the Resolution Upholding Appeal.

6. REPORT ON $10.00 INCREASE FOR VEHICLE CODE PARKING VIOLATIONS (Fin) -

Mayor Mulryan voiced concern about the City having to print new citation
forms adding the $10.00 increase as ordered by the Municipal Court, and
inquired if the City was having financial assistance from the State.
City Manager Nicolai responded that the City's supply of citation forms
was just about depleted and therefore new forms would shortly have to
be printed anyway without having to throw out any of the old forms.
It was pointed out that the $10.00 increase did not apply to overtime
parking violations.
Council accepted the report, without motion.
8b. CLAIMS FOR DAMAGES: STEPHEN JOHNSON (PD) - File 3-1-1158
Mayor Mulryan requested that Mr. Johnson be pursued for payment of damages
done to a Police car. Assistant City Attorney Casey indicated that it
is general practice for the Finance Department to follow up on damages
done to City property by sending bills out to the people involved.
Councilmember Frugoli moved and Councilmember Breiner seconded, to deny
the claim for damages presented by Mr. Stephen Johnson.

9. REPORT ON WINTER STORM PREPAREDNESS WEEK - NOVEMBER 17 THROUGH NOVEMBER
22, 1986 (PW) - File 9-3-40
Public Works Director Bernardi stated that the Resolution is to call
attention to the fact that everyone should be prepared in case of severe
rainstorms in the coming winter months.

10. DISCUSSION OF TSM TASK FORCE PROGRAM (PW) - File 11-32 x 11-13 x
11-16 x 119
Mayor Mulyan indicated that a meeting had been held with the Chamber
of Commerce, City officials and staff at which time the Chamber expressed
their desire to act in partnership with the City in the Traffic Systems
Management (TSM) Task Force Program.
Ms. Judy Davalos, President of the San Rafael Chamber of Commerce noted
they are enthusiastic about a voluntary traffic system and emphasized
their concern about implementing the program.
Councilmember Nave moved and Councilmember Breiner seconded, that the
City Council conceptually endorse the TSM Policy Statement and authorize
the TSM Task Force to work with the Chamber of Commerce to develop a
program structure.

11. DISCUSSION OF PEACOCK GAP PUMP STATION EMERGENCY GENERATOR (PW) - File

Mayor Mulryan indicated that a meeting was held with the Peacock Gap
community residents within the last week to discuss what the City
planned to do regarding the residents' concerns about flooding problems.
Public Works Director Bernardi stated the City has received a check in
the amount of $4,200 from Mr. Weatherby which would cover the rental
cost of an emergency generator for the first month. Mr. Bernardi noted
that the cost for a three month period would be approximately $17,000
including the cost for an electrician to do the hookup once the generator
is delivered.
City Manager Nicolai requested authorization to lease the emergency
generator, and added that the homeowners have since collected funds to
pay for the first month's rental of the generator themselves. She
stated that the homeowners requested the City meet with their
representatives to discuss long-term solutions to problems in the area,
and noted the City's responsibility generally includes the pump stations
and levee work around the lagoon. However, Ms. Nicolai stated that
tonight was to deal with a short-term situation of leasing the emergency
generator.
Councilmember Russom noted that Council should proceed on a short-term
basis and accept the offer of participation by the residents of Peacock
Gap, with staff to look at a long-range solution involving the City's
participation on an on-going basis.
In response to Councilmember Breiner's inquiry as to the financing of
the three month lease, Ms. Nicolai stated that at the meeting held, the
residents indicated they would come up with the first month's rent and
then go out into the neighborhood to discuss the situation with
neighbors who were not present, hoping to solicit funds from them as
well.
Mr. Sidney Johnson, resident of Peacock Gap, informed Council that
canvassing of the neighbors has been done with 20 checks collected to
date amounting to $2,000, with more money coming in, adding that the
Board of Directors of Peacock Gap Homeowners Association will also be
contributing to the fund.
Mr. Johnson indicated that Mr. Weatherby agreed to underwrite the
initial check for $4,200 and asked Council if they would return the
check since the neighbors now have the money to give to the City.

In response to the question as to what a generator would cost,
Mr. Bernardi informed Council that the cost of a permanently installed
generator would be approximately $100,000.
Mr. Johnson stated that on a long-term basis, they would like to have
a third pump with a generator to back up the pumps and that it be owned
as opposed to being leased. He indicated that the residents are willing
to participate financially in both the short-term and long-term solutions.
Mr. Bernardi indicated that if a third pump was to be added, it would
entail a major renovation or new pump station and the cost of a new pump
station would be about $250,000.
Mrs. Mary Carpou, Secretary, Peacock Gap Homeowners Association, pointed
out the City's responsibility in keeping the streets open and clear,
and stated that this is a "no wait" situation and also a preventative
measure.
After further discussion, Councilmember Breiner moved and Councilmember
Russom seconded, to approve temporary placement of an emergency generator,
to refund Mr. Weatherby's check in amount of $4,200 and accept one month's
payment from the Peacock Gap neighborhood in its place, and also directed
staff to bring back for discussion an overall plan for drainage facilities
in the area at the next meeting of December 1, 1986.

Mayor Mulryan noted that the lagoon is private; however, the City will
work with the residents, and indicated the level of the lagoon will be
immediately lowered one foot as discussed with Mrs. Johnson. The residents
were informed that the City hopes to have the rented emergency generator
in place before the December lst tide, and that a determination will
be made as to how long the generator will be needed and how it is to
be financed.
Councilmember Breiner volunteered to sit in on the Development Committee
meetings held by the Peacock Gap Homeowners Association.
There being no further business, the meeting was adjourned.
