Staff hold a Zoning Administrator hearing to memorialize the changes made by the City Council at the June 17, 2013 review of the 6 -month Performance Report; and 3. The next 6 -month Performance Report (May 2013 through October 2013) would be noticed and scheduled as a public hearing, open for public comments on all aspects of the Use Permit (staff anticipates that due to the Fall holidays, this hearing will take place sometime in January 2014). PROJECT DESCRIPTION The Ritter Center has been in operation its current location since 1981, providing a variety of services and resources, free of charge to the working poor and homeless. The Ritter Center is located in four buildings/modulars housed on two contiguous lots located on the south side of Ritter Street. As described below, the center provides various functions and services housed in the four buildings, including Case Management, Behavioral Health Day Services, Food Pantry, Emergency Clothing/Goodwill Gift certificates, Seasonal programs (Thanksgiving and Christmas): • Ritter Center (16 Ritter): Offices and food pantry distribution SRZA Minutes 9.18.13 ATTACHMENT 2-2 12 Ritter Street [Ritter Center] Re: UP13-030 Date: September 18, 2013 • Bouchard Building: Case Management (5 offices) and a conference room • Day Services Center (DSC): Showers, laundry, and restrooms • Medical Modular Building: Medical clinic No change to the Ritter Center operations is proposed by Ritter Center. The purpose of this Zoning Administrator hearing is to memorialize an interpretation of one of the conditions of approval by the City Council, during their review of the 6 month performance report. At that time, the Council found that one of the conditions (use permit condition #5) was not clear on the method of tallying the daily client case load, thus directed staff to hold a use permit hearing to amend Condition #5, changing the method of counting the daily client caseload for the DSC and medical modular, from a 7 -day average to averaaina over the actual number of operational days (tvpically 5-6 days/week) as directed by the Citv Council. ENVIRONMENTAL REVIEW Pursuant to the California Environmental Quality Act (CEQA), an environmental review is required to evaluate the environmental impacts of the proposed project. Staff has determined that this project is exempt per Article 19 Categorical Exemptions, Section 15301 a (Existing Facilities) Class 1 whereas the proposed project is: 1) limited to interior alterations; and 2) has been reviewed by appropriate city departments who will ensure that appropriate building and/or fire permits are secured. PUBLIC HEARING The Zoning Administrator meeting began at 10:00 A.M. Present at the meeting were Diane Linn, Executive Director, Ritter Center, James Ferrandini, Ritter Center staff, Hugo Landecker and Amy Likover, Gerstle Park residents, Jonathan Freeman, Alison Clayton (Health and Human Services), and Greg Brockbank. Raffi Boloyan, Planning Manager was the Acting Zoning Administrator. Caron Parker, Associate Planner made a brief staff presentation about the history of the project, explaining that the focus of the hearing was the change in Condition of Approval #5 only. Comments on other aspects of the use permit will be considered at the next City Council hearing to review the second Performance Report for the Ritter Center. This will be a public hearing and is tentatively set for sometime in January 2014. The public comment period was opened and public testimony was heard. There were a variety of comments and questions about how many non -homeless vs. chronically homeless clients are served, capacity of the medical modular and use of the overflow management plan. Amy Likover specifically requested that the Resolution be revised to define the term "operational days," and the Zoning administrator agreed to add this definition. As stated in COA #5, "for the purposes of this condition, an "operational day" is defined as a day during which the Day Services Center or the medical modular building is open to clients for services" The Zoning Administrator stated for the record that there were no letters received by staff in response to the public notice mailed on August 30, 2013 to property owners and occupants within a 300' radius of the subject property. SRZA Minutes 9.18.13 ATTACHMENT 2-3 12 Ritter Street [Ritter Center] Re: UP13-030 Date: September 18, 2013 The Zoning Administrator closed the public hearing at 11:00 A.M. The Zoning Administrator has determined that the City Council directed use permit amendment to change the method of tallying the total number of clients served per day is a minor amendment to the approved Use Permit (UP11-070). As such, the amended use permit is in substantial conformance with the City of San Rafael's Municipal Code property development standards for the Second/Third Mixed Use East (2/3/MUE) Zoning District, all applicable policies of the San Rafael General Plan 2020, and the review criteria for Use Permits. The Zoning Administrator stated that a copy of the meeting minutes, which incorporate the findings and the conditions of approval, would be mailed to the applicant and the property owner and would be available to the public for review at the Planning Division counter upon request. In addition, the Zoning Administrator stated that a project of this nature has an appeal period of five (5) working days upon the approval or denial of the project. RECOMMENDATION: Staff recommends that the Zoning Administrator approve this minor amendment to incorporate the City Council's interpretation of condition of approval #5, as determined during their review of the Ritter Center 6 month Performance Report on June 17, 2013. The amended Use Permit will also re- adopt the Findings as approved by the City Council in granting the original Use Permit UP11-070 in Resolution 13321, adopted on April 2, 2012. The Zoning Administrator hereby approves this Use Permit Amendment (UP13-030) to change Condition of Approval #5 (see Page 7), with original conditions in sty followed by revised condition in underline. All other conditions set forth in City Council Resolution 13321 shall remain in effect and are listed below. Any decision shall be final at 5:00 P.M. on Wednesday, September 25, 2013, pending no appeals filed with the City of San Rafael Planning Division by that date. FINDINGS: Use Permit Amendment (UP13-030) Findings 1) The Ritter Center use, including the proposed Use Permit amendment to relocate the 600 square foot medical clinic to a new 933 square foot modular on site and increase the client caseload limit for the Day Services Center (DSC) and the new medical modular to 65 clients/day, continues to be in accord with the General Plan, the objectives of the Zoning Ordinance, and the purposes of the Second/Third Mixed Use East (2/3 MUE) Downtown District in which the site is located. a. As discussed on Pages 4-5 of the February 14, 2012 Planning Commission staff report, the proposed project is consistent with General Plan Policies LU -9 (Intensity of Non - Residential Development), LU -14 (Land Use Compatibility), NH -4 (Property Maintenance), NH -17 (Competing Concerns), NH -51 (Existing Business Areas), and CD - 10a (Non -Residential Design Guidelines) in that: i) upon installation of the new medical modular, the proposed project site would have an FAR=0.87 which is below the SRZA Minutes 9.18.13 ATTACHMENT 2-4 12 Ritter Street [Ritter Center] Re: UP13-030 Date: September 18, 2013 maximum FAR allowed for the site (1.5 FAR); ii) the proposed use is an allowable use in the Second/Third Mixed Use Land Use Designation; iii) The proposed new modular would provide a better space for the medical clinic and reduce the number of clients having to wait outside; iv) the Ritter Center has been operating since 1981 and has worked with adjacent neighbors to address the challenges and concerns regarding the impact of Ritter clients on adjacent businesses while still providing needed services to the poor and homeless. The number of clients has increased steadily over the years and the proposed increase to 60 clients/day for the DSC and the new modular would be mitigated by better site organization and client management; and v) the proposed new modular has been designed with colors and materials to match the existing buildings on the site; and The proposed project is consistent the Zoning Ordinance in that medical clinics are conditionally permitted uses in the Second/Third Mixed Use East (2/3 MUE) Zoning District and the Ritter Center is currently operating under a previously approved Use Permit (UP04-005). The proposed Use Permit amendment would not introduce a new use, but simply relocate the existing approved medical clinic to a more appropriately designed medical modular space. The elimination of 5 existing parking spaces is allowed because parking up to 1.0 FAR is provided by parking garages and surface lots in the Downtown Parking Assessment District. 2) The proposed project, together with the conditions applicable thereto, would not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity, or to the general welfare of the City in that: a. The proposed project would relocate an existing use into a slightly larger space, but would not be an substantial "expansion" of medical space because unlike the existing modular, the new modular is designed with a waiting area; b. The proposed hours of operation for the clinic (Monday through Friday, 9 am — 5 pm) has not been increased and is less than the hours previously approved under Use Permit UP04-005, which allows Ritter Center to operate from 6:00 am to 8:00 pm seven days a week. The proposed hours coincide with typical hours for other business in the vicinity; c. The proposed increase in the number of clients for the DSC and new medical modular from the 40 clients/day limit per UP04-005, to 60 clients/day reflects current demand for services on the site. The increase in client numbers is not the result of installing a new modular on site, but has been an existing condition for several years. The addition of a new modular designed with a waiting area and better clinic facilities would help alleviate much of the client back-up on site. The medical clinic would be relocated from the DSC into the new modular, and the vacated medical space in the DSC is proposed to be used as offices for the Behavioral Health services staff. The Ritter Center is working with a space planner to help redesign office space on the site to maximize efficiency. The goal is to create a better space to manage clients throughout the day and reduce the number of Ritter clients on the surrounding City streets adjacent to the project site. The proposed new modular would improve client management on site and therefore reduce client overflow forced to wait outside for appointments; d. The revised method for calculating the daily client caseload by averaging the number of clients over the number of "operational days" rather than over a 7 -day week" will help SRZA Minutes 9.18.13 ATTACHMENT 2-5 12 Ritter Street [Ritter Center] Re: UP13-030 Date: September 18, 2013 maintain the number of clients to no more than 60 clients per day, better manage the number of clients on site and help reduce impact to the surrounding properties. e. The Ritter Center will continue the established daily litter removal/site clean-up operations (as required in UP11-070) to keep the streets near the project site clean; The Ritter Center will continue implement their security program on site during operating hours to maximize enforcement of Ritter Center client behavioral policies and ensure security on-site and in the project area. Ritter has also updated client management policies to refuse services to clients who violate appropriate behaviors agreements that impact neighboring businesses. The Ritter Center also has trained staff to manage any difficult clients and works cooperatively with the San Rafael Police Department to minimize impacts to adjacent properties; g. No impact to neighboring businesses is anticipated from the proposed elimination of 5 on-site parking spaces. The project site is in the Downtown Parking Assessment District, which provides parking for sites up to a 1.0 FAR. The Ritter Center has on- going off-site parking arrangements to lease space at the PG&E surface lot (on Lindaro Street between 2nd Street and 3rd Street). Ritter Center has secured 6 additional spaces in this lot to off -set the loss of the 5 on-site parking spaces proposed to be eliminated. In addition, Ritter Center has access to parking spaces at the Annex building at 815 Third Street; The City's Building/Fire Prevention Division has reviewed the project and developed conditions of approval that would ensure that the use would operate in a manner as described and comply with all life and safety code requirements. Additional review will be required upon submittal of a formal building permit application; and The project will not have a significant environmental impact, and is exempt from CEQA review per CEQA Guidelines Article 19 Categorical Exemptions, Section 15301 (Existing Facilities) and Section 15311 (Accessory Structures) which exempts minor interior and exterior alterations to existing structures, and the construction of minor structures accessory to existing commerical, industrial or institutional facilities. 3) That the proposed project, as conditioned, complies with each of the applicable provisions of the Zoning Ordinance, in that: a. The project conforms to the requirements of Chapter 5 (Land Use Regulation for the 2/3 MUE Zoning District) as a conditionally permitted use; b. The project is consistent with the requirements of Chapter 18 (Parking), because no on- site parking is required for sites up to 1.0 FAR located in the Downtown Parking Assessment District; and c. The project applicant submitted a Use Permit amendment application, requesting review of the proposed new 933 square foot medical modular and proposed increase in the client caseload limit for the DSC and new medical modular on site. We are encouraged at the direction our City is taking in dealing with homelessness in the longer term and we strongly support your efforts to continue to find better ways to help those in need while making our downtown a better place for families and our local business owners, Our challenge in the near term is how to reduce the impacts of the growing homeless population who are forced to live on the streets of our small City. Homelessness is a national crisis, but a quick look at 2015 census numbers tells us there is something different about San Rafael. Comparing San Rafael to Novato, a City with a similar population, shows us that San Rafael has 2.5 times the homeless population. Using the same 2015 census numbers you find that San Rafael has a homeless population per capita that is 20% higher than San Francisco and almost 30% higher than Berkeley. Our small City is clearly drawing people from elsewhere to use its services. In 2015 approximately 29% of the San Rafael homeless population, or 167 people, were from outside the County. Property crime, theft, assaults and robberies have risen concurrently with the growing homeless population in our small City while falling or remaining steady in other Cities. The result of this growing population downtown is a City where residents do not feel safe in their own community. Save San Rafael is submitting for your consideration 30 pages of comments from San Rafael families describing what life is like in our City today. I hope you will take a few moments to read through these comments to understand how scared, sad and frustrated our citizens are. While actions are being taken in the longer term to improve this situation, it is clear that the status quo is no longer acceptable and something must be done now to make this City once again a place for all of its citizens. While the Ritter Center is only part of the reason homeless are drawn to downtown San Rafael, it needs to also be a part of the solution. Until the Ritter Center can be relocated, reducing its use permit to its previous level is a sensible part of a larger set of actions required to improve life in our downtown area in the near term. The status quo must change now. On behalf of the San Rafael families and business owners who comprise Save San Rafael, I am submitting our petition with over 1200 signatures urging you to reduce the Ritter Center use permit to its prior level until the Center can be relocated away from downtown., Thank you I( I V'tA Ken Reich Save San Rafael than .®r Save San Rafael Recipient: "San Rafael City Council" Letter: Greetings, We the undersigned are submitting this petition for the hearings on the Ritter Center use permit Signatures Name Location Date Kenneth Reich , United States 2016-03-24 Kate Rice San Rafael, CA, United States 2016-03-29 Daniel Bacon San Rafael, CA, United States 2016-03-29 rob whey San Rafael, CA, United States 2016-03-29 Laurie Etheridge San Rafael, CA, United States 2016-03-29 Michael Perona San Rafael, CA, United States 2016-03-29 Carl Schick San Francisco, CA, United States 2016-03-30 Hannah Young San Anselmo, CA, United States 2016-03-30 Thad Sauvain San Rafael, CA, United States 2016-03-30 Beth Niles San Rafael, CA, United States 2016-03-30 Sunny Lee San Rafael, CA, United States 2016-03-30 Erick Valdovinos San Rafael, CA, United States 2016-03-30 Michele Holmes San Rafael, CA, United States 2016-03-30 Robert Boyce San Rafael, CA, United States 2016-03-30 Brian Napolitano San Rafael, CA, United States 2016-03-30 Gregory Arent San Rafael, CA, United States 2016-03-30 Carolyn Lenert San Rafael, CA, United States 2016-03-30 ray figone San Rafael, CA, United States 2016-03-30 Erendira Olivas San Rafael, CA, United States 2016-03-30 Susan Olsen Corte Madera, CA, United States 2016-03-30 Tony Franco San Rafael, CA, United States 2016-03-30 Arline Van Gessel San Rafael, CA, United States 2016-03-30 anne Wilson San Rafael, CA, United States 2016-03-30 Mark McGarvey San Rafael, CA, United States 2016-03-30 Leslie Allen San Rafael, CA, United States 2016-03-30 Ann Monette San Rafael, CA, United States 2016-03-30 Vanessa Nunez San Rafael, CA, United States 2016-03-30 Marsha Hallet San Anselmo, CA, United States 2016-03-30 Dulce MacLeod San Rafael, CA, United States 2016-03-30 Bonnie Balliet San Anselmo, CA, United States 2016-03-30 Name Location Date Susan Reed San Anselmo, CA, United States 2016-03-30 Scott Jones San Rafael, CA, United States 2016-03-30 Anne Sheldon San Rafael, CA, United States 2016-03-30 Tammy Nygard San Rafael, CA, United States 2016-03-30 Janet Dresser San Rafael, CA, United States 2016-03-30 Art Faibisch San Rafael, CA, United States 2016-03-30 karen cesarl San Rafael, CA, United States 2016-03-30 Lynn Morgenstern San Rafael, CA, United States 2016-03-30 Martha Delgado San Francisco, CA, United States 2016-03-30 Bridget Hook San Rafael, CA, United States 2016-03-30 Barbara Alexander San Rafael, CA, United States 2016-03-30 Jennifer Alpert San Rafael, CA, United States 2016-03-30 Jack G. I have both compassion for the homeless and the business owners. However, the chronic inebriates are making our downtown unsafe to visit. The Ritter Center keeps expanding their services beyond their capability to manage, The status quo must change. Hannah Young San Anselmo, CA 2016.03-30 1 think Ritter house should be relocated to a more appropriate location Thad Sauvain San Rafael, CA 2016.03-30 1 believe Ritter Is better located elsewhere and their client load should also be reduced until they show that they can handle more clients without causing problems in the area. Beth Niles San Rafael, CA 2016-03-30 1 believe we can do a better job than we are doing now for homeless people and reduce the negative impact on the downtown businesses that rely on locals to make their living but we have to work as a community. Michele Holmes San Rafael, CA 2016-03-30 _ The system is obviously flawed when our city becomes a "destination" city for free services. Ritter employees confessed to falsifying addresses to help serve . more people. How many businesses will have to close? How many assaults, robberies, shootings, drug deals do we have to tolerate? I used to walk i downtown but I'm sick of being harrassed. Enough is enough. As a San Rafael resident and home owner I feel the need to stick up for my rights loo. Please share and sign. Robert Boyce Grosse Pointe, MI 2016-03.30: My daughter goes to aftercare at Parkside, and used to take tennis lessons at Albert Park, She will no longer take tennis because she is afraid of the people that linger all around the courts. It has also served to make her fearful of going to Davidson Middle School, Tony Franco San Rafael, CA 2016.03.30 Born and raised in San Rafael, however, I will no longer go downtown due to the unpleasant experiences dealing with the homeless. Crime in San Rafael has skyrocketed over the years because the police have to spend their time dealing with bums Instead of patrolling our streets, The city is a messlfl anne Wilson San Rafael, CA 2016.03-30 1 don't feel safe in my neighborhood anymore and my kids are surrounded by alcohol and drugs andl think it's not a good environment to raise kids Ava Crystal Tallahasse, FL 2016.03-30 Crime and filth have gotten out of hand in SR. Ann Monelle San Rafael, CA 2016-03-30 Ritter House should be moved to a County location. Dulce MacLeod San Rafael, CA 2016-03-30 San Rafael deserves a break. Downtown can be a unpredictable place at times because the behavior of a number of Idle people. It can be volatile, I'm simply tired of it, Time for compassion for those who want a healthy downtown too. Susan Reed San Anselmo, CA 2016-03-30 The homeless population is overwhelming In San Rafael, We appreciate that others agree and together we need to find a better solution, Scott Jones San Rafael, CA 2016.03.30 Grew up In San Rafael and the darrels are out of control. Hard core hoodlum bums and addicts out of SR. Let Ross handle them. Tammy Nygard Mill Valley, CA 2016-03-30 1 do not enjoy living in san a dark due to the destruction and danger the homeless have brought with them. I want my city back and my kids deserve a better place than this. Can't walk to school, fear in our home It's places on them. Enough is enough. We are contemplating moving due to this nightmare created in less than 10 years. Art Falbfsch San Rafael, CA 2016-03.30: The city needs to deal with the homeless problem which has gotten out of hand. Nerve Location Date Comment Martha Delgado San Francisco, CA 2016-03.30 What Is happening now is irresponsible and unfair to both the people that Ritter serves as well as the law abiding and generous citizens and merchants that bear the brunt of the irresponsibly of Ritter with regard to the negative impact on the community. Ritter can continue to do its work, which no one disputes is valuable, I a facility that is better suited to its needs and one that doesn't destroy the community. Christopher Carey San Rafael, CA 2016-03-30 1 want San Rafael to thrive as a family community and I do believe the COUNTY and all of the cities need to help the homeless, not Just San Rafael. Myles Miller San Rafael, CA 2016-03-30 this problem Is out of control. Dionne Garcia San Rafael, CA 2016-03-30 1 am tired of the out of control negative Impact of the homeless influx over the last several years Elizabeth Rigali San Rafael, CA 2016.03.30 The quality of my life is greatly reduced by the Influx of badly behaving people. Leigha Davis San Rafael, CA 2016-03-30 Because 3 of the homeless people hanging out at Ridder killed a man in Fairfax that was walking his dog, they also stole his car (that Is how the police tracked them down). As well as a young woman In the SF Park. Richard Holmes San Rafael, CA 2016-03-30 1 believe there are better solutions than having the Ritter in downtown locations and do not feel it is safe for my wife and child In downtown San Rafael anymore Trevor Buck San Rafael, CA Jacqueline Tackaberry San Rafael, CA 2016.03.30 2016.03.30 Jill Symons San Rafael, CA 2016.03.30 I grew up in San Rafael, used to shop at Macy's and went to Davidson MS and spent afternoons walking up and down 4th Street. I would not want my middle sholl kids to do the same in todays environment, San Rafael can be great again. live 3-4 blocks from Ritter and drug dealing & homeless are over my back yard fence every night I Often SCARY & NOISY 111 have them leaving empty liquor bottles in my planter boxes and sitting in them as If I am an annex 7 1 gave up growing a Plant In one as they simply kill It ? It is a continual disturbance and I too have cleaned up human feces . I live here in San Rafael and no longer feet safe In my own town Jennifer Beales San Rafael, CA 2016-03-30 1 and my family have been personally affected by the growing number of homeless in San Rafael. Crime has risen. Locals no longer patronize business in our downtown. Our local Safeway Is no longer safe with dally shoplifting and shootings in their parking lot. We want our city backl Carrie Marmesh San Rafael, CA 2016-03-30 1 agree with all points. Liz Kalloch San Rafael, CA 2016-03-30 I'm a homeowner who lives In the West End Village In downtown San Rafael, and we have been dealing with the homeless situation for a few years now. It's gotten much worse on our end of town In the last year and a hail, and I'm not sure what the best solution Is, but it's feeling less and less sale and more and more worrisome. I think Ritter House is an important resource for homeless people, especially for mothers and children, and It's necessary [hal someone Is there to help, but clearly the free services draw other folks too. We've probably called the police more In the last 2 years than I ever have In my whole life, and If we're doing it I'm sure lot of other residents are loo, and that system can't be sustained either, So, clearly, I don't have any answers, but if things keep escalating the way they have been, kind of exponentially, It's going to get even less pretty. So, how to balance care and services for the homeless population AND the safety and well-being of the residents of San Rafael, that's the question I want to be asking, and hopefully we can answer It. Name Location Date Comment — - - Castellucci Lucianna San Rafael, CA 2016-03-30 I'm signing because I'm directly effected by the vile vagrancy on a daily basis. I have documented hundreds of photos and I'm not complacent to the idea that this is going to be a "way of life" for my children. I graduated from Terra Linda High In 1994, This Is not how San Rafael was then and it isn't acceptable now. We have let our community go and it's time to take action to get It back. We are friendly, but not to be run over by bleeding hearts that want to help homeless but aren't willing to have them live on their front doorsteps. Neither am 1. Brigid Richards San Rafael, CA 2016-03-30 Some people aren't going to 4th Street anymore because of the pan handlers and crazies. This Impacts merchants, restaurants, and potential potential new business. Rowley Adrianne San Rafael, CA 2016-03.30 I'm signing because I'm removing uncapped needles and human waste, bottles of alcohol and demanding masturbating overnight homeless campers to leave our business parking lot before we can open for business. When they pack up, they find their across the street into the gates of the Ritter Center to receive their daily services - whatever that may be. It's too much - and too frequent. When is enough really enough? The food given to clients at Ritter is frequently littered into the street, many homeless don't carry can openers. Daniel Bacon San Rafael, CA 2016-03-30 1 support moving Ritter to a better location, both for those of us who live and work in San Rafael and for those who need Ritter's services. Daniel Bacon San Rafael, CA 2016-03-30 Ritter Center should be moved to a better location, both for the people who live, work, and own businesses In San Rafael and for the people who receive services from Ritter. Daniel Bacon San Rafael, CA 2016-03-30 Ritter Center should be moved to a better location, both for the people who live, work, and own businesses in San Rafael and for the people who receive services from Ritter. CHAMPION ASHLEY San Rafael, CA 2016-03.30 I'm signing because we have to protect our businesses and defend the customer base we've worked so hard to build. If we lose customers and tourists - we lose culture and community. And then one day we will all look back and wonder what happened to the days when we could walk down 4th Street before it looked like the Tenderloin. Todd Judd San Rafael, CA 2016.03-30 San Rafael is overwhelmed Carole Kammen San Rafael, CA 2016-03-30 San Rafael is no longer a place I go to eat, shop, or walk, caldwell antony San Rafael, CA 2016.03-30 I'm singing because my wife, Lucianna Castellucci, of Best Collateral on Third & Ritter St, is put in physical danger every day in the environment Ritter Center creates and provides. We have 4 children and she is an asset to our business, our family, our schools and our community. Ritter Center's clients have physically assaulted her, damaged her vehicles, followed her, thrown items at her, yelled obscenities at her, made verbal death threats to her and most of these incidents have been reported to the SRPD In which they responded promptly. This is unacceptable behavior for you and I, but for a homeless individual, as they are jailed at the cost of the County and expensive to arrest, are overlooked on many occasions and cited with a warning to continue on the Poor behavior. How can I protect my family, my wonderful wife, when the City of San Rafael can't protect isn't citizens of this community? Ritter Center has it's own on-site Security Service for a reason, a good reason... to protect themselves from their own clients they serve. Who is protecting the citizens from the same clients they serve? Who is protecting my wife and her staff from the people they serve? The person that threated to slit my wife's throat is the very same lovely person Ritter Center provides security against. I urge Mayor Phillips to swiftly move Ritter Center and keep our mothers, children, sisters - CITIZENS - safe. Name Location Date Comment Andrew Smilh San Rafael, CA 2016-03-30 Homelessness is a growing issue that shouldn't be Ignored, or addressed with anylhing other than long-term, well -considered policy. Donald Stenson San Rafael, Ca, CA 2016.03-30 Homelessness is a major problem in San Rafael. This includes Saint Vincent de Paul and the problems along B Street, Abby Pledger San Rafael, CA 2016-03.30 1 care about our downtown. I want to support local smell businesses and I want to bring my kids there. There are other ways we can support our homeless population and in other places. They don't belong In our wonderful downtown. There Is so much opportunity to do things differently with both compasslon and CIVIC smarts. Bonnie Marmesh Mill Valley, CA 2016-03.30 1 agree with all points made. Michael Lane San Rafael, CA 2016.03-30 San Rafael Crime Statistics (comparing 2009 to 2015),,,, there Is a correlation with the huge Increases in crime and the huge Increases In the # of homeless in San Rafael: Thefts and Property Crimes 314(2009) , 557(2015) Assaults and Robberies 134(2009) , 199(2015) Mental Health 398(2009), 790(2015) Drugs and Alcohol 356(2009), 548(2015) Disorderly Conduct 1156(2009), 2390(2015) Total 2358(2009), 4484(2015) This effects our neighborhood properly values, our downtown business viability and safety of citizens. Jeff Mulanax San Rafael, CA 2016-03.30 -Jeff Mulanax Anne Pearson San Rafael, CA 2016-03.30 1 want to see all Ritter House out of San Rafael, not downtown, not In the canal, not at Marin Center. San Rafael does not have a Department of Social Services. That is a county function and if the county supervisors wish to take Riper House on County land so be it if they deem It necessary. Taxpayers of San Rafael should not be expected to carry the burden for the entire county. Kevin Seeley San rafael, CA 2016.03.30 This is needed] Jeanne Chatham San Rafael, CA 201603.30 1 am signing because I am a San Rafael resident and experienced the negative Impact Ritter Center has had on our downtown area and neighborhoods. It has become a serious problem. Steve Locke San Rafael, CA 2016.03-30 Something needs to change. Downtown San Rafael and the immediate neighborhoods are being affected. There has to be an alternative location that will provide services but lake pressure off of residents that just want to walk to the park with their kids without seeing homeless walling for their St Vincent's meal or drug dealers peddling their wares. Steve Reed San Rafael, CA 2016-03-30 I've cleaned up a homeless camp near Colman Elementary Shool, Robert Berry San Rafael, CA 2016.03.30 Ritter Street attracts homeless to Downtown San Rafael- they should be required to relocate before our downtown becomes undesirable Alex MacSwain San Rafael, CA 2016-03.30 1 try to avoid downtown due to these issues, Robert Kelly San Rafael, CA 2016-03.30 1 love San Rafael, however I am in complete dismay about the vagrants in downtown. t don't even want to be down there with my young daughters. All sitting area's have beggers smoking cigarette's, with dogs, drug issues etc. Its time to clean it up so I don't need to go to Mill Valley to lake a walk with my family and spend my dollars. Sarah Wheeler San Rafael, CA 2016.03.30 San Rafael should not be the only city In Marin County that offers services to the homeless. Name Location Date Comment Stephanie Summer San Rafael, CA 2016.03.30 A mentally -disturbed homeless man followed my 11 -year-old daughter while she was downtown and kept trying to find out "what kind of music she was listening to." Needless to say, she was scared. pamela samaniego San Rafael, CA 2016-03-30 1 am concerned about the safety of public places (Albert Park) for my children. a Perry San Rafael, CA 2016-03-30 Save San RafaeH John Schaefer Larkspur, CA 2016-03.30 1 office downtown at 781 Lincoln for 15 yrs and have seen the problem get worse year after year. Buz Johanson San Rafael, CA 2016-03-30 As many have said --- this has to change to save our city ...... ; Claire Sheen San Rafael, CA 2016-03-30 Pleasel Let's tackle this growing issue before it escalates further. Andrea Young Folsom, CA 2016.03-30 San Rafael needs to maintain the allure it has always had. The increase presence of the homeless makes it less welcoming and sometimes intimidating Sara Wolfe San Francisco, CA 2016.03.30 My family and f have been directly impacted negatively due to the rise in criminal activity from the homeless. Our house was broken Into and all my jewelry stolen from a man who was later identified as homeless. Our can has also been broken Into twice, Rall Reed San Rafael, CA 2016.03-30 . 1 want our town back. This Is not what I signed up buying our home 10 years ago. I am sure there a another place the people in need can find help within the county. Kim Adams San Rafael, CA 2016-03-30 1 want to feel safe in my neighborhood and I want to know my daughter is not going to be in danger when she goes to school. I thought we would have that by moving to Marin, but I don't feel that way now. I understand this is a deep and complex problem, but we should be sharing the load with other communities.. Travis Troen San Rafael, CA 2016.03-30 Finding used hypodermic needles on the open streets of San Rafael and in piles of garbage left by the homeless is a common occurance. This is unacceptable. I believe that the vast majority of this extremely dangerous waste is directly caused by the homeless population here in San Rafael. Time for some changes. Way Yu San Rafael, CA 2016.03-31 : I'm signing because i've lived in San Rafael for 11 years now and am raising a family here, but the downtown area has definitely gotten seedier in the past 2-3 years, to the point that I don't like to go there at night. It's a shame, because it hurts the great small businesses in the area but I won't compromise my safety or my children's safety to be down there at night. Linda Markwick San Rafael, CA 2016.03.31 The homeless situation has gotten out -of -hand. It is often scary to even walk in downtown San Rafael. Walter Wolk San Rafael, CA 2016-03-31 My 11 year old son has witnessed a drug deal on Lincoln near Ritter and this morning he was scared by a group of 4 homeless that were aggressively asking for money for food on the snake path to Davidson. I'm tired of my kid witnessing the crime that comes with the current homeless population and I want him to feel safe in his home town. Annie Filby San Rafael, CA 2016-03.31 The business people and residents of San Rafael are saying 'enough is enough' and are afraid of going downtown or into our parks. Ritter is overwhelmed and needs a bigger space to operate in, well away from any business or residence. What we have now is not working and has turned San Rafael into a mini -Tenderloin. Name Location Date Comment Jim Lynch San Rafael, CA 2016-03-31 For the safety of children walking to Davidson Middle School and for the economic vitality of our city, I am signing this petition. Ritter Center needs to move - the number of unsheltered homeless that are drawn to and linger around Ritter Center continues to grow and based on local, state and national indicators, the numbers will continue to grow unless we change the dynamic in our town and in the county. Signing this does not mean any of us are un -caring or cruel. On the contrary, we care deeply about our community. I hope that following the move, Ritter continues to help those in need from a location that it does not negatively impact at the same time. William Gletz San Rafael, CA 2016-03-31 The time is long overdue to address the "homeless" in San Rafael. Laura Collins San Rafael, CA 2016-03-31 I'm signing it because I avoid certain areas and businesses and because I want my grandchildren to be able to go to Davidson without fear. Jennifer Hinman San Rafael, CA 2016-03-31 I'm uncomfortable being downtown in my own home town. I often feel unsafe, and almost always feel ill at east. My young daughter has been frightened on more than one occasion by aggressive activities of people on the street, and those with addictions and/or mental Illness who have entered stores and restaurants where we've been. The managers of these establishments, often very young themselves, are put in the awkward position of having to ask the troubled people to leave. We rarely shop or eat downtown anymore, which I regret because we do believe In shopping local and want to be part of making downtown San Rafael the vibrant community it used to be. I'm keen to team more about alternatives that can support those in need while protecting those of us who want to enjoy our town. Bonnie McBride San Rafael, CA 2016.03-31 We stopped going downtown because it was scaring my 8 year old. Evan Reich San Rafael, CA 2016-03-31 1 love san rafael Pamela Parkes San Rafael, CA 2016-03-31 1 am signing this because San Rafael is assuming a disproportionate burden for serving the homeless population of Marin. A county -wide strategy is needed, with multiple service locations, so so that San Rafael does not continue to be a magnet for those within the homeless population who commit crimes, soil our sidewalks, and harass residents who are simply trying to enjoy their community. Bridget Radachy San Rafael, CA 2016.03-31 1 care about the environment my children grow up in. i value diversity but not danger. Lori Sommer San Rafael, CA 2016-03-31 Even though we are the tax payers it doesn't feel good to go downtown for dinner or just to do a walk and be in our town anymore. It's gone over the top with so many uncared for, poor souls. It needs to be cleaned up so we can all enjoy our town. Too many businesses and restaurants are leaving. It's time for other communities to share the burden. Chris Untermann San Rafael, CA 2016-03.31 So tired of this problem. It's ruining a great town Name Location Date Comment Melanie Matheson San Rafael, CA 2016.03-31 I'm the manager of an apartment building on Lincoln Ave (a few blocks north of the downtown). We have had to put a locking door on our laundry room to keep homeless people out, one evening I had to run a guy off the property after he decided to walk up our driveway and urinate—most recently a guy walked onto our property and up to our open back yard area. We have children who play In the back yard, freely -or should be the case, yet now we have to watch more closely for fear that someone might wander onto the property. We are also in the midst of installing gates up which takes away from the openness we have always enjoyed—all for safety because of transient people making their space where ever they decide. To add to this, I work in Fairfax, driving though the north end of San Rafael, through San Anselmo, and on to Fairfax ... It feels in many ways like San Rafael use to .... kids being free to move about. My child is of an age that she should be able to be allowed more freedom, yet I don't feel comfortable allowing her to venture out ... even walking over the freeway over pass to her school we encounter people sleeping on the path. A change is desperately needed. I'm not without heart for people who struggle, yet services need to be removed from our downtown. It's just to congested as It is. Christine Miller Novato, CA 2016-03-31 Because I am sick of the mess they leave in front of business and the harassment to our employees. They pee in public steal and break into business. They have more rights then us the business owners and tax payers. Kathleen Liparini San Rafael, CA 2016-03-31 Please remove these facilities to another place out of the downtown area. The county of Marin needs to take this agenda and expense not just San Rafael. Zachary Krefting San Rafael, CA 2016-03.31 1 no longer feel that Ritter can determine the difference between families in need, chronic Inebriates, and the dangerously menially III. Jeanie Lucq San Rafael, CA 2016.03.31 1 agree with the content of this petition Leigha Jahansooz San Rafael, CA 2016-03.31 _ This Issue desperately needs to be addressed. i don't feel comfortable walking around by myself, Paul Lucq San Rafael, CA 2016-03.31 I'm signing because, it has become increasingly unsafe in downtown San Rafael due to the increased homeless on our streets. There Is a larger criminal element to this influx. Name Location Date Comment Laura Austin San Rafael, CA 2016.03-31 This is a complex Issue that San Rafael has unfairly shouldered for too long. The proximity of this faciiity and the troubled, unpredictable nature of some of Its clients Is too close to Davidson Middle School and downtown, While I support its services to the working poor and those truly homeless looking to improve their lives and gel off the street, it has become a magnet for another element that is unhealthy and unsafe for our community. Susan Ghest-Kehoe San Rafael, CA 2016-03-31 The City of San Rafael carries the burden of caring for the homeless for the entire County. San Rafael is not full of uncaring, uncompassionate citizens; however the Ritter House location being In the downtown business district is not working. They are overwhelmed by the homeless epidemic that is also happening in many cities around California and the country. The amount of homeless drug addicted or drug induced people roaming downtown and adjacent to our schools and in the parks is something that deters people from coming to San Rafael and residents from going downtown to shop, dine, or just take a walk. It does riot feel safe or clean. The homeless do need to have services; however downtown is not the place for rehabilitation. Ritter needs to move. Toni Ignoffo San Rafael, CA 2016-03-31 I'm signing because I want to see our downtown thrive again Dan Connor San Rafael, CA 2016-03-31 1 actually moved out of downtown after many years of watching my community deteriorate before my eyes while all of the local authorities simply scratched their heads or shrugged in the interest of being "PC" or protecting their own Interests. It is time for a change, and anyone with a lick of sense can see that. Cynthia Collison San Rafael, CA 2016-03-31 I'm concerned about the direction San Rafael has been going over the past several years. I'm concerned for the business owners and the properly owners and our safety. Al the same time, I'm concerned about individuals that are challenged while at the same time, I don't understand why San Rafael has to take the brunt of all the services extended to the homeless and the mentally challenged. I feel they should be distributed more evenly throughout Marin County. Jan Johanson San Rafael, CA 2016-03-31 1 feel it's time to focus and take action on the situation which has become Intolerable and which is negatively affecting more people than it Is helping. Matt Parlit San Rafael, CA 2016-03-31 If you want more of something, subsidize it. That is what San Rafael has done to itself. Against the will of its citizens, community power -brokers and those in government have spent time and effort to make my home town a soft, comfortable place for bums. They are Importing and paying a class of antisocial, insane, and criminal ... because we didn't have them before. Stop spending my money to ruin my town, Where will the bums go? Not our worry. They came from somewhere. They'll go to the next town that hires them to ruin their parks and crap in doorways. As custodians of a nice little town, the Council's Job Is to take care of the town -- not to lure maniacs here from Portland, Santa Cruz, etc. just so they can take a bow about how "compassionate" they are. Do your jobl Allison Skinner San Rafael, CA 2016.03-31 1 am a long time resident of SR and have seen this issue negative Impact our city. While there are many things that have Improved the homeless situation has gotten worse. As a mother of 2 boys In the public school system, Davidson at the moment, this issue has personally effected them... alternative bike routes to school and restricted, unsafe 'off limits' areas are just two. We need to look at alternatives .... Mario Gonzalez San Rafael, CA 2016.03-31 1 agree that It should not be in the down town area. I drive by there and see a lot of Vanslent people defacing the area with trash, loitering and disrupting normal traffic. Our city Is deteriorating and I am considering moving away due to the homeless epidemic here. 2016-03-31 1 am a San Rafael resident who travels to Novato or San Anselmo to shop because the streets of San Rafael are seemingly filled with homeless asking for - hand-outs. It makes walking down the streets uncomfortable, so I go elsewhere. 2016-03-31 1 live In the Gerslle Park neighborhood of San Rafael. I am at the point where 1 don't feel comfortable going to Gerstle Park with my kids due to high homeless activity, and my bicycles have been stolen from my house. I also no longer feel comfortable shopping downtown in my own city. Please remedy this situation, this situation is no longer acceptable. 2016-03-31 1 agree with Ann Pearson, the county should help with this effort! 2016-03-31 1 want San Rafael to be a safer place for our residents and for others to enjoy our unique community, 2016.03.31 I'm tired of this problem. In the last month, on walks with my children (4 and 2) they were approached by someone screaming directly at them and another time when a man tried to reach out and pet one of them. So sick of !1. 2016-03-31 1 have immediate family therel This is an endangerment problem more so than a homeless problem! 2016.03-31 It isn't safe for women children anymore, why does the Riter house have its own security? To protect themselves from there clients. Who protects us, It's a burden on PD. 2016.03-31 For the children of San Rafael 2016-03-31 1 love San Rafael[[ Lets make it better and safer for our kids sake. 2016-03-31 The current situation is degrading the community, especially downtown. Let's try an alternative approach. 2016.03.31 As a resident and business owner in San Rafael, the street people of San I Rafael and the corresponding crime, litter cost, etc. are the primary problem facing our community. Many of the people in favor of Ritter don't even live in San Rafael and don't suffer the constant abuse. Furthermore, they would never allow Ritter in their neighborhood, but would not hesitate to call me a NIMBY for my feelings. Look at the damage that street people have done to the economies and communities around the upper Haight in SF and University Ave in Berkeley. San Rafael is forced to bare an unfair burden because the US has no national mental health/addiction policy and other cities and communities have chosen to send their street people here. They cost the city in police, medical, and municipal resources that we can't afford to spend. They pose a severe fire risk. They leave litter everywhere, a gaping wound that the Downtown Street Team is only a band aid for. Public Urination and defecation are bad for business. Drug dealers supply the addicts and will defend there turf with violence. Please excuse the free association here, but the list is too long. Ritter is a bad neighbor with a hidden agenda. Dianne Linn, former head of Ritter, once said to me personally, that she "won't stop until anyone who wants to come to Marin will be given a home". That's scary... 2016-03-31 1 see way too much homelessness around our children's preschool and the downtown area. It is appalling, Name Location Date Comment Rita Becker San Rafael, CA 2016-03-31 I'd like to feel safe again in the city In which I've lived for the past 25 years. Bill Werstler San Rafael, CA 2016-03-31 As a twenty year resident of San Rafael I have seen, in an alarmingly short period of time, a huge influx of transient Individuals who pose both safety and social threats to our community. Police presence Is on the rise as a direct result of the ever increasing number of homeless. The feeling of a small town community is being threatened everyday. Madeline Barnett San Rafael, CA 2016-03-31 1 live right In the thick of it, and would love to be able to feel safe walking down , street. Being able to enjoy Albert Park would be a bonus. Margery Noss San Rafael, CA 2016.03-31 1 care about my city and I'm tired of stepping over homeless, watching them pee and dedicate all over our streets. I'm afraid to go downtown therefore I don't. Dan Hanlon Novato, CA 2016.03-31 The City Council needs the support of the community in making the decision of how to control the Issues related to the homeless In the downtown area, Chris Johnson San Rafael, CA 2016.03.31 The situation is clearly out of hand and Is ruining the reputation of the city not to mention presenting a well documented safely risk. It makes no sense that homeless people are dictating the policy of the city and it's tax paying residents. Laurens Schlosser San Rafael, CA 2016-03-31 I'm tired of seeing my town trashed & our kids being afraid to walk to school or downtown. Servicing the poor & elderly is one thing..... I'm all for something in place for these folks. But, as l see it - Ritter House is just a band aid to folks with drug/alcohol addictions and mental illness - they are just not equipped to service an issue of this scale. It's totally out of hand and will not improve any time soon. The company I work for used to be located on Fifth Ave & B Street - I can't count how many times there were messes left by the homeless that were so disgusting it would make you feel sick; how many times I had to call the police to remove people that were sleeping in our doorway, on our picnic table, who would urinate, in the middle of the day, in our front doorway vestibule. Enough already. Let's focus on the poor families and the elderly in our community. I'm sorry the 'others' have their mental and drug issues -- 1 really really am. Other cities in Marin should provide assistance for these people though -- not just San Rafael. Amy Anderson San Rafael, CA 2016-03-31 1 have been a business owner in Downtown San Rafael for nearly 19 and have watched the homeless problem become worse each year. Many of my customers are literally scared to come to San Rafael because of the homeless and transients that walk the streets. Name Location Date Comment eugenia Franco san rafael, CA 2016.03-31 1 was born and raised in San Rafael. I care about raising my 3 kids in a clean, drug free and safe community so I chose to pay more taxes and purchased my home on the San Rafael hill In the year 2002.Sadly Boyd park which was my park of choice growing up became over taken by homeless people where I didn't want to bring my kids too because I was discovering dirty hyper dermic drug needles scattered around the park. With our efforts this parkgotcleaned up and It's become a safer place but not for our downtown area where farmers market likes to attract Marin families. I have noticed human feces in the down town streets even in front of boutiques -and more homeless people begging families walking by for money. Many of these homeless people are not even from Marin, non the less San RafaelllThey travel from outside Marin and even out of state purposely landing in San Rafael as they are hearing out in the street irom other homeless people that San Rafael is the place to be. This is not fair to San Rafael natives that pay a lot of money to live in a place that we once felt more safe and sanitation was not an issue as it is now and getting worse. I'm a healthcare provider at the San Francisco veterans hospital for 15 years and I believe in helping the under deserved however this dramatic influx of homeless people invading our San Rafael community is now compromising our once clean and safer family community. Valerie mandin-kelly San Rafael, CA 2016-03-31 1 am signing this petition because the homeless situation in Rafael is overwhelming 1 We need to find a better place for them outside of San Rafael where there are shops, restaurants.,. Help people who are trying to make a living for their families. So many big buildings are empty outside of San Rafael going to novato, why not using one and creating a center that would help them, food and shelter ... ?I Malinda Wheeler San rafael, CA 2016-03-31 Because my family and I no longer feel safe in our own hometown. Kara King San Rafael, CA 2016-03-31 Safety Chris Stewart San Rafael, CA 2016-03-31 1 want my children to be safe and feel comfortable walking or biking to school and in their neighborhood. An alternate location for both the Ritter Center and the food kitchen is necessary to clean up our downtown Tony Markwick San Rafael, CA 2016-03.31 irrefutably homelessness is a regional issue. As such all services, including the St Anthony dining hall, should be re-located to the Marin Civic Center. Seems to be plenty of space there. Jana Mannina San Rafael, CA 2016-03-31 1 want to feel safe to go downtown alone and with our children. I don't want my children exposed to the vulgarity and explicit commentary that comes our way. I want to support our local community, business owners, and families, but given the current circumstances, we literally go downtown twice per year. Thanks. mike brinck San Rafael, CA 2016-03-31 1 agree with the petition.... Ken Goudey San Rafael, CA 2016.03-31 We must find a way to provide support and services for our neighbors who come upon hard times, but we cannot continue to be a destination town for an endless parade of itinerant transients seeking a soft community and hand-outs. Ritter Is only part of the problem, but we now (unfortunately) need to provide significant back pressure to right this serious imbalance. Restricting services at Ritter House (and St. Vincent's) would be a small step. Moving them outside the downtown area, particularly to a more "rural" destination, would allow these services to continue to provide assistance without the major negative impacts they are currently having on San Rafael, Have we already forgotten the debacle at Boyd Park? Albert park is now just as bad, and the hills behind Gerstle Park house a number of vagrants who defile the open space with apathy, We all want to help people in need, but nobody wants their community, businesses, and schools to slump under the weight of that compassion. San Rafael is dangerously out -of -balance and something considerable needs to be done now. Pat Taylor San Rafael, CA 2016.03.31 San Rafael should not be expected to carry the burden for the entire county. San Rafael, CA 2016-04.01 1 am signing because my family who used to love to take, especially evening walks, shop and eat downtown rarely do now due to feeling uncomfortable due to the homeless population, especially with many having dogs, sometimes even off lease, that may not be registered, vaccinated, etc. I fully support providing aid to the homeless but this should not be just San Rafael's Issue, and the help services should not be downtown and near schools. I do NOT believe all homeless are drug users and criminals. But there have been increased crime and drug issues since the large influx which Is of concern. An Rafael, CA 2016.04.01 We no longer eat at restaurants or visit downtown San Rafael stores due to the number of homeless hanging out, sleeping along roads or pan handling. San Rafael, CA 2016.04.01 1 do agree that San Rafael seems to have become the only magnet city in marin for people facing homelessness. Can find away to do this better, without forcing the residents of San Rafael to barricade themselves into their houses and their cars? San Francisco, CA 2016.04.01 Because I just bought a home in San Rafael and avoid downtown like the plague. I don't have anything against the homeless in general. I do have a problem with giving professional transient, drug user/dealers/ thieves an address to collect County services that could go to more deserving residents down on their luck. There is an element of violence and drug use with a portion of the homeless that taints the others with a bad name. We should help people but just not ONLY in San Rafael, each City In our County should have their own "Ritter House" and "St. Vincents". It Is not fair or right to force one City in our County to take care of all the Citys homeless and deal with the consequences of this. Please save our Beautiful, wonderful San Rafael. I remember being able to go downlown and the candy stores, the book shops, the diners and the familiar faces. Daniel Nemits San Rafael, CA 2016-04-02 I'm signing, but I fear there will be stiff resistance from all other towns in the county to help San Rafael. The attitude in Mill Valley and Larkspur is that San Rafael is a bunch of whiners who are 'heartless'. In the end this effort may require a San Rafael-based grass-roots effort to campaign in *other* towns for new County Supervisor candidates. Otherwise every county vote will remain 4 to 1, 'against` the Ione San Rafael Supervisor and 'for' continuing to enable the chemically-dependent, as long as its all kept in San Rafael, This is the reality. Daniel Nemits San Rafael, CA 2016-04-02 For the record: Frank Egger, second district candidate has been the only one who mentioned anything about homelessness with this statement. He said, "The County needs to accept the responsibility for addressing homelessness and programs for homeless people and not make San Rafael go it alone. San Rafael neighborhoods and businesses need help." Egger also publicly supported Laura's Law at the same meeting. Interested parties should be figuring out ways to lean on the county, because only with City *and* County backing wilt any movement be seen. Name Location Date Comment David Lammel San Rafael, CA 2016-04-02 My dog-walking route used to take me up to the picnic area and tennis courts in Gerstle Park. I no longer feel safe doing that. I also used to jog along downtown 4th St. I had to give that up too. This situation is horrendous for downtown businesses and neighborhoods, and can't continue. Ritter and St. Vincent are terrifically charitable to those in need, but their whole purpose may collapse because they are unable or unwilling to figure out how to be good neighbors In a city that has long supported their admirable efforts. Meanwhile, every few hours, there is another police call and more vitality sapped out of our downtown and nearby neighborhoods. This is a very tough issue for city leaders, but since Ritter - St. Vincent can't or won't act decisively and quickly, the city must do whatever is legal, and humane, to repair the mess we currently have. The problems Part of the Ritter Center's mission statement is "TO END HOMELESSNESS IN MARIN COUNTY" but there is too much evidence that the homeless population is increasing because of, the Ritter Center. It has helped the city to gain a reputation as a mecca for homeless people, San Rafael has less than a quarter of the county's population and almost half of the homeless population, according to the 2013 census. It's unfair for one city to bear the burden for a countywide problem. It wasn't until a month ago that my friend and I decided to take a night stroll downtown that I realized there were homeless and druggies "sleeping" outside of almost EVERY store We were surprised and scared when one of them a woman in a sleeping bag started yelling at us out of the blue. I used to rent movies from walgreens and I can't go without people outside just harassing you jus like at the Shell at the Central San Rafael exit. All public places have been usurped by "homeless" and "helpless" people (most of whom have never Dan Coleman San Rafael, CA lived in Marin before). I don't think that the original objective in creating the parks and other public spaces in San Rafael (such as Albert Park and Gerstle Park, the Community Center, the Transit Center, and many more) was to turn Patty Gessner San Rafael, CA them Into a defacto homeless shelter when people who have a lot of money and live on hills far from these spaces decide to selfishly "help". I was driving down 3rd Street at 10:00pm and there was a homeless man dressed in all black staggering down the middle lane of the street. It was so dark I did not see him until the last minute and had to swerve quickly barely missing him. I was fortunate that there was not a car next to me and that I did not hit him. On another occasion while heading down second street a homeless man came running and screaming into the middle of the street from between 2 parked cars and I was forced to swerve into the other lane to avoid hitting him. John Greene San Rafael, CA 2016-04-04 Too many criminals and bums. Also, too much hypocrisy, Anybody who's not willing to take just one of these miscreants into their own home and provide them with food, clothing, & shelter, and/or give them employment In their business (in other words, practice what they preach) is a hypocrite. Hypocrites don't have moral standing to impose these reprobates on the rest of us and reproach us for not wanting to tolerate them. I live next to open space, and these are the same destructive jackasses who camp out and set fires that threaten property, safety, and lives. Spare your compassion for those who truly merit it. Ch, and if you think things are bad now, just wait until the homeless bum express--oops, I mean the dumb train--oops, I mean the smart train gets up and running. People are sleeping day and night in the parking lot of the former Klein TV next to Ritter. The property was sold about 6 months ago. The new owner chooses not to have an agreement with the police for enforcement of trespassing. The site is not an emergency shelter, nor is it a housing site for homeless. Nobody even cleans up trash left behind by the sleepers. The security people at Ritter do nothing. As a community, what should happen. The only solution I can think of is a Code Enforcement complaint. Do you have any other suggestions? Thanks, Hugo Caron Parker From: Kenneth Reich <kenneth.reich@gmail,com> Sent: Tuesday, April 19, 2016 5:24 PM To: Caron Parker Cc: Andrew Hening; Kate Colin Subject: Re: website inquiry Hello Caron - I chatted with Kate Colin today about the upcoming hearings on Ritter Center. I had a few questions she suggested you may be able to assist with. My point of view is that San Rafael, while working on its longer term strategy, needs to make some short term tactical changes to begin to change our reputation as a destination for the homeless and to thereby begin to reduce the inflow of homeless from outside of our County. I am curious if, in the context of the Ritter Center use permit, we have considered adding eligibility requirements as a condition of maintaining the use permit. This would entail criteria to establish whether a person has in the past been a resident of Marin in some capacity and therefore eligible to receive services. There may be variations of this idea that would allow Ritter to continue to operate, while changing the reputation of San Rafael as being a destination for the homeless from outside of our County. We must change the status quo on May 16th and should explore all possible ideas. Perhaps this has been already considered and there is a legal reason why it cannot be implemented, Do you have time to chat in the next week or so, either by phone or in person? Much preferred to email ;-) Thanks. We have only been in our new home for 2 months but my concern for the safety of myself and my children has grown to such a level that it warrants an email. In the short time I've lived here, I have experienced numerous incidents but the most frightening was several nights ago when someone was banging on my door at 3:4Sam. My trash often gets rummaged through with a mess of old food for me to pick up the next day. I was nearly accosted going into Safeway by a crazy man flailing his arms at me and screaming absolute obscenities. I will not shop there again. While walking down 4th St. (near Starbucks) on a Sunday afternoon with a friend, a guy ran- full speed- at us only to dodge us at the last second. I knew San Rafael had a homeless situation but living just 3 miles down the road in San Anselmo, I really had no idea of it's depth and impact on the citizens. I really like my neighbors but am a bit remiss that I have chosen this area to live, particularly because I have three kids. I have always been involved with helping the homeless and volunteer in the city at both Glide Memorial and St. Anthony's. I feel that The Ritter Center really contributes to the mess we're faced with in San Rafael. The city is being taken over by the homeless and the drug addicted.
