Ordinance No. 1324 entitled:
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING VARIOUS
SECTIONS OF THE SAN RAFAEL MUNICIPAL CODE CONCERNING

and was introduced at a regular meeting of
the City Council of the City of San Rafael, held on the 5th
day of February 19 79 Published as re-
quired by City Charter in the San Rafael Pointer ,
a newspaper printed and published in the City of San Rafael
and passed and adopted as an ordinance of said City at a
regular meeting of the City Council of said City
held on the 20th day of February 19 79 by the
following vote, to -wit:

Noes: Councilmen: None

ORDINANCE NO. 1,324
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING
VARIOUS SECTIONS OF THE SAN RAFAEL MUNICIPAL CODE
CONCERNING ENVIRONMENTAL AND DESIGN REVIEW FOR
RIDGELINES AND ELEVATED DECKS
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. Section 14.08.190 R is hereby amended by adding the following:
"Ridgeline" is a line following the long axis of a ridge, comprised of the
points of highest ground elevation, at a location identified as a "Ridgeline" on
the map entitled "San Rafael Planning Area - Ridgelines" dated January, 1979•
DIVISION 2. Section 14.11.020(6) is amended in full to read as follows:
Section 14.11.020(6) "Physical improvements" as used herein may include,
but are not limited to the following:
(1) The siting and style of single family residences and duplexes when:
(a) located on a lot that does not have frontage on a public street but has
an overall grade of fifteen percent or more; or
(b) a part of a subdivision in which fifteen or more contiguous lots are
proposed to be built by one builder.
(2) Any structure located within one hundred vertical feet of a ridgeline.
(3) Condominiums, townhouses, apartments and any other multi -family
residences.
(4) Offices, commercial and industrial buildings and structures.
(5) Marinas and yacht harbors.
(6) Religious, fraternal, social, cultural, quasi public and similar
buildings and structures.
(7) Land improvements: grading or filling of land, removal of natural
ground cover, vegetation or trees; installation of fences, retaining walls, walk-
ways, sidewalks, curb. (NOTE: See Use Permit requirements under Section 14.74.020g
where the principal use proposed is grading or filling.)
(8) Landscaping: including vegetation, sprinkler system and low level
lighting.
(9) Parking and Loading Areas: driveways, curb cuts or other street
connections.
(10) Signs: when submitted simultaneously with plans for any of the
improvements listed in Section 14.11.02(A).

(11) Painting and Colors: exterior textures and colors on new construction
or the first time existing construction is finished with a color or colored material;
thereafter on repainting and refinishing only if colors not on the approved Earthtone-
Woodtone List are proposed to be used.
(12) Exterior lighting.
(13) Elevated decks for single family or duplex residences when the deck is
higher than three feet above finished grade, except that decks of less than fifty
square feet and decks which are fully cantilevered from a building shall not be
subject to review.
(14) Drainage.
(15) All other exterior ornamental or functional changes.
DIVISION 3. Section 14.82.030(d) is hereby amended to read as follows:
14.82.030(d) Environmental and Design Review
(1) Amendments that do not alter the basic site layout or appearance from
the form approved by the Planning Commission.
(2) Accessory structures or room addition applications required by
Section 14.11.020(B)(2)
(3) Elevated deck applications required by Section 14.11.020(B)(13).
(4) Such other items as the Planning Commission may delegate by Resolution
passed by a majority vote of the entire membership of the Planning Commission.
DIVISION 4. If any section, subsection, sentence, clause, or phrase of
this Ordinance is for any reason held to be invalid, such decision shall not
affect the validity of the remaining portions of this Ordinance. The Council
hereby declares that it would have adopted the Ordinance and each section,
subsection, sentence, clause, or phrase thereof, irrespective of the fact that
any one or more sections, subsections, sentences, clauses, or phrases be declared
invalid.
DIVISION 5. This Ordinance shall be published once in full before its
final passage in the San Rafael Pointer , a newspaper of general circulation
printed, published and circulated in the City of San Rafael, and shall be in full
force and effect thirty (30) days after its final passage.

The foregoing Ordinance No. 1324 was read and introduced at a
regular meeting of the City Council of the City of San Rafael, held
on Monday the fifth day of February 1979, and
ordered passed to print by the following vote, to wit:
AYES: COUNCILMEN: Jensen, Mulryan, Nixon and Mayor Bettini
NOES: COUNC I LMEN : None
ABSENT: COUNCILMEN: Miskimen
and will come up for adoption as an Ordinance of the City of San Rafael at a
regular meeting of the Council to be held on Tuesday the 20th
day of February , 1979.
