ORDINANCE NO. 1335
AN ORDINANCE AMENDING THE ZONING MAP OF THE
CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE
BY SECTION 14.15.020 OF THE SAN RAFAEL MUNICIPAL CODE
SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM R-3 AND C-2
(MULTIPLE FAMILY RESIDENTIAL AND GENERAL COMMERCIAL) DISTRICTS
TO P -D (PLANNED DEVELOPMENT) DISTRICT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. The Zoning Map of the City of San Rafael,
California, adopted by reference by Section 14.15.020 of the
Municipal Code is amended by reclassifying the following real
property from R-3 and C-2 (Multiple Family Residential and General
Commercial) Districts to P -D (Planned Development) District on
property located at 302 Fourth Street, County Assessor's Parcels
14-092-04, 05, 06, 07, 11, 12, 17, 18, and a ten -foot deep strip
of abandoned right-of-way along the Fourth Street frontage of
Parcel 14-092-11.
DIVISION 2. Any development of this property shall be
subject to the conditions outlined in Exhibit "A" which is attached
hereto and made a part hereof.
DIVISION 3. This Ordinance shall be published once in
full before its final passage in a newspaper of general circulation,
printed, published, and circulated in the City of San Rafael, and
shall be in full force and effect thirty (30) days after its final
passage.
DIVISION 4. If any section, subsection, sentence, clause,
or phrase of this Ordinance is for any reason held to be invalid,
such decision shall not affect the validity of the remaining portions
of this Ordinance. The Council hereby declares that it would have
adopted the Ordinance and each section, subsection, sentence, clause,
or phrase thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses, or phrases be declared
invalid.

The foregoing Ordinance No. 1335 was read and introduced
at a regular meeting of the City Council of the City of San
Rafael, held on the 18th day of June 1979, and ordered
passed to print by the following vote, to wit:
AYES: COUNCILMEMBERS: Jensen, Miskimen and Mayor Mulryan
NOES: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS: Breiner and Nixon
and will come up for adoption as an Ordinance of the City of San
Rafael at a regular meeting of the Council to be held on the
second day of Julv , 1979.

EXHIBIT "A"
Conditions which were included as part of the zoning (Z79-7) action
by the Planning Commission on May 29, 1979:
PLANNING DEPARTMENT
(a) Building shall be relocated eastward as necessary to provide an
additional 3 -foot -wide landscaped strip adjacent to the west
property line.
(b) All existing palm trees shall be preserved and relocated as
necessary to be incorporated into the proposed landscaping.
(c) Use of the structure shall be limited to use for elderly housing
units for moderate income persons.
(d) Each elevator shall be of sufficient size to accommodate a gurney.
POLICE DEPARTMENT
(e) All apartment doors shall be provided single cylinder deadbolts
to Police Department standards and 180° viewers in door.
(f) All windows that can open and provide access to apartments shall
be provided secondary locks.
PUBLIC WORKS DEPARTMENT
(g) An engineered site plan shall be submitted with the application
for the building permit showing all proposed and existing site
characteristics.
(h) All earthwork shall be done under the supervision of a soils
engineer.
(i) A soils engineering report shall be submitted to the City Engineer
which is in response to the Seismic Safety Element of the General Plan.
(j) Finished floor elevation shall be subject to the approval of the
City Engineer.
(k) Applicant shall replace defective curb, gutter and sidewalk as
required by the City Engineer.
(1) All unused driveways shall be replaced with standard curb, gutter
and sidewalk.
(m) Applicant shall improve the curb radius at the corner of Mission
and Union as directed by the City Engineer.
(n) Applicant shall construct wheel chair ramps at both corners.
