is a true and correct copy of an ordinance of said City and was
introduced at a regular meeting of the City Council
of the City of San Rafael, held on the twentieth day of
June 1983, published as required by City Charter in the
San Rafael News/Pointer a newspaper published in the City
of San Rafael and passed and adopted as an ordinance of said City at
a re--ular meeting of the City Council of said City
held on the fifth day of July 1983, by the following
vote, to wit:

ORDINANCE NO. 1460
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE
ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA,
ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE
MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO
RECLASSIFY CERTAIN REAL PROPERTY FROM P -D (PLANNED
DEVELOPMENT) DISTRICT TO P -D (PLANNED DEVELOPMENT)
DISTRICT
(54 San Pablo Avenue "Meadow Oaks")
THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. The Zoning Map of the City of San Rafael,
California, adopted by reference by Section 14.15.020 of the Muni-
cipal Code is amended by reclassifying the following real property
from P -D (Planned Development) District to P -D (Planned Development)
District. Said property so reclassified is located at 54 San Pablo
Avenue, San Rafael, County Assessor's Parcels 179-321-08 and 11 and
more particularly described in Exhibit "B".
DIVISION 2. Any development of this property shall be
subject to the conditions outlined in Exhibit "A" which is attached
hereto and made a part hereof.
DIVISION 3. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation,
published and circulated in the City of San Rafael, and shall be in
full force and effect thirty (30) days after its final passage.

The foregoing Ordinance No. 1460 was read and intro-
duced at a regular meeting of the City Council of the City of
San Rafael, held on the 20th day of June , 1983, and
ordered passed to print by the following vote, to wit:

and will come up for adoption as an Ordinance of the City of San
Rafael at a regular meeting of the Council to be held on the
fifth day of July , 1983.

EXHIBIT "A"
Conditions which were included as part of the zoning R83-6)
action by the Planning Commission on May 24, 1983:
(a) This P -D (Planned Development) rezoning is approved for the
140 unit Meadow Oaks condominium complex on 11.6 acres, and
permanent open space on 42.1 acres. Forty-eight are studio
and one -bedroom, 40 are small two-bedroom, and 52 are large
two and three-bedroom units. Fourteen units shall be desig-
nated below market rate with a unit mix and construction
phasing as specified in TS83-6 condition (1). The project
shall also contain the recreation facilities shown on the
landscape plan, and construction of a pedestrian access trail
and fire road on proposed open space lands to existing fire
roads.
(b) Conditions of TS83-6 and ED83-32 and any subsequent modification
thereof shall be satisfied.
(c) The rezoning is valid for a period of 18 months or until
November 24, 1984, and shall become null and void if a building
permit is not issued or an extension granted.

All that certain Real Property situated in the City of San Rafael, County of
Marin, State of California, described as follows:
COMMENCING at a point on the Northeasterly line of San Pablo Avenue, said point
being the most Southerly corner of the parcel conveyed to Louis Martini, et
ux, by Deed recorded October 27, 1949 in Book 616 of Official Records, at
page 374, Marin County Records; running thence along said Northeasterly line
and the Southeasterly line of said Avenue, South 21032' East 164.44 feet;
thence South 230461 West 88.00 feet to the most Northerly corner of the parcel
conveyed to Edward Screttrini by Deed recorded October 27, 1949 in Book 631
of Official Records, at Page 35, Marin County Records; running thence along
the Northeasterly, Southeasterly and Southerly lines of said parcel, South
66°14' East 85.00 feet, South 23°46' West 90.00 feet and South 87°43' West
94.61 feet to the Southeasterly line of said San Pablo Avenue; thence along
said Southeaster line South 23°46' West 500.45 feet, more or less, to the
most Northerly corner of parcel conveyed to James G. Paganetti, by Deed
recorded April 18, 1960 in Book 1360 of Official Records, at Page 561, Marin
County Records; thence along the Northeasterly and Southeasterly lines of
said parcel, South 48°49' East 100.0 feet and South 23029' West 90.0 feet
to the Northeasterly line of the parcel conveyed to C.J. Kalberer, by Deed
recorded February 11, 1927 in Book 111 of Official Rgcords, at Page 285, Marin
County Records; thence along said line, South 48'49' East 1403.3 feet to the
most Easterly corner of said parcel; said corner being on the San Pedro Ridge
and being the Northerly line of the "Coleman Tract"; thence along said ridge
North 55°42' East 296.2 feet, North 88021' East 691.6 feet and North 39°32'
East 219.4 feet to the Southwesterly line of the parcel conveyed to John Z.
Fung, et ux, by Deed recorded June 27, 1947 in Book 553 of Official Records,
at Page 237, Marin County Records; thence along said line, North 47018' West
181.44 feet, more or less to an angle point in said line that is common to
the courses of South 37°22' East 191.05 feet and South 47°18' East 181.44 feet,
more or less, as set forth in said Deed; thence still along said line, North'
37122' West 191.05 feet, North 41°54' West 150.82 feet, North 11054' West
140.32 feet and North 0°51' West 176.5 feet to the Southwesterly line of the
parcel conveyed to John Z. Fung, et ux, by Deed recorded October 30, 1946 in
Book 538 of Official Records, at Page 53, Marin County Records; thence along
said line, North 48'15' West 285.23 feet, North 48°48' West 369.95 feet and
North 62°08' West 1070.0 feet, more or less, to a point that bears North
44°06' East from the point of commencement and thence South 44°06' West 204.0
feet, more or less, to the point of commencement.
