(1313 Fifth Avenue), AP #11-205-01 is a true and correct copy of an ordinance of said City and was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the 16th day of MAY , 19 88, published as required by City Charter in the MARIN INDEPENDENT JOURNAL a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at EL REGULAR meeting of the City Council of said City held on the 6th day of JUNE , 19_U, by the following %*ote , to wit: AYES: COUNCILREMBERS: Boro, Breiner, Thayer & Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCIUIEMBERS: None ABSTAINED: COUNCILMEMBERS: Frugoli (Due to absence from meeting of 5/16/88) WITNESS my hand and the official seal of the City of San Rafael this Seventh day of June , 19 88 JEAN LEONCINI\ City Clerk ORDINANCE NO. 1544 AN ORDINANCE OF THE CITY OF SAN RAFAEL PROVIDING FOR THE SALE AND CONVEYANCE OF PUBLIC REAL PROPERTY TO THE SAN RAFAEL REDEVELOPMENT AGENCY THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. It is hereby determined and ordained that the real property situated at 1313 Fifth Avenue as more particularly described in "Exhibit A" attached hereto, in San Rafael, California, is surplus to the City and can serve a greater public purpose by the assembly with adjoining lands to provide a site for planned future development, and that it would be in the best interest of the City of San Rafael, California, to sell all of the real property here- inafter described. DIVISION 2. The City of San Rafael, California, a municipal corporation, hereinafter referred to as "City", by and through its City Council, does hereby sell the land referred to in Division 1 above and hereinafter specifically described, to the San Rafael Redevelopment Agency, a public body, corporate and politic hereinafter referred to as "Buyer", upon the following terms and conditions: 1. Purchase Price. The purchase price to be paid by Buyer to City shall be the sum of Seven Hundred and Fifty thousand and No/100 ($750,000) in cash lawful money of the United State of America. 2. Delivery of Possession. Buyer shall be given possession of said real property upon recordation of the deed of conveyance. 3. Compliance with San Rafael Charter. It is understood that the within sale is subject to Subdivision 7 of Section 7 of Article VII of the San Rafael Charter, and it is agreed that the within sale shall be made in compliance with said Charter provisions. t N A L ORDINANCE NO. 1544 4. Condition of Title. Title shall be subject to covenants, conditions, restrictions, reser- vations, rights, rights-of-way and easements now of record and to all of the provisions of this Agreement of Sale, and the property is sold as an "as is" condition. 5. Description of Property. That certain real property situate in the City of San Rafael, County of Marin, State of California, as described in "Exhibit A" attached hereto. DIVISION 3. The Mayor of the City of San Rafael is authorized and directed to execute and to deliver to the San Rafael Redevelopment Agency, a public body, corporate and politic, a deed of conveyance, in the name of said City necessary and proper to carry out the sale, upon the terms and conditions herein provided, upon recieipt of the pur- chase price and other considerations, all as hereinabove set forth. DIVISION 4. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage LUAA_ft_e_? LEONCINI y Clerk -3- UEXHIBIT A" LEGAL DESCRIPTION All that certain real �,���Ly situate in the City of San Rafael, County of Marin, State of California, described as follows: EMINNING at a point on the Southerly line of 5th Street, said point being the Northeast — of the Ly described in the Deed from William Vanuvj, et ux, to the City of San Rafael, dated ,hole 9, 1897 and recorded June 9, 1897 in Book 45 of Deeds, at Page 315, Marin County Records; running thence along said Southerly line of 5th Street, South 83" 15' East 155 feet; tip leaving said line South 60 45' West 140 feet to the Northerly line of the property described in the Deed fran Timothy J. Maims to Robert Mages dated S=vLo,1,a.L 15, 1897 and recorded September 15, 1897 in Boric 47 of Deeds, at Page 108, Marin County Records; tl along said line North 83° 15' West 155.9 feet to the Southeast corner of the property described in the above mentioned Deed to the City of San Rafael; thence along the Easterly line thereof, 140 feet to the point of beginning.
