is a true and correct copy of an ordinance of said City,
and was introduced at a regular meeting of
the City Council of the City of San Rafael, held on the 6th

and passed and adopted as an ordinance of said City at a
regular meeting of the City Council of said City

ORDINANCE NO. 1291
AN URGENCY ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL
CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL
CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO DESIGNATE CERTAIN REAL PROPERTIES
WITH A DRD (DOWNTOWN REVIEW DISTRICT) OVERLAY ZONE
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. The Zoning Map of the City of San Rafael,
California, adopted by reference by Section 14.15.020 of the Municipal
Code, is amended by combining the existing zoning of the following -
described real properties with a DRD (Downtown Review District) over-
lay zone:
Parcels comprising building sites fronting on
both sides of Fourth Street between Lootens Place
and Hetherton Street, more particularly Assessors
Parcels 11-224-10 thru 18; 11-227-03 thru 07;
11-271-01 thru 07; 11-273-01, 02, 04, 05, 06,
19 and 21; 11-275-01, 02 and 03; 11-277-01;
14-084-09 and 12; 14-121-01, 07, 08, and 11.
Containing 5.73 acres, more or less.
DIVISION 2. This Ordinance is an Urgency Ordinance for the
needed preservation of the public peace, health, or safety within the
meaning of Government Code Section 25123 and shall go into effect im-
mediately. The facts constituting such necessity are: The existing
Downtown District extends from "D" Street to Lootens Place along
Fourth Street. A logical extension of the District would incorporate
the area from Lootens Place to Hetherton Street along Fourth Street;
moreover, such extension would integrate the full extent of the com-
mercial or business -oriented portion of Fourth Street into the Down-
town District. The merchants within the District will only participate
in the Beautification Program if the implementation of the Program is
imminent. The City's economic basis is largely founded on the sales
tax, and a significant portion of that sales tax is derived from the
sales of businesses located in the Downtown District. Therefore,
the inclusion of the additional area along Fourth Street from Lootens
Pace is necessary, as well as early implementation, for the Program's
success.

DIVISION 3. If any section, subsection, sentence, clause,
or phrase of this Ordinance is for any reason held to be invalid,
such decision shall not affect the validity of the remaining portions
of this Ordinance. The Council hereby declares that it would have
adopted the Ordinance and each section, subsection, sentence, clause,
or phrase thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses, or phrases be declared
invalid.

The above and foregoing Ordinance No. 1291 was adopted as
an Urgency Ordinance of the City of San Rafael at a regular meeting
of the City Council of San Rafael held on the sixth day of February ,
1978, by the following vote, to wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan and Mayor Bettini
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Nixon
