is a true and correct copy of an ordinance of said City,
and was introduced at a regular meeting of
the City Council of the City of San Rafael, held on the 19th
day of June 19 78 Published as re-
quired by City Charter in the Independent -Journal ,
a newspaper printed and published in the City of San Rafael
and passed and adopted as an ordinance of said City at a
regular meeting of the City Council of said City
held on the 5th day of July 19 78 by the
following vote, to -wit:

ORDINANCE NO. 1300
AN ORDINANCE OF THE CITY OF SAN RAFAEL
AMENDING ORDINANCE NO. 1268, CODIFIED AS TITLE 4,
CHAPTER 4.08 OF THE MUNICIPAL CODE OF THE CITY OF SAN RAFAEL,
REQUIRING MAINTENANCE OF RECORDS AND TESTING OF UNDERGROUND FLAMMABLE
AND COMBUSTIBLE LIQUID INSTALLATIONS
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. Section 4.08.090, Amendments Made to the Uniform
Fire Code, of the San Rafael Municipal Code, is amended by adding sub-
paragraphs (f) and (g) to Article 15, Section 15.703 of the Uniform
Fire Code, which shall read as follows:
(f) Maintenance of Records. Accurate inventory records shall
be maintained and reconciled daily on all Class I flammable liquid or
Class II or III -A combustible liquid storage tanks for indication of
possible leakage from tanks or piping.
(g) Testing of Underground Tanks and Piping. If loss of
flammable or combustible liquid is evident from the records required
in 15.703(f), or other indicators of a leak exist, the Fire Chief may
order testing to be conducted on suspected tanks and piping.
Such testing shall be in conformance with National Fire
Protection Association, Standard #329 (Underground Leakage of Flammable
or Combustible Liquids). Such tests shall be conducted at the expense
of the owner, lessor, or other party having control over said system.
If the required testing indicates that a leak has occurred
and flammable or combustible liquids are present in the soil and are
deemed by the Fire Chief to constitute a fire hazard, said party having
control shall conduct the necessary mitigation measures, as per N.F.P.A.
Standard #329, at their own expense.
DIVISION 2. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation, printed,
published, and circulated in the City of San Rafael, and shall be in
full force and effect thirty (30) days of its f ':nal passage.

The foregoing Ordinance No. 1300 was read and introduced
at a regular meeting of the City Council of the City of San Rafael,
held on the 19th day of June 1978, and ordered passed to
print by the following vote, to wit:
AYES: COUNCILMEN: Miskimen, Mulryan and Vice -Mayor Jensen
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Nixon and Mayor Bettini
and will come up for adoption as an Ordinance of the City of San Rafael
at a regular meeting of the Council to be held on the 5th day of
July 1978.
