ORDINANCE NO. 1302
AN URGENCY ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING TITLE 3,
CHAPTER 3.20 SECTION 3.20.030 OF THE MUNICIPAL CODE TO PROVIDE
FOR EIGHT (8). PERCENT TAX
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. Title 3, Chapter 3.20, Section 3.20.030 of the San Rafael
Municipal Code is hereby amended and shall read as follows:
3.20.030 Tax Imposed. For the privilege of occupancy in any hotel, each
transient is subject to and shall pay a tax in the amount of eight percent of the rent
charged by the operator. The tax constitutes a debt owed by the transient to the
City which is extinguished only by payment to the operator or to the City. The
transient shall pay the tax to the operator of the hotel at the time the rent is paid.
If the rent is paid in installments, a proportionate share of the tax shall be paid
with each installment. The unpaid tax shall be due upon the transient's ceasing
to occupy space in the hotel. If for any reason the tax due is not paid to the oper-
ator of the hotel, the tax collector may require that such tax shall be paid directly
to him.
DIVISION 2. An urgency ordinance is hereby determined to be valid in that
this tax shall be used to support the police and fire services within the community.
DIVISION 3. If any section, subsection, sentence, clause or phrase of
this Ordinance is for any reason held to be invalid, such decision shall not affect
the validity of the remaining portions of this Ordinance. The Council hereby
declares that it would have adopted the Ordinance and each section, subsection,
sentence, clause, or phrase thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses, or phrases be declared invalid.

The above and foregoing Ordinance No. 1302 was adopted as an
Urgency Ordinance of the City of San Rafael at a special meeting of the
City Council of San Rafael held on the 26th day of June 1978,
by the following vote, to -wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Settini
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: None
