the foregoing Charter Ordinance No. 1403 entitled:
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING VARIOUS SECTIONS
OF THE SAN RAFAEL MUNICIPAL CODE TITLE 14 CONCERNING COMMERCIAL
RECREATIONAL USES
is a true and correct copy of an ordinance of said City and was
introduced at a regular meeting of the City Council
of the City of San Rafael, held on the third day of
August , 1981, published as required by City Charter in. the
San Rafael News/Pointer , a newspaper published in the City
of San Rafael and passed and adopted as an ordinance of said City at
a regular meeting of the City Council of said City
held on the seventeenth day of August 1981, by the following
vote, to wit:

ORDINANCE NO. 1403
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL AMENDING VARIOUS SECTIONS OF THE SAN RAFAEL
MUNICIPAL CODE TITLE 14 CONCERNING COMMERCIAL
RECREATIONAL USES
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. Chapter 14.38 (C-R) Commercial Recreational
District is hereby added as follows:

14.38.010 PURPOSE.
C-R: COMMERCIAL RECREATION DISTRICT
Purpose
Use Permit
Other Regulations
The purpose of the commercial recreational district is to en-
courage larger commercial recreational uses and facilities in a
manner compatible with surrounding land uses. These are recreational
uses involving outdoor as well as indoor activities.
14.38.020 USE PERMIT.
The following uses are permitted, subject to obtaining a use permit
in each case.
1. Golf courses and country clubs.
2. Golf driving ranges.
3. Marinas and yacht harbors.
4. Tennis and swim clubs.
5. Riding academies.
6. Rod and gun clubs.
7. Non-public parks and playgrounds.
8. Other recreational facilities and uses which the Planning
Director determines are of similar use or nature.
9. Accessory uses and structures incidental and appurtenant
to the primary use.
10. Public utilities facilities and uses.
14.38.030 OTHER REGULATIONS.
All uses are subject to Chapter 14.11 Environmental and Design
Review, and Chapter 14.13 Off -Street Parking and Loading.
DIVISION 2. Section 14.44.020 II a is hereby amended to
read as follows:
14.44.020 USE REGULATIONS
II. Use Permit. The following uses are permitted, subject to
obtaining a use permit in each case.

a. Ambulance services, animal hospitals, automobile repair
shops, cleaning and dyeing establishments, creameries,
discos, gasoline service stations, laundries, launderettes,
live entertainment, outdoor markets, outdoor sales establish-
ments, marine uses, pet shops, public garages, used car
lots, fast food establishments, theaters, commercial
recreation uses contained entirely within a building,
establishments selling prepared food intended for con-
sumption on the premises in a vehicle, and other uses
which, in the opinion of the Planning Commission, are of a
similar nature.
DIVISION 3. Section 14.46.040 d. is hereby amended to read
as follows:
14.46.040 CONDITIONAL USES
d. Commercial entertainment and recreation contained entirely
within a building.
DIVISION 4. Section 14.75.020 a. is hereby deleted and the
remaining Sections are renumbered a. through j.
read:
DIVISION 5. Section 14.75.020 f. is hereby amended to
f. Churches, schools, parks and playgrounds, public utility
and public and quasi public buildings may be permitted in
any "R" District wherein not otherwise specified in said
District, providing a use permit shall first be obtained
in each case.
DIVISION 6. If any section, subsection, sentence, clause,
or phrase of this Ordinance is for any reason held to be invalid,
such decision shall not affect the validity of the remaining portions
of this Ordinance. The Council hereby declares that it would have
adopted the Ordinance, and eadh section, subsection, sentence, clause,
or phrase thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses, or phrases be declared
invalid.
DIVISION 7. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation,
published and circulated in the City of San Rafael, and shall be in
full force and effect thirty (30) days after its final passage.

The foregoing Ordinance No. 1403 was read and intro-
duced at a regular meeting of the City Council of the City of
San Rafael, held on the 3rd day of AuLrust , 1981, and
ordered passed to print by the following vote, to wit:
AYES: COUNCILMEMBERS: Breiner, Nixon & Acting Mayor Jensen
NOES: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS: Mayor Mulryan
ABSTAINED: COUNCILMEMBERS: Miskimen
and will come up for adoption as an Ordinance of the City of San
Rafael at a regular meeting of the Council to be held on the
seventeenth day of August , 1981.
