the foregoing Charter Ordinance No. 1491 entitled:
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE

ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE

is a true and correct copy of an ordinance of said City and was
introduced at a REGULAR meeting of the City Council
of the City of San Rafael, held on the SIXTEENTH day of
JULY , 1984, published as required by City Charter in the
INDEPENDENT -JOURNAL , a newspaper published in the City
of San Rafael and passed and adopted as an ordinance of said City at
a REGULAR meeting of the City Council of said City
held on the SIXTH day of AUGUST 1984, by the following
vote, to wit:

AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING
THE ZONING MAP OF THE CITY OF SAN RAFAEL,
CALIFORNIA, ADOPTED BY REFERENCE BY SECTION
14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL,
CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL
PROPERTY FROM M (HEAVY COMMERCIAL AND MANUFAC-
TURING) DISTRICT TO P -D (PLANNED DEVELOPMENT)

THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. The Zoning Map of the City of San Rafael,
California, adopted by reference by Section 14.15.020 of the Muni-
cipal Code is amended by reclassifying the following real property
from M (Heavy Commercial and Manufacturing) District to P -D (Planned
Development) District. Said property so reclassified is located at
530 Francisco Boulevard West, San Rafael, County Assessor's Parcels

"k-051--06 and 20, described in Exhibit "B".
DIVISION 2. Any development of this property shall be
subject to the conditions outlined in Exhibit "A" which is attached
hereto and made a part hereof.
DIVISION 3. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation,
published and circulated in the City of San Rafael, and shall be in
full force and effect thirty (30) days after its final passage.

The foregoing Ordinance No. 1491 was read and intro-
duced at a REGULAR meeting of the City Council of the City of
San Rafael, held on the 16TH day of JULY , 1984, and
ordered passed to print by the following vote, to wit:

EXHIBIT "A"
Conditions which were included as part of the zoning (Z84-4) action by the
Planning Coamiission on flay 15, 1984:
Conditions of approval:
(a) The P -D zoning shall be limited to development of a 36,778 square foot
retail center contained within two buildings. The following development
standards shall apply:
1) Uses shall be limited to small and large item retail, emphasizing
home improvement uses, with the center divided as follows:
a- 22,000 square feet for bulk retail;
b- 14,778 square feet for small item retail.
2) All uses shall be subject to use permit approval. Minor changes in
square footage limitations -can be approved by use permit. All changes
in uses and square footage shall be subject to specific traffic review
to determine if there are any additional impacts to critical inter-
sections in the East San Rafael area. Additional mitigation fees may
be charged if it is determined that there are additional traffic
impacts.
3) Building setbacks:
a- Minimum front yard setback: 25 feet;
b- Average rear yard setback: 15 feet;
c- flinimum side yard (south) setback: 5 feet.
4) Building height: maximum 30 feet.
5) Building coverage: maximum 32%.
6) Landscape coverage: minimum 25%.
(b) This P -D zoning shall be subject to a>>endment when or if the 55 -foot wide
highway "take" occurs. This "take" ray result in modifications to the
site plan (building, parking and landscaping).
(c) This P -D zoning shall be valid for IB nonths from the date of City Council
adoption unless subsequent permits have been filed and approved.
