the foregoing Charter Ordinance No. 1390 entitled:
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF
THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION
14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO
RECLASSIFY CERTAIN REAL PROPERTY FROM "U" (UNCLASSIFIED) DISTRICT
TO P -D (PLANNED DEVELOPMENT) DISTRICT (54 San Pablo Avenue "Meadow
Oaks")
is a true and correct copy of an ordinance of said City and was
introduced at an adjourned rev-ular meeting of -the City Council
of the City of San Rafael, held on the twentv-third day of
March , 1981, published as required by City Charter in the
San Rafael News/Pointer , a newspaper published in the City
of San Raf ael and passed and adopted as an ordinance of said City at
an adjourned regular meeting of the City Council of said City
held on the sixth day of April , 19 81, by -the following
vote, to wit:

ORDINANCE NO. 1390
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE
ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA,
ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE
MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO
RECLASSIFY CERTAIN REAL PROPERTY FROM "U" (UNCLAS-
SIFIED) DISTRICT TO P -D (PLANNED DEVELOPMENT) DISTRICT
(54 San Pablo Avenue "Meadow Oaks")
THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. The Zoning Map of the City of San Rafael,
California, adopted by reference by Section 14.15.020 of the Muni-
cipal Code is amended by reclassifying the following real property
from "U" (Unclassified) District to P -D (Planned Development)
District. Said property so reclassified is located at
54 San Pablo Avenue, San Rafael, County Assessor's Parcels
179-321-08, 11 and 179-311-21.
DIVISION 2. Any development of this property shall be
subject to the conditions outlined in Exhibit "A" which is
attached hereto and made a part hereof.
DIVISION 3. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation,
published, and circulated in the City of San Rafael, and shall be in
full force and effect thirty (30) days after its final passage.

EXHIBIT "A"
Conditions which were included as part of the zoning
(Z79-18) action by the Planning Commission on February
24, 1981:
(a) Prior to recordation of a subdivision map or issuance
of building permits, the applicant shall agree in a
form acceptable to the City Attorney, to pay his fair
share cost for areawide traffic improvements. Sub-
sequent permits may require payment of an estimated
fee to the City.
(b) The entry design shall be modified to provide a minimum
15 -foot setback from the townhouse roadway to the
adjacent neighbor's home. Subsequent permits shall
guarantee adequate access provisions for the neighbor's
driveway.
(c) Slides shall be repaired as outlined in the soils
investigation and required by the Geotechnic Review
Board in letters on file with the City.
(d) Graded slopes shall be sculptured and contoured to
match existing land forms. Specific plans shall be
approved as part of the design review and subdivision
approvals.
(e) The single family homes shall be subject to design
review. Specific building envelopes shall be shown
on the subdivision map. These envelopes shall provide
a minimum 15 -foot front setback and 20 -foot side
separation between units. Building heights for lots
3 - 9 shall not exceed 35 feet as measured parallel
to the existing contours. The building height for lot
2 shall not exceed 25 feet as measured parallel to the
existing contours.
(f) Prior to tentative map approval, one or more of the
single family lots may be eliminated in favor of the
same number or greater number of units being transfer-
red to the remainder of the project. This shall be
determined by the Planning Commission after additional
field investigation of the site.
