ORDINANCE NO. 1207
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING
SAN RAFAEL MUNICIPAL CODE SUBSECTION 10.040.050 (P) PEDDLER
AND AMENDING CHAPTER 10.48 THEREOF
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. Subsection 10.040.050 (P) Peddler of the Municipal
Code of the City of San Rafael is hereby amended and shall read as follows:
"See Municipal Code Section 10.48.030."
DIVISION 2. Chapter 10.48.of the Municipal Code of the City
of San Rafael is hereby amended and shall read as follows:
Chapter 10.48
PEDDLERS AND SOLICITORS
10.48.010 Definitions.
10.48.020 Peddling and Soliciting Without
Invitation Prohibited.
10.48.030 License and Permit Fees.
10.48.010 Definitions. Words and phrases not specifically
defined herein shall be construed according to the context and approved
usage of the language. As used in this Chapter, "peddler" or "solicitor"
means any person going from place to place or along the streets or doing
business at any place other than in a fixed place of business; selling,
taking orders for, or soliciting orders for goods, wares, or merchan-
dise for present or future delivery.
10.48.020 Peddling and Soliciting Without Invitation Prohibited.
The practice of going in and upon private, residential, or commercial
premises, or upon public streets, in the City by solicitors, peddlers,
hawkers, itinerant merchants and transient vendors of merchandise where
and when such persons have not been requested or invited to do so by the
owner, owners, occupant, or occupants of said private, residential, or
commercial premises, for the purpose of soliciting orders for the sale
of goods, wares, and merchandise, and/or for the purpose of peddling or
hawking the same, is prohibited, declared to be a nuisance, and punish-
able as a misdemeanor.
No solicitor, peddler, hawker, itinerant merchant, or tran-
sient vendor shall go upon or be within any private, residential, or
commercial premises, or upon public streets, in the City for the pur-
pose of practicing his said business or profession, without first being
expressly invited or requested to do so by the owner or occupant thereof.

10.48.030 License and Permit Fees. Every solicitor,
peddler, hawker, itinerant merchant, or transient vendor who goes
upon or within any private residential or commercial premises in
the City for the purpose of practicing his said business or pro-
fession, with an express invitation or request to do so by the owner
or occupant thereof, shall pay to the City an annual fee (not prorated
or any part refundable) for each hereafter as indicated:
Basic Fee: $40.00 per year annually - plus:
Employees: $ 5.00 per employee ..... 1 through 10
plus $3.00 per employee ..... 11 through 40
plus $2.00 per employee ..... in excess of 40
DIVISION 3. If any section, subsection, sentence, clause
or phrase of this Ordinance is for any reason held to be invalid, such
decision shall not affect the validity of the remaining portions of
this Ordinance. The Council hereby declares that it would have adopted
the Ordinance and each section, subsection, sentence, clause or phrase
thereof, irrespective of the fact that any one or more sections, sub-
sections, sentences, clauses or phrases be declared invalid.
DIVISION 4. This Ordinance shall be published once in full
before its final passage in the Independent Journal , a newspaper of
general circulation, printed, published, and circulated in the City of
San Rafael, and shall be in full force and effect thirty (30) days after
its final passage.

and introduced at a regular meeting of the City Council of the
City of San Rafael, held on the 15th day of December , 1975,
and ordered passed to print by the following vote, to -wit;

and will come up for adoption as an Ordinance of the
