LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1392 entitled: AN ORDINANCE OF THE CITY OF SAN RAFAEL AUTHORIZING THE LEASE OF TIDE AND SUBMERGED LANDS GRANTED IN TRUST TO THE CITY OF SAN RAFAEL is a true and correct copy of an ordinance of said City and was introduced at a regular meeting of the City Council of the City of San Rafael, held on the sixth day of April IT 1981, published as required by City Charter in the Independent -Journal , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a regular meeting of the City Council of said City held on the twentvi eth day of Anri 1 , 1911L, by the following vote, to wit: AYES: COUNCILMEMBERS : Brei ner, Jensen, Mi ski men, Nixon & Mayor Mul ryan NOES: COUNCILMEDIBERS : None ABSENT: COUNCILMEMBERS : None ti WITNESS my hand and the official seal of the City of San Rafael this twenty-second day of ADri1 , 19BL. JE N% LEONCINI, City Clerk ORDINANCE NO. 1392 AN ORDINANCE OF THE CITY OF SAN RAFAEL AUTHORIZING THE LEASE OF TIDE AND SUB- MERGED LANDS GRANTED IN TRUST TO THE CITY OF SAN RAFAEL The Council of the City of San Rafael, California, do ordain as follows: Section 1: It is hereby found, determined, and ordained that the State of California, by virtue of Chapter 83 of the Statutes of 1923, as amended by Chapter 178 of the Statutes of 1967, as amended by Chapter 1383 of the Statutes of 1970, and as amended by Chapter 1742 of the Statutes of 1971 has granted all the right, title, and interest of the State in and to all the salt marsh, tide, and submerged lands, whether filled or unfilled, located within the boundaries of the City of San Rafael, hereinafter referred to as the City, and situated below the line of mean high tide of the Pacific Ocean or any harbor, estuary, bay or inlet within its boundaries, to be forever held by the City, and by its successors in trust for the uses and purposes set forth in the Statutes. Section 2: The Statutes set forth the uses and purposes of the tide and submerged lands and also provide that said lands may also be leased by the City as long as said leases do not interfere with navi- gation or commerce. Section 3: The City shall adopt a resolution by majority vote of the Council that establishes guidelines for the lease or permit of unfilled tide and submerged lands that are subject to tidal action. Section 4: The City shall adopt a resolution by majority vote of the Council that establishes another set of guidelines for the lease or permit of filled or reclaimed tidelands. Section 5: The guidelines shall not be incompatible with the provisions of Section 6330 et seq of the Public Resources Code of the State of California. Section 6: The guidelines may be amended from time to time by majority vote of the City Council. Section 7: This Ordinance shall be published once in full before its passage in a newspaper of general circulation, p.ub.lished and circulated in said City, and shall be in full force and effect thirty (30) days after its passage.
