the foregoing Charter Ordinance No. 1533 entitled:
"AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP
OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY

ORDINANCE NO. 1533
AN ORDINANCE OF THE CITY OF SAN RAFAEL
AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA,
ADOPTED BY REFERENCE BY SECTION 14.15.020
OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA,
SO AS TO RECLASSIFY CERTAIN REAL PROPERTY
FROM P -D (PLANNED DEVELOPMENT) DISTRICT
TO P -D (PLANNED DEVELOPMENT) DISTRICT

(MARIN SHORES TOWNHOUSES)
THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. The Zoning Map of the City of San Rafael,
California, adopted by reference by Section 14.15.020 of the
Municipal Code is amended by reclassifying the following real
property from P -D (Planned Development) District to P -D (Planned
Development) District. Said property so reclassified is located
at 310-330 Pt. San Pedro Road, San Rafael, County Assessor's
Parcel 9-031-14 which is more particularly described in Exhibit
ITBII .
DIVISION 2. Any development of this property
shall be subject to the conditions outlined in Exhibit "A"
which is attached hereto and made a part hereof.
DIVISION 3. If any section, subsection, sentence,
clause or phrase of this ordinance is for any reason held to
be invalid, such holding or holdings shall not affect the validity
of the remaining portions of this ordinance. The Council declares
that it would have passed this ordinance and each section,
subsection, sentence, clause and phrase thereof, irrespective
of the fact that any one or more sections, subsections, sentences,
clauses or phrases be declared invalid.
DIVISION 4. This ordinance shall be published
once in full before its final passage in a newspaper of general
circulation, published and circulated in the City of San Rafael,
and shall be in full force and effect thirty (30) days after
its final passage.

The foregoing Ordinance No. 1533 was read
and introduced at a regular meeting of the City Council of
the City of San Rafael on the 15th day of December
1986, and ordered passed to print by the following vote, to
wit.

NOES: COUNCILMEMBERS: Breiner
ABSENT: COUNCILMEMBERS: Russom
and will come up for adoption as an Ordinance of the City of
San Rafael at a regular meeting of the Council to be held on
the Fifth day of January , 1987.

EXHIBIT "A"
Conditions which were included as part of the zoning (Z83-5)
action by the Planning Commission on May 10, 1983:
(a) The P -D zoning shall be limited to development of
six two-story townhouse units with the following
development standards:
(1) Access from Pt. San Pedro Road shall be limited
to one driveway curb cut at the west end of
the site.
(2) A 60 foot wide view corridor to the San Rafael
Canal shall be maintained between Units 4 and
5. Landscaping in this area shall be limited
to ground cover or low growing shrubs.
(b) The P -D zoning shall be valid for a period of 18
months, or until Mav 11. 1988, and shall become null
and void if building permits are not issued by this
date.
EXHIBIT "B"
Description
All that certain real property situate in the City of San
Rafael, County of Marin, State of California, described as
follows:
BEGINNING at the point of intersection at the most South-
easterly right-of-way line of Point San Pedro Road with the
Northeasterly Boundary of the Porto Bello Subdivision, said
point being more particularly the intersection of the courses
South 39. 01' 45" East 158.87 feet and the curve to the left
of radius 555.28 feet, central angle of 30. 16' 50" and
distance 293.46 feet as said courses are shown on the Parcel
Map of the Lands of Marin Yacht Club recorded in Book 21 of
Parcel Maps at Page 8, said point being also the most Westerly
point of Parcel A of said Parcel Map, thence South 39. 01' 45"
East (called South 40. 24' 30" East on the map of Porto Bello
as recorded in Book 12 of Recorded Maps at Page 10) 158.87
feet to a point on the Westerly line of the San Rafael Canal
as shown on the "Resurvey of the San Rafael Canal as shown on
Map No. 2 of the Salt Marsh and Tidelands situate in the
County of Marin as originally surveyed under the direction of
G.F. Allardt in 1870" as said resurvey is recorded in Book 12
of Official Surveys at Page 25; thence along said Westerly
line of San Rafael Canal North 22. 36' 41" East 355.61 feet;
thence leaving said Westerly line of San Rafael Canal North
00. 39' 55" East 37.07 feet; thence North 69. 22' 19" West
61.00 feet to the Southeasterly right-of-way line of Point San
Pedro Road; thence along said right-of-way line South 20. 37'
41" West 30.00 feet; thence along the curve to the right
having a radius of 555.28 feet, a central angle of 30o 16' 50"
and a length of 293.46 feet to the Point of Beginning.
Containing 0.78 acre, more or less.
