ORDINANCE NO. 1455
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE
ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA,
ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE
MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO
RECLASSIFY CERTAIN REAL PROPERTY FROM C-2 (GENERAL
COMMERCIAL) DISTRICT TO P -D (PLANNED DEVELOPMENT)
DISTRICT
(1301 Third Street "Centertown")
THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. The Zoning Map of the City of San Rafael,
California, adopted by reference by Section 14.15.020 of the Muni-
cipal Code is amended by reclassifying the following real property
from C-2 (General Commercial) District to P -D (Planned Development)
District. Said property so reclassified is located at 1301 Third
Street at "C" Street, San Rafael, County Assessor's Parcels
11-254-02 through 06 and more particularly described in Exhibit "B".
DIVISION 2. Any development of this property shall be
subject to the conditions outlined in Exhibit "A" which is attached
hereto and made a part hereof.
DIVISION 3. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation,
published and circulated in the City of San Rafael, and shall be in
full force and effect thirty (30) days after its final passage.

ORDINANCE NO. 1458
The foregoing Ordinance No. 1458 was read and intro-
duced at a regular meeting of the City Council of the City of
San Rafael, held on the 20th day of June , 1983, and
ordered passed to print by the following vote, to wit:
AYES: COUNCILMEMBERS: Frugoli, Jensen, Miskimen & Mayor Mulryan
NOES: COUNCILMEMBERS: Breiner
ABSENT: COUNCILMEMBERS: None
and will come up for adoption as an Ordinance of the City of San
Rafael at a regular meeting of the Council to be held on the
fifth day of July , 1983.

EXHIBIT "A"
Conditions which were included as part of the zoning (Z82-18)
action by the Planning Commission on May 10, 1983:
(a) This P -D (Planned Development) rezoning is approved for a
95 -unit condominium complex restricted to occupancy by
persons 60 years of age or older. This provision shall be
contained in the CC&R's. Units are approximately 450 square
feet in size. Sixty-two parking spaces are provided on site;
eight additional parking spaces shall be available for limited
use on the adjacent parcel. Ten of the units shall be desig-
nated below market rate; five to be affordable one-person fam-
ilies of median income, and five to be affordable to two -
person families of moderate (up to 120% of median) income.
(b) All conditions of UP82-91, ED82-89 and TS83-7 and any sub-
sequent modification thereof shall be satisfied.
(c) The P -D rezoning is approved for this project only. If any
of the project approvals expire, the zoning shall automatically
revert to the previous C-2 (General Commercial) District.
(d) The rezoning is valid for a period of 18 months or until
November 10, 1984, and shall become null and void if a build-
ing permit is not issued or an extension granted.
EXHIBIT "B"
Description
All that certain real property situate in the City of San
Rafael, County of Marin, State of California, being a portion
of Block 15 as said Block is laid down and delineated on Map
of Town of San Rafael, filed in the office of the County
Recorder of the County of Marin, State of California, October
14, 1873, described as follows:
BEGINNING at the corner formed by the intersection of the
South line of Third Street with the West line of C Street;
running thence Southerly along the West line of C Street 192.0
feet; thence Westerly and parallel with Third Street 150 feet;
thence Northerly and parallel with C Street 36.0 feet; thence
Westerly and parallel with Third Street 52.4 feet; thence
Northerly and parallel with C Street 152.88 feet to the
Southerly line of Third Street; thence Easterly along the
Southerly line of Third Street 204.31 feet to the Point of
Beginning.
