ORDINANCE NO. 1235
AN ORDINANCE OF THE CITY OF SAN RAFAEL
AMENDING VARIOUS SECTIONS OF THE MUNICIPAL CODE
TO PERMIT THE ESTABLISHMENT OF FEES, SERVICE CHARGES
AND TAXES BY RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
D I V I S 10 N 1 . Title 1, Chapter 4 of the Municipal Code of the City of
San Rafael is hereby amended by adding thereto Section 1. 04.015 which shall read
as follows:
Section 1. 04.015 Fees. It is the policy of the San Rafael City Council that
all fees listed within the Municipal Code shall be established by resolution of the
City Council.
D I V I S 10 N 2 . Section 1. 12.011 of the Municipal Code of the City of
San Rafael is hereby repealed. A new Section 1.12.011 is substituted, which shall
read as follows:
Section 1.12.011 Disposal of unclaimed property in possession of police
department. When the police department has in its possession any personal property,
the ownership of which is unknown, the department shall retain the property in its
possession for a minimum period of three months from the date on which it came into
possession of the department, during which time the members of the department shall
make reasonable effort to ascertain the identity of the owner thereof, and, should the
identity and address of such owner be ascertained, shall give notice to such owner by
registered mail, of the fact that the property is in the possession of the department,
and that the owner, upon satisfactorily identifying himself and his ownership, will be
entitled to receive the property. If, during the three months period, the department
is unable to ascertain the name and address of the owner of such property, and no person
or persons make claims thereto and prove their ownership, then the chief of police shall
cause such property to be sold, at public auction, to the highest bidder, for cash, after
having first given notice of the time and place of such sale, for a minimum period of
ten days before the time fixed therefor, by publication in the San Rafael Independent
journal, a newspaper of general circulation published in the county of Marin, state of
California. Such notice shall generally describe each specific item of property to be
sold. The cost of such publication shall be a proper charge against the city, and the
proceeds from the sale shall be deposited by the chief of police with the city treasurer
as a miscellaneous receipt.
D I V I S 10 N 3 . Title 3, Chapter 3.2 6 of the Municipal Code of the City of
San Rafael is hereby amended by adding thereto Section 3.26.051 which shall read
as follows:
Section 3.26.051 Property Development Excise Tax. The Property Development
Excise Tax shall be established by resolution of the San Rafael City Council.

D I V I S 10 N 4 . Title 10, Chapter 10.60 of the Municipal Code of the City of
San Rafael is hereby modified by deleting the last sentence from Section 10.60. 120.
DIVISION 5 . Title 10, Chapter 10.60 of the Municipal Code of the City
of San Rafael is hereby amended by adding thereto Section 10.60. 121 which shall read
as follows:
Section 10.60. 121 Application fee. An application fee shall be established
by resolution of the San Rafael City Council.
DIVISION 6. Title 10, Chapter 10.80 of the Municipal Code of the City
of San Rafael is hereby amended by adding thereto Section 10.80.061 which shall read
as follows:
Section 10.80.061 Investiqation of application fee. A fee for background
investigation of private patrol employees shall be set by resolution of the San Rafael
City Council.
D I V I S 10 N 7 . Title 10, Chapter 10.84 of the Municipal Code of the City
of San Rafael is hereby amended by adding thereto Section 10.84.081 which shall read
as follows:
Section 10. 84.081 Investiqation fee. A fee for background investigation of
tow truck drivers and operators shall be set by resolution of the San Rafael City Council.
DIVISION 8 . If any section, sub -section, sentence, clause, or phrase
of this Ordinance is for any reason held to be invalid, such decision shall not affect
the validity of the remaining portions of this Ordinance. The Council hereby declares
that it would have adopted the Ordinance and each section, sub -section, sentence,
clause, or phrase thereof, irrespective of the fact that any one or more sections, sub-
sections, sentences, clauses, or phrases be declared invalid.
D I V I S ION' 9 . This Ordinance shall be published once in full before its
final passage in the San Rafael Pointer , a newspaper of general circulation,
printed, published, and circulated in the City of San Rafael, and shall be in full force
and effect thirty (30) days after its final passage.

a rPaular meeting of the City Council of the City of San Rafael, held on the 2nd
day of August , 1976, and ordered passed to print by the following vote, to wit:
AYES: COUNCILMEN: Miskimen, Nixon and Mayor Bettini
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Jensen and Mulryan
and will come up for adoption as an Ordinance of the City of San Rafael at a
regular meeting of the Council to be held on the 16th day of August
1976.
