ORDINANCE NO. 1232
AN URGENCY ORDINANCE OF THE CITY OF SAN RAFAEL
AMENDING CHAPTER 2.32 OF THE SAN RAFAEL MUNICIPAL CODE
BY ADDING A NEW SECTION 2.32.050 THERETO, RELOCATION APPEALS BOARD
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. Chapter 2.32, Redevelopment Agency, of the
San Rafael Municipal Code is amended by adding a new section there-
to, which shall read as follows:
2.32.050 Relocation Appeals Board
2.32.051 Membership and Compensation
2.32.052 Term of Office and Removal
2.32.053 Powers and Duties
2.32.050 Relocation Appeals Board. A Relocation Appeals
Board is hereby created.
2.32.051 Membership and Compensation. The Relocation
Appeals Board shall consist of five Members appointed by the Mayor
and approved by the City Council. The Members of the Relocation
Appeals Board shall serve without compensation, but each of the
Members shall be reimbursed for his necessary expenses incurred
in performance of his duties, as determined by the City Council.
2.32.052 Term of Office and Removal. The Members of the
Relocation Appeals Board shall serve for a term of four years and
shall be subject to removal by the affirmative vote of three
Members of the Council. The term of office for the Members of the
Board shall be staggered in the manner provided by Resolution of
the City Council.
2.32.053 Powers and Duties. The Board shall, within
twenty days, hear all complaints brought by residents of the
various project areas relating to relocation and shall determine
if the Redevelopment Agency has complied with the provisions of
Chapter 4, Community Redevelopment Law, entitled "Redevelopment
Procedures and Activities" commencing with Health and Safety Codes
Section 33300, and Federal regulations. The Board shall conduct a
Public Hearing and thereafter transmit its findings and recommenda-
tions to the Redevelopment Agency within fifteen days.

DIVISION 2. This Ordinance is an Urgency Ordinance for
immediate preservation of the public peace, health or safety within
the meaning.of Government Code Section 25123 and shall go into
effect immediately. The facts constituting such necessity are:
a grievance has arisen out of the relocation of a Redevelopment
tenant which needs immediate disposition; and as a result of in-
creased activity within the Redevelopment Agency, the implementation
of a procedure handling these potential grievances is needed
immediately.
DIVISION 3. If any section, subsection, sentence, clause,
or phrase of this Ordinance is for any reason held to be invalid,
such decision shall not affect the validity of the remaining portions
of this Ordinance. The Council hereby declares that it would have
adopted the Ordinance and each section, subsection, sentence, clause,
or phrase thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses, or phrases be declared
invalid.

The above and foregoing Ordinance No. 1232 was adopted
as an Urgency Ordinance of the City of San Rafael at a regular meeting
of the City Council of San Rafael held on the 6th day of July
1976, by the following vote, to wit:
