introduced at a Regular meeting of the City Council
of the City of San Rafael, held on the 4th day of
March , 19 85, published as required by City Charter in the
Independent Journal a newspaper published in the City
of San Rafael and passed and adopted as an ordinance of said City at
a Regular meeting of the City Council of said City
held on the 18th day of March 19 85 by the following
vote, to wit:

ORDINANCE NO. 1501
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING
TITLE 4, SECTIONS 4.08.090 AND 4.08.100 (AMENDMENTS
TO THE UNIFORM FIRE CODE), OF THE MUNICIPAL CODE OF
THE CITY OF SAN RAFAEL
(Re: Installation of Wired Smoke Detectors In Existing, Hotel Rooms)
THE COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS:
DIVISION 1. Title 4, Chapter 4.08, Section 4.08.090, of
the Muncipal Code of the City of San Rafael, is hereby amended and
shall read as follows:
4.08.090. Amendments Made to the Uniform Fire Code. The
Uniform Fire Code is amended and changed in the following respects
only:

Section 10.307(g) is hereby amended and shall read as
Section 10.307(8). No hotel as defined in Section 409 of
the Uniform Building Code or any successor section thereto shall be
sold or otherwise transferred, altered, repaired, reconstructed or
added to by the performing of work thereon of a value exceeding One
Thousand Dollars ($1,000) within any twelve (12) month period unless
and until a smoke detector, approved and listed by the State Fire
Marshal pursuant to California Health & Safety Code Section 13114,
shall first be installed in accordance with the manufacturer's
instructions in each guest room and/or unit intended for human
occupancy.
In addition thereto, on or before the expiration of
twenty-four (24) months from and after the effective date of this
ordinance, every guest room and/or unit intended for human occupancy
in every hotel, as defined in Section 409 of the Uniform Building
Code, shall have installed therein a smoke detector, approved and
listed by the State Fire Marshal pursuant to California Health &
Safety Code Section 13114, in accordance with the manufacturer's
instructions.
The smoke detector devices referred to herein shall be of
a type sufficient to meet the minimum level of protection defined in

Standard 74 of the National Fire Protection Association. In addi-
tion, such smoke detector devices shall be required to meet the
following criteria: (1) the detectors shall not be sensitive to
heat only; (2) the detectors shall conform to the Uniform Building
Code Standard 42-6; (3) the detector shall be approved and listed by
the California State Fire Marshal's Office for use in residential
occupancies; (4) the detector shall take its primary source of power
from the hotel building electrical system with no intervening
switches or disconnects other than those required for overcurrent
protection; (5) the detector shall be clearly audible in all rooms
located within each guest room and/or unit when all intervening
doors therein are closed.
The amendments to this section are adopted pursuant to the
express statutory authority therefor contained in California Health
& Safety Code Section 13113.7.
DIVISION 2. Title 4, Chapter 4.08, Section 4.08.100 of
the Municipal Code of the City of San Rafael is hereby amended and
shall read as follows:
4.08.100. Penalties. Former Section 4.08.100 as con-
tained in Ordinance 1494, adopted August 20, 1984, is amended to
substitute "infraction" where the word "misdemeanor" there appears,
and to provide for a penalty consisting of a maximum fine of Two
Hundred Dollars ($200) for each offense. All other provisions of
Section 4.08.100 contained in Ordinance 1494 shall remain in full
force and effect.
DIVISION 3. All other amendments made to the Uniform Fire
Code as set forth in Ordinance 1494 which was duly passed by the
City Council of San Rafael on August 20, 1984, remain in full force
and effect.
DIVISION 4. If any section, subsection, sentence, clause
or phrase of this ordinance is for any reason held to be invalid,
such decision shall not affect the validity of the remaining portion

of this ordinance. The City Council of the City of San Rafael
hereby declares that it would have adopted the ordinance and each
section, subsection, sentence, clause or phrase thereof, irrespec-
tive of the fact that any one or more sections, subsections,
sentences, clauses or phrases shall be declared invalid.
DIVISION 5. This ordinance shall go into effect and be in
full force and effect and in operation thirty (30) days after its
final passage.

The foregoing Ordinance No. 1501 was read and introduced
at a regular meeting of the City Council of the City of San
Rafael, held on the 4th day of March 1985, and ordered
passed to print by the following vote, to wit:

NOES: COUNCILMEMBERS: None

and will come up for adoption as an Ordinance of the City of San
