LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1437 entitled: AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM PUD -AP (PLANNED UNIT DEVELOPMENT - ADMIN- ISTRATIVE PROFESSIONAL) DISTRICT TO PUD -AP (PLANNED UNIT DEVELOPMENT - ADMINISTRATIVE PROFESSIONAL) DISTRICT (175 North Redwood Drive - Marin Covenant Church) is a true and correct copy of an ordinance of said City and was introduced at a regular meeting of the City Council of the City of San Rafael, held on the second day of August , 1982, published as required by City Charter in the Independent -Journal , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a regu1 ar meeting of the City Council of said City held on the sixteenth day of August 1982, by the following vote, to wit: AYES: COUNCILMEMBERS:Breiner, Frugoli, Jensen, Miskimen & Mayor Mulryan NOES: COUNCILMEbiBERS:None ABSENT: COUNCILMEMBERS:None u WITNESS my hand and the official seal of the City of San Rafael this eighteenth day of August , 1982. LEONCINI,�yC ORDINANCE NO. 1437 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM PUD -AP (PLANNED UNIT DEVELOPMENT - ADMINISTRATIVE PROFESSIONAL) DISTRICT TO PUD -AP (PLANNED UNIT DEVELOPMENT - ADMINISTRATIVE PROFESSIONAL) DISTRICT (175 North Redwood Drive - Darin Covenant Church) THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by reference by Section 14.15.020 of the Muni- cipal Code is amended by reclassifying the following real property from PUD -AP (Planned Unit Development - Administrative Professional) District to PUD -AP (Planned Unit Development - Administrative Professional) District. Said property so reclassified is located at 175 North Redwood Drive, San Rafael, County Assessor's Parcels 155-271-01 through 08. DIVISION 2. Any development of this property shall be subject to the conditions outlined in Exhibit "A" which is attached hereto and made a part hereof. DIVISION 3. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. LEO CINI, City Clerk ORDINANCE NO. 1437 The foregoing Ordinance No. 1437 was read and intro- duced at a regular meeting of the City Council of the City of San Rafael, held on the second day of August 1982 and ordered passed to print by the following vote, to wit: AYES: COUNCILMEMBERS:Frugoli, Jensen, Miskimen & Mayor Mulryan NOES: COUNCILMEMBERS:None ABSENT: COUNCILMEMBERS:Breiner and will come up for adoption as an Ordinance of the City of San Rafael at a regular meeting of the Council to be held on the sixteenth day of August , 1982. 25 A/1 J A M. LEONCINI, City Clerk - 2 - EXHIBIT "A" Z82-7 Conditions of Approval (a) All conditions of UP82-35 shall apply. UP82-35 Conditions of Approval (a) All previous conditions of UP73-82 shall apply with the exception to references to the square footage of the church/office buildings. This permit authorizes use of 42,000 square feet as described in the staff report. Simultaneous use of the "Rafael North Executive Park" offices (50,000± square feet),and the Marin Covenant Church buildings is prohibited. Use of the church or education building (besides incidental offices for the pastor) shall be limited to Saturdays, Sundays and holidays. If at any time the total parking, generated by combined uses, exceeds the 250 spaces provided, the Planning Commission retains the right to reopen the use permit and establish additional limitations. (b) The Marin Covenant Church and educational building shall be subject to Environmental Design Review, Minor modifications and refinements to areas described can be made at the time of this review by the Planning -Commission. (c) This permit is conditioned upon the submittal of written authorization from the Board of Directors of "Rafael North Executive Park" for the increased square footage for Marin Covenant Church. (d) This permit is valid for a period of one year or until July 13, 1983, if not extended.
