APPROVAL OF MINUTES OF REGULAR MEETING OF JULY 2, 1990 (CC) - File 1-4 Councilmember Breiner referred to page 3, under Item 5, in the last paragraph, stating that it was her understanding that the minutes of the meeting of June 18th had been amended to state that nothing was to be brought in on that site (Marin Ranch Airport) unless it was checked specifically by the City staff. She asked these minutes be amended to reflect that, and clarify the matter. Councilmember Breiner moved and Councilmember Shippey seconded, to approve the minutes of the regular meeting of July 2, 1990, as amended. Mayor Mulryan presented the Resolution of Appreciation to San Rafael High School Basket- ball Team Representative, Coach Bret Tovani. PRESENTATION OF PROCLAMATION - File 110 b. Mayor Mulryan presented a Proclamation to Provost Dennis Goldie of Falkirk, Scotland, proclaiming July 16, 1990 as Falkirk, Scotland Day in San Rafael. 10. PUBLIC HEARING - GPA 90-3 - REVISED DRAFT HOUSING ELEMENT (P1) - File 115 x 13-16 Mayor Mulryan declared the Public Hearing opened. Planning Director Pendoley informed the Council that staff, assisted by Consultant Jeff Baird, had revised the Housing Element of the General Plan, stating that the update is primarily a "fine tuning" of existing policies and programs in the Housing Element to comply with the State law requirements. He noted that according to a 1989 Bay Area Council Survey San Rafael was one of only 10 cities in the Bay Area to come within 50% of meeting its lower income housing need between 1980 and 1990. He noted that the Draft Housing Element establishes new targets for the 1988/1995 time period to meeting housing needs. He added that San Rafael's Housing Element was revised in 1988 as part of the overall San Rafael General Plan revision, and that the Housing Element had been accepted by the State Housing and Community Development as complying with State law, with the addition of information clarifying the amount of available high density vacant land and expanding the description of the City's Fair Housing Program. Mr. Pendoley then highlighted the changes in the Draft document, new policies covering rental BMR (Below Market Rate) units, consideration of "in -lieu" fees for nonresidential projects, and policies recommended by the Residential Care Facilities Task Force, clarifi- cation of policies for Housing Opportunity Areas, and the minor editing and clarification of a number of policies. Mr. Pendoley referred the Council to the Background Section of the staff report, for further details and clarification of the revisions and updating. Councilmember Thayer stated that she noticed that the percentages, when figuring the amount of BMR units in a project, always go to the lower side, and she recommended that any differ- ence in such cases by made up by charging in -lieu fees. Mr. Pendoley responded that is a very important point, and noted that in recent approvals if there was a one-half differen- tial staff has been asking for the higher number. Councilmember Shippey noted that staff was considering increasing minimum requirements for proportion of BMR units. He added, that is not being done here, and asked about the SRCC MINUTES (Regular) 7/16/90 Page 2 SRCC MINUTES (Regular) '16/90 Page 3 procedures to be taken. Mr. Pendoley responded that staff would be bringing back implement- ing ordinances and programs. He noted that this simply outlines it, and gives direction to staff to prepare the actual implementation programs for the Council's approval. Councilmember Breiner remarked that the City probably has a fair number of illegal second units, and wondered if the group had ever discussed ways for people to bring those units up to code. Mr. Pendoley stated they had not, but it is probably something which should be looked into. Mayor Mulryan inquired if Councilmember Breiner's intention was toward "grandfathering" such units, and she responded that was not her intention, but she had in mind people finding out in a confidential manner about such units, and tell where they are, so they could be inspected for safety since many of the illegal units would otherwise not be improved. She asked that staff discuss ways this could be done. Mr. Pendoley stated he will report back within the next couple of months on the pros and cons of such a program. Councilmember Shippey inquired if this would be with a view to abate the units, and Council - member Breiner stated that was not her intention, but if there is a way that some of the units which are illegal could be made legal it would improve the housing stock. She noted that we have a second dwelling unit Ordinance to use as criteria. Councilmember Thayer suggested that perhaps realtors would cooperate in this regard, when they handle a property for sale which has a second unit. Erwin Williams, President of the San Rafael Housing Corporation, urged the Council to adopt the Housing Element tonight. He noted that within the City two potential housing sites have recently been lost, and someone should seriously consider replacing them. Victoria DeWitt of the West End Neighborhood Association urged that the City use the census figures which will be available in January. She also noted that 46% of the people in emer- gency shelters are not Marin County residents, and that San Rafael does not have to solve the County's problems. Doris Law Bagley, who serves on the Winter Shelter Advisory Committee for the homeless, stated that her group was appointed by the Board of Supervisors to take care of the homeless at the Armory last year, and they will be doing it again this coming Winter. She stated the program at the Armory had no adverse affect on the residents of Santa Venetia. Mayor Mulryan noted that the homeless people were being taken by bus to San Rafael and dropped off on Fourth Street, and have created quite a problem Downtown. Ms. Bagley respond- ed that it was more the patrons of the St. Vincent de Paul dining room than the people from the Armory who were causing problems. Ms. Bagley referred to a report from the Winter Shelter Advisory Committee dated June 4, 1990, to the Board of Supervisors, in which one recommendation was that the Board of Supervisors, Mayors, City Councilmembers and City Planners meet jointly to recommend speci- fic shelter sites. She also referred to a lawsuit filed against the City of Adelante for its alleged discrimination against the Fair Housing Amendments Act of 1988 and its accom- panying regulations. She urged the Council to revise the Zoning Ordinance so that it is consistent with the Fair Housing Act, and have special use permits for emergency shelters during the Summer when the Armory is closed. Mary Amander, who owns a shop two doors down from the corner of Fourth and "B" Streets, told the Council of her problems regarding the homeless people loitering around her store, and leaving it very dirty. She stated that women have a right to have a pleasant time shopping and many of her customers were accosted and panhandled. They would, under these circumstances, rather go to a shopping center. Harry Winters of the West End area, supported the use of conditional use permits, with separate types of use permits for commercial than for residential areas. He added that the neighbors are concerned that if a shelter is permitted at the church in his neighbor- hood, when people would come to it and find there was no more room they would not leave the neighborhood. Mayor Mulryan asked for a staff recommendation, and Mr. Pendoley stated that the problem with a master use permit is, for instance, if several churches want to have shelters on a rotating basis. He added that the Residential Task Force Committee recommended that one use permit be required for that program; however, if you are going to do that you must administer it the same as any other use permits, which means that a public hearing must be held and all property owners within at least 300 feet of all facilities must receive a notice. Mayor Mulryan clarified that all applicants would be heard, probably five, and it would be in a joint public hearing. Mr. Pendoley stated that the advantage of a master program is that it is possible to get a better coordinated service not only for the clients, but for the neighborhoods. He noted that, under current procedures, depending on how far apart the facilities were, it could mean as many as five neighborhood meetings would need to be held before the public hearing before the Council. SRCC MINUTES (Regular) 7/16/90 Page 3 SRCC MINUTES (Regular) -116/90 Page 4 Elizabeth Hanson, who co-chairs the Winter Shelter Advisory Committee with Doris Bagley, stated that she would like to see the site selection and standards for emergency shelters, as recommended by the Residential Care Facilities Task Force, incorporated into the Housing Element. She stated that the City of Los Angeles has adopted a Zoning Ordinance which authorizies the establishment of emergency shelters by right, and not by use permits, in high density residential and commercial zones. She said she would like San Rafael to adopt a similar Ordinance, rather than go with the conditional use permits. She said the present standards are too stringent and restrictive, citing that one parking space is required for every five beds, considering that the homeless people do not have many cars. She concluded by quoting from the State Housing & Community Development Housing Element requirements: "The general use and site zoning must permit development of, conversion to, or use of, a shelter or transitional housing without undue special regulatory approval, and parking requirements, fire regulations, and design standards will not preclude the use of the site." Alex Diefenbach, project manager for the Ecumenical Association for Housing, briefed a letter dated July 16, 1990, which included a number of suggestions regarding the Housing Element, also stating that staff and the consultant have done a very fine job in updating the Element. The first item he mentioned was, under "Housing Goals", H -A, noting that this goal calls on the City to "Encourage provision of a habitable dwelling for every City resident". He said they feel this language is not strong enough, and the word "promote" should be used instead of "encourage". Regarding New Market Rate (NMR) and Below Market Rate (BMR) Housing, Policy H -19/H-20, Mr. Diefenbach recommended rephrasing Policy H-19 to give equal weight to the option of donating a portion of the property for the construc- tion of affordable housing by a nonprofit entity. He noted that in this way rental units would be guaranteed affordable in perpetuity. Regarding Policy H-20, Mr. Diefenbach recommended establishing a sliding scale for fee waiver/reduction giving greater relief to those projects which provide a higher percentage of low and moderate income units. Under Housing Opportunity Areas, H-38, Mr. Diefenbach recommended that since the density increase is effective in perpetuity, the affordability restrictions should also be in perpetuity. Under H -b, in Implementing Programs, he suggested that under possible sources of income there should be a directive to investigate additional sources of income. Under Existing Housing Conservation Actions, he recommended changes in wording to H -r, H -t and H -aa, including adding language about accessibility to all units so that mobility impaired people could visit their friends' homes. Under H-jj, he recommended putting in a specific target date of 1991 because San Rafael already has an excess of employment relative to housing. Mr. Diefenbach then made suggestions for issues not included in the Housing Element: 1) Provide incentives for mixed-use projects; 2) Make City -owned parking lots available for the creation of affordable housing over them; and 3) Explore mechanisms for raising revenues for the Housing Fund. Dirk Brinckerhoff, on behalf of the San Rafael Chamber of Commerce stated that the Chamber realizes the need for more affordable housing, and has had their task force working for a number of months. He stated it is very important that the City get back two sites to make up for the ones which were lost. He applauded the City's commitment to affordable housing, and urged adoption of the Housing Element as presented tonight. Aileen Taylor informed the Council that she had been a member of the Winter Shelter Advisory Committee, and is also an elder of the First Presbyterian Church at Fifth and E, which has been used in the past as an emergency shelter. She said she applauds most of the Housing Element, but it is not adequate in carrying out its new assignment regarding the homeless in our midst. She stated this is a serious situation which we face, and it will not go away. She stated that instead of giving every neighborhood association veto power over the City's decisions, the City should assume a leadership role regarding the Housing Element. She also repeated the previous views, that there had been no problems in Santa Venetia as a result of the Armory use. She stated there was never a single complaint when they operated Harbor House. She noted that at least 25% and possibly 50% of the people at the Armory were chronically mentally ill. She added that she has never once been accosted by any homeless in Downtown San Rafael. Jeff Mulanax of the Montecito Neighborhood Association stated he agrees with the West End neighbors that the City should use the census figures. He stated that San Rafael has become a magnet, and that this should be a County issue and the County should take a leader- ship role in what happens to the homeless. He stated that an EIR should be done. Mayor Mulryan noted that the City is doing its best to create a balance, and added that he appreciates everyone's interest and concern. He then closed the Public Hearing and called for Council discussion. SRCC MINUTES (Regular) 7/16/90 Page 4 SRCC MINUTES (Regular, 7/16/90 Page 5 Councilmember Shippey remarked that several speakers noted the loss of housing opportunity due to the new library site. He pointed out that this is not a guaranteed acquisition, and if it does not go through the property would be available for housing. Also, in the library plans there is a possibility of housing. He then inquired of the City Attorney whether the churches must have a use permit. City Attorney Ragghianti responded that on temporary use of church property there is no reason to not have a use permit for churches. He stated he does not believe that would be in conflict with the State Housing Act. Councilmember Thayer stated that the amendments to the Fair Housing Act preclude constraint! which would be imposed on a neighborhood. She added that with reference to the disabled, this could also be alcohol and drug abusers, and that there is no court case which states the City cannot require a use permit for this type of facility. Councilmember Breiner stated that a number of suggestions from the Ecumenical Association for Housing (EAH) were significant, and she would like staff to come back and see if H-20 regarding the fee waiver/reduction is feasible. She added she would like to see some more specific possible approaches with regard to giving some relief to some projects, because some will provide a higher percentage of low and moderate income units and they should have a larger fee reduction or waiver. Councilmember Breiner also mentioned H -aa on page 12, regarding accessible units for the physically disabled, and she would like to see wording where the City would require accessible units in all projects of four units or more. She stated that it should be possible to consider this in the design, taking into consideration that some of the housing units will, of course, be upstairs. Mr. Pendoley responded that he would suggest, on H -aa, that if the rewording is required a study be done on this issue, because it would be very difficult for staff to tell right now what the impact would be. He stated that, on the sliding scale as suggested on page 20, he does not think it is inconsistent with the direction which the Planning Commission gave staff. However, the particulars should be subject to an implementation study, rather than to be made an explicit policy. Councilmember Breiner asked staff to incorporate suggestions as implementation programs on the following: H-20 - Establish program for a "sliding scale" for fee waiver/reduction. Need more specific types of approaches in terms of giving relief to some projects which provide a higher percentage of low and moderate income units. Staff to review all suggestions from EAH. H -aa - Accessible Units for the Physically Disabled. Wants wording changed where the City will require accessible units in all projects of 4 units or more. Suggested the City needs analysis of the types of housing units which should be built in the future in order to have rental available to families rather than one or two persons. Councilmember Breiner stated that in the background material, on page 23, it states that San Rafael evidently had a smaller proportion of units with more than three rooms and a larger proportion of units with less than three rooms, and that the demand for larger rental units is increasing at a faster rate. She recommended an analysis of the types of housing units we need to have built in the future in order to have rental available to families rather than for just one or two persons. Councilmember Breiner also suggested that H-kk be added on page 14, where evaluation of types of houses needed to maintain a diverse community would be addressed, such as a design where some room could be designed to later become a second dwelling unit when the family is smaller. She added this could be an item which would be part of the implementation in the long term. City Manager Nicolai recommended that this could be part of Program H-gg. Councilmember Thayer agreed that some of the EAH recommendations, particularly regarding H-19, are worth considering. Councilmember Breiner moved and Councilmember Shippey seconded, to certify the Negative Declaration and approve the revised Housing Element. RESOLUTION NO. 8207 - CERTIFYING A NEGATIVE DECLARATION AND ADOPTING A REVISED SAN RAFAEL GENERAL PLAN 2000 HOUSING ELEMENT (GPA 90-3) AYES: COUNCILMEMBERS: Breiner, Shippey, Thayer & Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Boro 11. REPORT ON PROS AND CONS OF CITY TAKING OVER REGULATORY AUTHORITY FROM THE STATE RE MOBILE - HOME PARKS (CA) - File 13-7-1 x 13-16 City Attorney Ragghianti informed the Council that at the July 2, 1990 meeting he had reported briefly on the acquisition of Contempo Marin Mobilehome Park by the Homeowners Corporation. He had also pointed out that the Homeowners Association was also interested in the City's position with regard to assuming regulatory authority over the mobilehome SRCC MINUTES (Regular) 7/16/90 Page 5 SRCC MINUTES (Regular) '16/90 Page 6 park. He stated he had looked at the Health and Safety Code and found that Section 18300(b) permits the City, if it wishes, to adopt a Resolution requesting that regulatory authority be returned to the City for the enforcement of health and safety matters. He stated that the important question to answer is what, exactly, would the City be doing if it adopted this resolution, whch it is not doing now. He stated the chief issue would be inspection of health and safety measures, fire -related, water, sewer, plumbing, etc. He added that the City has always had, despite the adoption by the State of the Mobilehome Parks Act, the right to enforce its police power of zoning at the site. He stated that the Homeowners Association is principally interested in local regulatory authority of the health and safety issues, primarily inspections. He added that Stanley Yates has been communicating with him, and with the Council, in this regard. Mayor Mulryan stated that the Council is more than happy to accommodate this request, except he does not yet have an evaluation about how much staff time demands there would be, or the specifics of what the City would be asked to do. Mr. Ragghianti recommended that the Council request staff to evaluate this issue. Stanley Yates, President of the Contempo Marin Homeowners Corporation, addressed the Council, thanking the Council for considering the request, and for their interest in the problems at the Park. He stated that the City Attorney had summed it up very well, and that the biggest problem is Title 25, under which the State regulates the Park, has minimum standards. He added that it is regulated out of Sacramento and to get any results it is necessary to go through the ombudsman with a written request, which takes anywhere from a month to two months, to get an answer. Then, when the inspector finally gets here, he will look only at the specific item, and ignore all of the other health and safety violations in the Park. As for staff time, Mr. Yates stated he does not feel it would take too much, adding that Code Enforcement Officer Roy Butts may have to come out a few times to take care of existing problems, and with the City working with the management, the management will take care of most of the problems. He added that the present management needs to be pushed. He stated that the Park owners are aware of the problems, but do nothing. He noted that with the drought there are additional fire problems. Mr. Yates then informed the Council that, with Contempo being one of the largest pools of affordable housing, the management has made the statement that they want to move in the largest possible factory -built houses and take up as much of the room as they can, and charge as much as they can for the sale of it. He noted there is one up for sale at present, with the asking price of $139,000, which would mean that with a 15% down payment and the rent raise there would be a monthly payment of $1,800 per month. He said it is in place of a double -wide affordable unit. They also built a garage in front, on a curve, about 22 feet from the curb. The people will have to back out on a blind curve. This is the sort of issue which would be picked up if the City had authority. Mayor Mulryan asked staff to provide a report on what would be the impact on staff, and give their recommendations to the Council. Councilmember Breiner questioned the City's present responsibility, and Mr. Ragghianti stated he believes that the Mobilehome Park Act never took away from the City any of its zoning power, whatsoever. Councilmember Shippey noted that, from what Mr. Yates said, the City is losing part of its affordable housing, and the staff report could address how we could control that loss, through zoning or other ordinance. 12. SUMMARY PROCEEDINGS - FORMATION OF BAYPONT LAGOONS LANDSCAPING AND LIGHTING DISTRICT (PW) - File 6-48 Public Works Director Bernardi informed the Council that the landowner, Spinnaker Point Development, Inc., had requested that this item be continued to the meeting of August 20, 1990. CORRESPONDENCE FROM NORTH SAN RAFAEL COALITION OF RESIDENTS RE USE PERMIT FOR MARIN RANCH AIRPORT (P1) - File 12-12 x 12-17 x 100 x 9-3-40 Councilmember Breiner requested this item be placed on the August 6, 1990 Council meeting agenda. After discussion, it was agreed that staff would instead write to the North San Rafael Coalition of Residents, informing them that the use permit has not expired and that their letter will become part of the packet material furnished to the Planning Commis- sion when review of the use permit application is scheduled for hearing. 2. REVIEW OF WETLANDS - File 115 Councilmember Thayer requested that the Council be furnished with a list of projects, including those approved through the Priority Projects Procedure (PPP), affected by the current wetlands setback policy. Councilmember Thayer stated that she would like a more stringent setback policy than the one in the General Plan. 3. DOMINICAN CONVENT FIRE - File 9-3-31 Mayor Mulryan commended the Fire Department on their fine work in controlling the Dominican Convent fire.
