Ordinance No. 1286 entitled:
AN ORDINANCE OF THE CITY OF SAN RAFAEL PROVIDING FOR COST
OF LIVING INCREASE FOR CITY COUNCIL
is a true and correct copy of an ordinance of said City,
and was introduced at a regular meeting of
the City Council of the City of San Rafael, held on the 19th
day of December 19 77 . Published as re-
quired by City Charter in the Independent -Journal ,
a newspaper printed and published in the City of San Rafael
and passed and adopted as an ordinance of said City at a
regular meeting of the City Council of said City
held on the 3rd day of January 1978 by the
following vote, to -wit:
Ayes: Councilmen: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini
Noes: Councilmen: None
Absent: Councilmen: None

ORDINANCE NO. 1286
AN ORDINANCE OF THE CITY OF SAN RAFAEL
PROVIDING FOR COST OF LIVING INCREASE
FOR CITY COUNCIL
THE COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS:
DIVISION 1 . Section 36516.2 of the California Government Code,
enacted in 1972, provides that the compensation of councilmen and mayor may
be increased beyond the amount provided in Section 36516 of the Government
Code by an Ordinance on an amount equal to 5% for each calendar year from the
operative date of the last adjustment of the salary in effect when the Ordinance
or amendment thereto is enacted. The previous salary adjustment was effective
in July 1976 in the amount of $391 per month for the mayor and $262 per month
for each councilman.
D I V I S 10 N 2. As of the effective date of this Ordinance each
councilman and the mayor shall receive in addition to his regular compensation
of $391 per month for the Mayor and $262 per month for each Councilman, a sum (
equal to 6.8% of that amount. Said increase shall be paid in the same manner as
paid to other officers and employees of the City of San Rafael.
D I V I S ION 3 . Nothing contained herein shall be construed to provide
for any automatic future increase in salary pursuant to Section 36516.2; however,
this provision shall not invalidate Section 4 of Ordinance No. 878 which does
providg for automatic increase pursuant to population growth as set forth in Govern-
ment Code section 36516.
D I V I S I ON 4. If any section, subsection, sentence, clause or phrase
of this Ordinance is for any reason held to be invalid, such decision shall not
affect the validity of the remaining portions of this ordinance. The Council hereby
declares that it would have adopted the ordinance and each section, subsection,
sentence, clause or phrase thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses or phrases be declared invalid.
DIV IS I ON 5 . This Ordinance shall be published once in full before
its final passage in the Independent -Journal a newspaper of general circulation,
printed, published and circulated in the City of San Rafael, and shall be in full
force and effect thirty (30) days after its final passage.

The above and foregoing Ordinance No. 1286 was read and introduced
at a regular meeting of the Council of the City of San Rafael, held on the 19th
day of December 1977, and ordered passed to print by the following vote,
to wit:
AYES: COUNCILMEN: Jensen, Mul ryan, Nixon and Mayor Betti ni
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Miski men
and will come up for adoption as an ordinance of the City of San Rafael at a
regular meeting of the Council to be held on the 3rd day of January ,
1978.
