Ordinance No. 1353 entitled:
AN ORDINANCE OF THE CITY OF SAN RAFAEL REPEALING CHAPTER 6.10
"ANIMAL CONTROL" OF THE SAN RAFAEL MUNICIPAL CODE AND ADOPTING

first day of October 1979, published as
required by City Charter in the Marin Suburban Newspapers
a newspaper printed and published in the City of San Rafael
and passed and adopted as an ordinance of said City at a
regular meeting of the City Council of said City
held on the fifteenth day of October , 1979; by the
following vote, to wit:

ORDINANCE NO. 1353
AN ORDINANCE OF THE CITY OF SAN RAFAEL REPEALING CHAPTER 6.10 "ANIMAL CONTROL"
OF THE SAN RAFAEL MUNICIPAL CODE AND
ADOPTING BY REFERENCE THE MARIN COUNTY ANIMAL CONTROL CODE
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. Chapter 6.10 "Animal Control" of the San Rafael
Municipal Code is hereby repealed, and a new Chapter 6.10 is enacted,
to read in its entirety as follows:
CHAPTER 6.10 ANIMALS
Section 6.10.010 Adoption of County Code.
6.10.050 Penalty for Violations.
Section 6.10.010 Adoption of County Code. Pursuant to Section
50022.9 of the Government Code, the Marin County Animal Control Code, set
forth in Title 8 of the Marin County Code as Chapters 8.04, 8.08 and 8.12
hereby is adopted by reference and is in full force and effect within the
City of San Rafael.
Section 6.10.050 Penalty for Violations. Any person violating
within San Rafael any of the provisions of -Section 8.04.180; 8.04.181;
8.04.240; 8.04.245; 8.04.246; 8.08.010; 8.08.020; 8.12.010; and
8.12.020 of the Marin County Code is guilty of a Misdemeanor and upon con-
viction thereof shall be punished by fine not exceeding Five Hundred
Dollars, by imprisonment not exceeding six months, or by both such fine
and imprisonment. Any person violating within San Rafael any other pro-
visions of Title 8 of the Marin County Code is guilty of an infraction
and upon conviction thereof shall be punished by a fine of not more than
Fifty Dollars for the first offense and for a second or subsequent offense
by a fine of not more than One Hundred Dollars.
DIVISION 2. If any section, subsection, sentence, clause, or
phrase of this Ordinance is for any reason held to be invalid, such de-
cision shall not affect the validity of the remaining portions of this
Ordinance. The Council hereby declares that it would have adopted the
Ordinance and each section, subsection, sentence, clause, or phrase there-
of, irrespective of the fact that any one or more sections, subsections,
sentences, clauses, or phrases be declared invalid.

DIVISION 3. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation, printed,
published, and circulated in the City of San Rafael, and shall be in
full force and effect thirty (30) days after its final passage.

The foregoing Ordinance No. 1353 was read and introduced
at a regular meeting of the City Council of the City of San Rafael,
held on the first day of October 1979, and ordered passed to
print by the following vote, to wit:
AYES: COUNCILMEMBERS: Breiner, Miskimen, Nixon and Mayor Mulryan
NOES: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS: Jensen
and will come up for adoption as an Ordinance of the City of San Rafael
at a regular meeting of the Council to be held on the 15th day of
October , 1979.
