Leoncini, City Clerk ORAL COMMUNICATIONS OF AN URGENCY NATURE: RE: CONCERNS - OAKWOOD SUBDIVISION - File 5-1-244 Mr. Doug Hancock of 205 Spring Grove, San Rafael, spoke of concerns regarding the Oakwood Subdivision and carelessness of the developer, Tyler Development Company. He then listed several items needing attention: 1. Trees over 4" in diameter have been cut prior to design review approval. 2. Protection of mature trees as outlined by City regulations have been ignored. 3. Paving within 6" of trees, stacking of dirt and materials next to trees and tractor injuries continue. Holes for foundation piers 18" by 35 ft. deep have been left with only a single plywood cover over weekends posing a danger to children. 4. Exterior house colors have been applied at the opposite end of the spectrum required by the project's conditions agreed to over 10 years of discussions with previous owners, which should be repainted. 5. Construction equipment, materials and garbage have been left on neighbor's property despite lawyer's letters. 6. Work has started regularly before 7:00 AM until threatened with citations from the Department of Public Works. 7. Requests for temporary stop signs or construction zone notices are unanswered despite, so far, one motor vehicle accident. Mr. Hancock stated his concern is that proper supervision of developer becomes a priority of the City before more destruction and risk to public safety occurs. Mr. Harry Winters, President of the West End Neighborhood Association, reiterated Mr. Hancock's concerns and spoke on the alteration of the drainage on the subject property that would have an impact on his property. Public Works Director Bernardi indicated that problem had been taken care of. Council directed Planning staff to look into the matter of colors on the exterior of houses, and unanimously agreed to have temporary stop signs placed at Spring Grove and Hillside, during the construction period. Set date for Special Meeting of the City Council to interview applicants, for Monday, July 6, 1987 commencing at 6:00 PM in the City Manager's Conference Room 201. Approved staff recommendation: a. Called for applications to fill two 4 -year terms on the Planning Commission, with deadline for receipt, Tuesday, June 23, 1987 at 12:Noon in the City Clerk's Office (Terms to expire the end of June, 1991) b. Set date for Special Meeting of the City Council to interview applicants, including incumbents, for Monday, July 6, 1987 commenc- ing at 6:00 PM in the City Manager's Conference Room 201. STATUS REPORT ON 101 ACTION COMMITTEE (P1) - File 170 At the request of Mayor Mulryan, Planning Director Moore gave a brief report on the status of the 101 Action Committee. Council accepted status report, without motion. 9. REPORT ON BID OPENINGS AND AWARD OF BIDS FOR NEW AND USED VEHICLES PER VEHICLE REPLACEMENT LIST (Gen.Svcs.) - File 4-2-214 Councilmember Breiner voiced concern on the two used full-size station wagons for the Fire Department and Recreation Department, questioning the difference between a new price as opposed to a used one. City Manager Nicolai replied she could not comment on a new cost because bids are requested for used vehicles. She stated once bids are received from rental companies based on various used cars meeting the City's specifications, the City's garage mechanic checks the cars according to the specifications. Ms. Nicolai noted that besides the fact that the two cars have low mileage, Steve Snyder was the only qualified bidder. Councilmember Breiner directed staff to include the age and mileage of vehicles being replaced in future reports. RESOLUTION NO. 7542 - AUTHORIZING THE PURCHASE OF NEW AND USED VEHICLES UTILIZING EQUIPMENT REPLACEMENT FUNDS New 2-4 yard dump truck used by Public Works Department to ISI Inc., (low bidder) in amount of $27,724.30. Two used full-size station wagons, one for the Fire Department and one for the Recreation Department from Steve Snyder Chevrolet (low bidder that meets specifications) in amount of $27,794.66. CLAIM FOR DAMAGES 13.a. Peter H. Nielsen (PW) - File 3-1-1240 Mayor Mulryan indicated that City Attorney had requested Council action on this claim to deny Application for Leave to Present Late Claim. Councilmember Willms moved and Councilmember Breiner seconded, to deny the Application for Leave to Present Late Claim. UP86-12(b); 6 MONTHS STATUS REPORT - REVIEW OF MASTER USE PERMIT FOR DON TIMOTEO SCHOOL; 39 TRELLIS DRIVE; DIXIE SCHOOL DISTRICT, OWNER; MARION DANSIE, REP.; AP 175-060-01 (Pl) - File 10-5 Planning Director Moore stated six months ago Council reviewed the appeal of the Planning Commission action on a master use permit for the Don Timoteo School to allow evening use to continue at the school. Council conditionally approved the master use permit with many condi- tions, and limited evening use. Ms. Moore indicated staff has closely monitored the use permit because of the controversy within the neigh- borhood. A time extention of the master use permit was reviewed by the Zoning Administrator on May 20, 1987 with two neighbors present and Code Enforcement Officer Butts reported he had inspected the site on several occasions in the past six months and found there was no misuse of street parking and there was adequate on-site parking for the various uses. The only matter discussed was an abandoned basketball court being used as a parking area and the Zoning Administrator had the School District and the tenants make appropriate improvements to that area so it would be properly striped as a parking area. The matter has been approved for extension by the Zoning Administrator and there has been no appeal. Ms. Moore indicated a new tenant, (Regional Occupational Program) moved in and the School District failed to inform the present tenants. Impacts were felt by the childcare program because of the inappropriate interactions between the adult's activities and the childcare program, but hopefully this has been worked out by the School District and the tenants. This was not a use permit matter; however, planning staff indicated to the School District to work closely with their tenants to avoid the City's use permit becoming a vehicle for a tenant/ lease situation. Council accepted report without motion. 15. DISCUSSION RE SETTING DATES FOR THE 1987/88 BUDGET HEARINGS (CC) File 8-5 Council unanimously approved setting dates for the 1987/88 Budget Hearings to be held on: Monday, June 22 and Tuesday, June 23, 1987, commencing at 7:30 PM. Both meetings to be held in the Webb Room, San Rafael Public Library. There being no further business, the meeting was adjourned.
