LEON � 1 ,iity ler ORDINANCE NO. 1367 AN URGENCY ORDINANCE OF THE CITY OF SAN RAFAEL EXCEPTING LOW AND MODERATE SENIOR CITIZEN HOUSING PROJECT (ROTARY MANOR) FROM PROVISIONS OF ORDINANCE NO. 1354 FINDINGS 1. The City Council has adopted Ordinance 1354 on October 29, 1979 preventing development pending completion of a Neighborhood Plan for Neighborhoods 13/14. 2. At the inception of and during formulation of the Neighborhoods 13/14 Plan, the Rotary Manor, a low and moderate income senior citizen housing project, has been ongoing and conceptual approval has been given by the City; 3. The Rotary Manor housing project will provide housing for senior citizens in the low and moderate income bracket whose needs for housing are supported by widely disseminated market data and sta- tistics; 4. The Rotary Manor project will, in part, occupy existing facilities and property which heretofore have been utilized as a public school, thus not occupying undeveloped land or land with high neighborhood visibility nor known environmental constraints; 5. The Rotary Manor housing project, as proposed, will not be counter- productive to the proposed goals of the Neighborhoods 13/14 Plan. 6. The Rotary Manor housing project has the general approval of the neighborhood residents. 7. The Rotary Manor housing project achieves housing goals set forth in the proposed Neighborhood Plan and the General Plan. THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. Ordinance No. 1354 of the City of San Rafael is hereby amended to except from its provisions the Rotary Manor housing project proposed for development at the West End School property, 1821 Fifth Avenue, San Rafael, California. DIVISION 2. This Ordinance is an Urgency Ordinance for the needed preservation of the public peace, health, or safety within the meaning of Government Code Section 25123 and shall go into effect immediately. The facts constituting such necessity are: The Neighborhood Plan for Neighborhoods 13/14 although recom- mended by the Planning Commission, is still pending hearings before the San Rafael City Council. Final adoption of said Plan, and implementing zoning, may not occur for weeks or months. *0P G-RINA- 1 - ORDINANCE NO. 1367 Because housing is urgently needed in San Rafael; because the Rotary Manor project will fulfill a housing need for low and moderate income senior citizens, it is imperative its processing be allowed to proceed. Development of the Rotary Manor project is more expeditiously possible at this time in that the building season is imminent, and work may proceed without hindrance. LAWRENCE E.
