ORDINANCE NO. 1329
AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL,
CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE
SAN RAFAEL MUNICIPAL CODE SO AS TO RECLASSIFY CERTAIN REAL PROPERTY
FROM P -C (PLANNED COMMUNITY) DISTRICT TO P -C (PLANNED COMMUNITY)
DISTRICT IN ORDER TO AMEND THE DIASTER PLAN
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. The Zoning Map of the City of San Rafael,
California, adopted by reference by Section 14.15.020 of the
Municipal Code is amended by reclassifying the following described
real property from P -C (Planned Community) District to P -C
(Planned Community) District, in order to amend the blaster Plan.
Said property so reclassified is located south of Lucas Valley
Road and west of Los Gamos Road, and shown as County Assessor's
Parcel 165-010-80, and as shown on Exhibit 1.
DIVISION 2. Any development of this property shall be
subject to the conditions outlined in Exhibit "A" which is
attached hereto and made a part hereof.
DIVISION 3. This Ordinance shall be published once in
full before its final passage in a newspaper of general circulation
printed, published, and circulated in the City of San Rafael, and
shall be in full force and effect thirty (30) days after its final
passage.

EXHIBIT "A"
Conditions which were included as part of the zoning (Z78-24) action
by the Planning Commission on 2-27-79 and City Council 3-19-79:
(a) P -C zoning is hereby established for the property as designated
on the attached map labeled Exhibit 1 and subject to the limitations
imposed by these conditions of approval. The boundary line separating
the residential and office designations shall coincide with the line
approved by s79-3 subdividing the property.
(b) Single family residential use shall be permitted for that portion of
the property identified on the Exhibit as residential. The number
of units to be permitted shall be determined by future use permit
action, but shall be limited to the number which can be developed
on the property without causing significant environmental damage
to the site.
(c) Up to 30,000 square feet gross of office space and related parking
may be constructed on the portion of the site designated for office
use. The amount of building and location shall be established by
future use permit and design review approval, but shall be limited
as necessary to minimize damage to the existing topography and
vegetation.
(d) A use permitshall be required prior to the development of either the
residential parcel or the office parcel. As part of use permit
review, precise development plans shall be submitted for evaluation.
The precise development plans shall include architectural floor plans,
architectural elevations, landscaping concepts plans, preliminary
grading plans and site improvement (parking) plans. The City shall
assess the environmental impacts of the proposed development. If,
as a result of the findings of the Terra Linda Traffic Study or sub-
sequent traffic studies, it is determined that mitigation measures
are required of the proposed project, then the project shall be
required to comply with those mitigation measures.
(e) No more than six single family residences shall be permitted on the
upper five -acre portion of the site.
(f) All residential units approved by subsequent actions of the City of
San Rafael shall be subject to Environmental and Design Review.
The placement of these residences shall be so located as to preserve
the ridgeline and shall be located so as to not infringe on existing
adjacent residences.
