DANIEL BOWLING OF CURTIS AND BOWLING MEDIATION FOR A TOTAL COMPENSATION AMOUNT NOT TO EXCEED $50,000 RECOMMENDATION: Adopt Resolution authorizing the City Manager to enter into an amended agreement with Curtis and Bowling Mediation to provide consulting services to the City to address the challenges from chronic inebriates in downtown San Rafael. BACKGROUND: In Marin County, as in many counties around the country, there is a growing concern with spending on certain high -need individuals, including those who frequently encounter the criminal justice system as a result of alcohol abuse. These individuals tend to continually cycle through some of the most expensive public service providers, yet do not receive appropriate care to meet their complex needs. As a result, they can exhaust thousands of dollars in public resources, with little or no improvement in their quality of life. In January 2012, a collaborative effort, introduced by Marin County Deputy Public Defender Christine O'Hanlon, was established resulting in the Department of Health and Human Services commissioning a Study to evaluate the current system of care in Marin, investigate the public cost of serving homeless, alcohol dependent persons with complex health and mental health conditions, and identifying recommendations to better and more cost effectively serve this population. The Chronic Alcohol Use with Justice -System Involvement (CAJI) Report was subsequently developed by HomeBase. Results of this cost study found that "between June 1, 2011 and May 31, 2012, thirty-four (34) individuals in the County of Marin incurred a cost of $2,039,463 for services related to homelessness FOR CITY CLERK ONLY File No.: 4-3-603E Council Meeting: 07/05/2016 Disposition: Resolution 14154 SAN RAFAEL CITY COUNCIL AGENDA REPORT / Paae: 2 and chronic addiction to alcohol. Actual costs are most likely much greater. The vast majority of these individuals were male, 91 percent were homeless, and the average age was 47. In addition, despite expenditures of $60,000 per person per year, there is little to no improvement in the quality of life for these individuals." There continues to be a negative community impact from alcohol -addicted, chronically homeless individuals in downtown San Rafael specifically. In effort to assist with this seemingly intractable challenge, the City engaged Daniel Bowling with Curtis and Bowling Mediation. Beginning in November 2015, City officials have been working with Mr. Bowling in a facilitated problem -solving process as part of their efforts to address this issue. A Working Group composed of Mayor Gary Phillips, Councilmember Kate Colin, City Attorney Rob Epstein, Police Chief Diana Bishop, Fire Chief Chris Gray, City Manager Jim Schutz, and Director of Homeless Planning and Outreach Andrew Hening has met several times to discuss the information gathered through interviews of involved County and City officials by facilitator Daniel Bowling. ANALYSIS: Through his interviewing process with both County and City officials, Mr. Bowling has developed significant insights and findings. Staff is recommending amending the original contract of $20,000 to an amended contract not to exceed a total of $50,000. This provides for the current phases of the agreement, including information gathering and process design. The next phase, which is not a part of the action recommended in this staff report, would get into implementation which would build off of the findings of the above work. Mr. Bowling has prepared a draft scope of services for this future stage. Because a significant portion of the ongoing work involves a variety of Departments at the County of Marin, including Health and Human Services, Probation, the court system, and the Sheriff's Office, County staff is discussing working directly with Mr. Bowling on the draft scope of services and next steps. FISCAL IMPACT: Initial costs are being funded in fiscal year 2015-2016 by the City's General Fund. There are sufficient funds in the fiscal year 2016-2017 General Fund operating budget to support the amended agreement for a total contract not -to -exceed $50,000. OPTIONS: 1) Adopt the Resolution authorizing the City Manager to enter into an amended agreement with G. Daniel Bowling of Curtis and Bowling Mediation, in a form to be approved by the City Attorney. 2) Request changes to the Resolution. 3) Reject the Resolution. RECOMMENDED ACTION: Adopt Resolution RESOLUTION NO. 14154 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL AUTHORIZING THE CITY MANAGER TO AMEND THE AGREEMENT FOR SERVICES WITH G. DANIEL BOWLING OF CURTIS AND BOWLING MEDIATION FOR A TOTAL COMPENSATION AMOUNT NOT TO EXCEED $50,000 WHEREAS, the San Rafael City Council is committed to addressing the problems and impacts of chronic inebriates on the downtown areas of San Rafael; and WHEREAS, in furtherance of that end, on November 13, 2015, the City entered into an "Agreement for Professional Services Regarding Chronic Inebriates in San Rafael" ("Agreement") with G. Daniel Bowling of Curtis and Bowling Mediation, for investigative and facilitation services in bringing stakeholders together to find solutions to the problems and impacts of chronic inebriates on the downtown areas of San Rafael; and WHEREAS, the Council finds that it is necessary and appropriate to increase the budget for Mr. Bowling's work to complete all the services desired under the Agreement. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael hereby approves and authorizes the City Manager to execute an amendment to the Agreement, in a form to be approved by the City Attorney, to increase the total compensation payable under the Agreement to a not -to -exceed amount of $50,000. DANIEL BOWLING, a partner of Curtis and Bowling Mediation (hereinafter "CONTRACTOR"). RECITALS WHEREAS, the CITY and CONTRACTOR entered into that certain "Agreement for Professional Services Regarding Chronic Inebriates in San Rafael" dated November 13, 2015 (the "2015 Agreement"), pursuant to which CONTRACTOR has provided investigative and facilitation services in bringing stakeholders together to find solutions to the problems and impacts of chronic inebriates on the downtown areas of San Rafael; and WHEREAS, the parties have determined that it is necessary and appropriate to increase the budget for CONTRACTOR's work to enable him to complete the desired services under the 2015 Agreement; NOW, THEREFORE, the parties hereby amend the Agreement as follows: 1. Section 4 of the 2015 Agreement is hereby amended to read in its entirety as follows: 4. COMPENSATION. For the full performance of the services described herein by CONTRACTOR, CITY shall pay CONTRACTOR at the rate of $375 per hour for his services, and reimburse CONTRACTOR for his reasonable expenses incurred in performing these services, in a total amount not to exceed $50,000. Payment will be made monthly upon receipt by PROJECT MANAGER of itemized invoices submitted by CONTRACTOR. 2. Except as specifically amended herein, the terms of the 2015 Agreement shall remain unchanged and in full force.
