Ex -officio Clerk of the Council of said City, do hereby certify that
the foregoing Charter Ordinance No. 1454 entitled:
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE
CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020
OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY
CERTAIN REAL PROPERTY FROM "U" (UNCLASSIFIED) DISTRICT TO P -D (PLANNED
DEVELOPMENT) DISTRICT (Northgate East Phase II)
is a true and correct copy of an ordinance of said City and was
introduced at a regular meeting of the City Council
of the City of San Rafael, held on the sixteenth I day of
May , 1983, published as required by City Charter in the
Independent -Journal , a newspaper published in the City
of San Rafael and passed and adopted as an ordinance of said City at
a regular meeting of the City Council of said City
held on the sixth day of June , 1983, by the following
vote. to wit:

ORDINANCE NO. 1454
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE
ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA,
ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE
MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO
RECLASSIFY CERTAIN REAL PROPERTY FROM "U" (UNCLAS-
SIFIED) DISTRICT TO P -D (PLANNED DEVELOPMENT) DISTRICT
(Northgate East Phase II)
THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. The Zoning Map of the City of San Rafael,
California, adopted by reference by Section 14.15.020 of the Muni-
cipal Code is amended by reclassifying the following real property
from "U" (Unclassified) District to P -D (Planned Development)
District. Said property so reclassified is located at 4040 Civic
Center Drive (Northgate East Phase II), San Rafael, County Assessor's
Parcels 180-121-38, 44 and a portion of 43 and described in Exhibit
"B" attached.
DIVISION 2. Any development of this property shall be
subject to the conditions outlined in Exhibit "A" which is attached
hereto and made a part hereof.
DIVISION 3. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation,
published and circulated in the City of San Rafael, and shall be in
full force and effect thirty (30) days after its final passage.

The foregoing Ordinance No. 1454 was read and intro-
duced at a regular meeting of the City Council of the City of
San Rafael, held on the 16th day of May , 1983, and
ordered passed to print by the following vote, to wit:

NOES: COUNC ILMEMBERS: None
ABSENT: COUNC ILMEMBERS : Brei ner & Mayor Mul ryan
and will come up for adoption as an Ordinance of the City of San
Rafael at a regular meeting of the Council to be held on the
sixth day of June , 1983.

EXHIBIT "A"
Conditions which were included as part of the zoning R82-14)
action by the Planning Commission on March 15, 1983:
(a) The site is approved for development of a 129,358 gross
square foot office building, 346 car parking deck and
ancillary site improvements as depicted on the plan
dated January 3, 1983, and prepared by William Schuppel
and Associates.
(b) The uses are contingent upon conditions specified under
UP82-61 and any subsequent use permit amendments.
(c) Proposed building and site improvements shall substantially
comply with the plans prepared by William Schuppel and
Associates dated January 3, and conditions attached to
ED82-46.
(d) The action shall be valid for 18 months or until September
15, 1984, unless extended, and shall become null and void
if an extension or building permit for the project is not
issued prior to that date.

being the most Northerly corner of the parcel of land
conveyed.to the State of California by Deed recorded
November 29, 1956 in Book 1076 of Official Records at
page 227, thence along said Northwesterly line North
34° 17' 03" East 585.00 feet, thence leaving said
Northwesterly line South 52' 00' 00" East 606.00 feet,
thence South 430 30' West 212.35 feet, thence South 77"
13' 00" West 490.06 feet to the Northeasterly line of
said State parcel, thence along said Northeasterly line,

beginning.

of 40 feet, said strip lying Northeasterly of and con-

86 feet in width, lying Southerly of and contiguous to

Said Easement to be bounded on the East by a line having
a bearing of South 12' 47' 00" East from the Easterly
terminus of said course and on the West by the Easterly
line of the Parcel of land conveyed to the State of
California by Deed recorded November 29, 1956 in Book -
1076 of Official Records at page 227, Marin County Records_
